MEMORANDUM AND RECOMMENDATIONS re 40. The court RECOMMENDS that Plaintiff's request for emergency injunctive relief be DENIED. The request for expedited hearing on the emergency motion 38 is DENIED AS MOOT. Objections to M&R due by 5/7/2026. ORDER on Plaintiff's Motion for Leave to Amend GRANTING 11. The proposed complaint 12 is not accepted as the live pleading. By May 8, 2026, Plaintiff is ORDERED to file an amended complaint addressing all deficiencies identified in Transunion's Motion to Dismiss. TransUnions's Motion to Dismiss 32 is DENIED AS MOOT. Plaintiff's Motion to file a Sur-Reply 47 is DENIED AS MOOT. Motion to Stay Discovery Pending Ruling 36 is GRANTED. Discovery is STAYED pending ruling on any Rule12 motions to forthcoming amended complaint. The scheduling order 67 is VACATED, all court settings are canceled. A future scheduling order will be issued, as needed, after ruling on any Rule 12 motion. All pending motions relating to discovery are DENIED 27, 39, 55, 58.
