MEMORANDUM OPINION: Accordingly, the Court will DISMISS this action without prejudice for failure to state a claim and failure to prosecute and comply with an Order of the Court. See Rodriguez, 62 F.4th at 277. Finally, the Court CERTIFIES that any appeal from this action would not be taken in good faith and would be totally frivolous. See 28 U.S.C. § 1915(a)(3); Fed. R. App. P. 24(a). Should Plaintiff file a notice of appeal, he will be DENIED leave to appeal in forma pauperis. See id. AN APPROPRIATE JUDGMENT ORDER SHALL ENTER.
