CREP was administratively established in February 1997, whereby USDA was authorized to enter into agreements with States to address resource concerns (see 7 CFR 1410.50, circa 1997). By October 1997, USDA executed its first CREP agreement with the State of Maryland targeting acreage that, once enrolled, reduces runoff, sediment, and nutrients into the Chesapeake Bay and promotes enhanced wildlife habitats. The 2018 Farm Bill established CREP as a permanent subprogram under CRP
