 To amend part E of title IV of the Social Security Act to provide for 
  the making of foster care maintenance payments to private for-profit 
             agencies. <<NOTE: Nov. 22, 2005 -  [S. 1894]>> 

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress <<NOTE: Fair Access Foster Care Act 
of 2005. 42 USC 1305 note.>> assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Fair Access Foster Care Act of 
2005''.

SEC. 2. FOSTER CARE MAINTENANCE PAYMENTS TO PRIVATE FOR-PROFIT AGENCIES.

    Section 472(b) of the Social Security Act (42 U.S.C. 672(b)) is 
amended by striking ``nonprofit'' each place it appears.
