<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e44e00a-5922-11f1-8b30-a3426597295f" style="-uslm-lc:I658180">Cape Fox Land Entitlement Finalization Act of 2025.</p></sidenote>
<section id="d464e88" identifier="/us/pl/119/93/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Cape Fox Land Entitlement Finalization Act of 2025</shortTitle>”.</content></section>
<section id="d464e98" identifier="/us/pl/119/93/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x9e452e2b-5922-11f1-8b30-a3426597295f" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y9e452e2c-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Cape fox</inline>.—</heading><content>The term “<term>Cape Fox</term>” means the Cape Fox Village Corporation, a Village Corporation for the Native Village of Saxman, Alaska, organized pursuant to the Alaska Native Claims Settlement Act (<ref href="/us/usc/t43/s1601/etseq">43 U.S.C. 1601 et seq.</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y9e452e2d-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Federal land</inline>.—</heading><content>The term “<term>Federal land</term>” means the approximately 180 acres of surface land within the Tongass National Forest in the State of Alaska, as generally depicted on the Map.</content></paragraph>
<paragraph class="fontsize10" id="y9e452e2e-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>Map</term>” means the map entitled “Cape Fox Village Corporation Final Selection” and dated December 18, 2023.</content></paragraph>
<paragraph class="fontsize10" id="y9e452e2f-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>

<section id="d464e145" identifier="/us/pl/119/93/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>WAIVER OF CORE TOWNSHIP REQUIREMENT FOR CERTAIN LAND.</heading><subsection class="firstIndent0 fontsize10" id="y9e457c50-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Notwithstanding section 16(b) of the Alaska Native Claims Settlement Act (<ref href="/us/usc/t43/s1615/b">43 U.S.C. 1615(b)</ref>), Cape Fox shall not be required to select or receive conveyance of the approximately 185 acres of unconveyed land described in subsection (b) located within the township in which the Native Village of Saxman, Alaska, is located.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9e457c51-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Land Described</inline>.—</heading><chapeau>The land referred to in subsection (a) is as follows:</chapeau><paragraph class="fontsize10" id="y9e457c52-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Approximately 40 acres in T. 74 S., R.90 E., sec. 10, SWNE, Copper River Meridian.</content></paragraph>
<paragraph class="fontsize10" id="y9e457c53-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Approximately 144.57 acres in T. 75 S., R.91 E., sec. 1, lots 1, 3, and 4, Copper River Meridian.</content></paragraph>

<section id="d464e183" identifier="/us/pl/119/93/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e457c54-5922-11f1-8b30-a3426597295f" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading>SELECTION OUTSIDE EXTERIOR SELECTION BOUNDARY.</heading><subsection class="firstIndent0 fontsize10" id="y9e45ca75-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e45f186-5922-11f1-8b30-a3426597295f" style="-uslm-lc:I658180">Notice.</p></sidenote><inline class="smallCaps">Selection and Conveyance of Surface Estate</inline>.—</heading><content>Not later than 90 days after the date of enactment of this Act, if Cape Fox submits to the Secretary a written notice of selection <page identifier="/us/stat/140/829">140 STAT. 829</page>
of the Federal land, the Secretary shall, on receiving that written notice, convey the Federal land to Cape Fox.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9e45f187-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conveyance of Subsurface Estate</inline>.—</heading><content>On conveyance to Cape Fox of the surface estate to the Federal land under subsection (a), the Secretary shall convey to Sealaska Corporation the subsurface estate to that Federal land.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9e45f188-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Timing</inline>.—</heading><content>It is the intent of Congress that the Secretary complete the conveyances to Cape Fox and Sealaska Corporation under subsections (a) and (b), respectively, as soon as practicable after the date on which the Secretary receives a written notice of the selection of Cape Fox under subsection (a), but not later than 180 days after the date on which the Secretary receives that written notice.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9e45f189-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Entitlement Fulfilled</inline>.—</heading><chapeau>The conveyance of Federal land to Cape Fox and the subsurface interest in the Federal land to Sealaska Corporation under subsections (a) and (b), respectively, shall be considered to fulfill the entitlement of—</chapeau><paragraph class="fontsize10" id="y9e45f18a-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Cape Fox under section 16 of the Alaska Native Claims Settlement Act (<ref href="/us/usc/t43/s1615">43 U.S.C. 1615</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="y9e45f18b-5922-11f1-8b30-a3426597295f" identifier="/us/pl/119/93/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Sealaska Corporation to any subsurface interest in the Federal land under section 14(f) of that Act (<ref href="/us/usc/t43/s1613/f">43 U.S.C. 1613(f)</ref>).</content></paragraph>

</section>
<section id="d464e252" identifier="/us/pl/119/93/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>PUBLIC ACCESS EASEMENT.</heading><content style="-uslm-lc:I658120">  The conveyance of the Federal land under section 4 shall be subject to the reservation of a public easement under section 17(b) of the Alaska Native Claims Settlement Act (<ref href="/us/usc/t43/s1616/b">43 U.S.C. 1616(b)</ref>) to allow for access to National Forest System land further inland on Revillagigedo Island from the George Inlet.</content></section>
<section id="d464e262" identifier="/us/pl/119/93/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>VALID EXISTING RIGHTS.</heading><content style="-uslm-lc:I658120">  Unless otherwise agreed to by the Secretary, the Secretary of Agriculture, and Cape Fox, the conveyances under this legislation shall be subject to any valid existing rights, reservations, rights-of-way, and other encumbrances of third parties in, to, or on the Federal land as of the date of enactment of this Act.</content></section>
