<section id="d310e102" identifier="/us/pl/119/91/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Sloan Canyon Conservation and Lateral Pipeline Act</shortTitle>”.</content></section>
<section id="d310e112" identifier="/us/pl/119/91/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd908ea95-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="yd908ea96-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Conservation area</inline>.—</heading><content>The term “<term>Conservation Area</term>” means the Sloan Canyon National Conservation Area.</content></paragraph>
<paragraph class="fontsize10" id="yd908ea97-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</content></paragraph>

<section id="d310e137" identifier="/us/pl/119/91/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>SLOAN CANYON NATIONAL CONSERVATION AREA BOUNDARY ADJUSTMENT.</heading><subsection class="firstIndent0 fontsize10" id="yd90a7138-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Boundary Adjustment</inline>.—</heading><paragraph class="fontsize10" id="yd90a7139-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>Section 603(4) of the Sloan Canyon National Conservation Area Act (<ref href="/us/usc/t16/s460qqq–1/4">16 U.S.C. 460qqq–1(4)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>map entitled ‘Southern Nevada Public Land Management Act’ and dated October 1, 2002</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>map entitled ‘Proposed Sloan Canyon Expansion’ and dated May 20, 2024</quotedText>”.</content></paragraph>
<paragraph class="fontsize10" id="yd90a713a-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/a/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Acreage</inline>.—</heading><content>Section 604(b) of the Sloan Canyon National Conservation Area Act (<ref href="/us/usc/t16/s460qqq–2/b">16 U.S.C. 460qqq–2(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>48,438</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>57,728</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd90a713b-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Right-of-Way</inline>.—</heading><content>Section 605 of the Sloan Canyon National Conservation Area Act (<ref href="/us/usc/t16/s460qqq–3">16 U.S.C. 460qqq–3</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yd90b348c-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd90b348d-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658180">Water.</p><p class="leftAlign firstIndent0 fontsize8" id="xd90b348e-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658180">Deadlines.</p></sidenote><inline class="smallCaps">Horizon Lateral Pipeline Right-of-Way</inline>.—</heading><paragraph class="fontsize10" id="yd90b348f-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Notwithstanding sections 202 and 503 of the Federal Land Policy and Management Act of 1976 (<ref href="/us/usc/t43/s1712">43 U.S.C. 1712</ref>, 1763) and subject to valid existing rights and paragraph (3), the Secretary of the Interior, acting through the Director of the Bureau of Land Management (referred to in this subsection as the ‘Secretary’), shall, not later than 1 year after the date of enactment of this subsection, grant to the Southern Nevada Water Authority (referred to in this subsection as the ‘Authority’), not subject to the payment of rents or other charges, the temporary and permanent water <page identifier="/us/stat/140/823">140 STAT. 823</page>
pipeline infrastructure, and outside the boundaries of the Conservation Area, powerline, facility, and access road rights-of-way depicted on the map for the purposes of—</chapeau><subparagraph class="fontsize10" id="yd90b3490-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>performing geotechnical investigations within the rights-of-way; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd90b3491-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>constructing and operating water transmission and related facilities.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd90b3492-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Excavation and disposal</inline>.—</heading><subparagraph class="fontsize10" id="yd90b5ba3-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Authority may, without consideration, excavate and use or dispose of sand, gravel, minerals, or other materials from the tunneling of the water pipeline necessary to fulfill the purpose of the rights-of-way granted under paragraph (1).</content></subparagraph>
<subparagraph class="fontsize10" id="yd90b5ba4-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Memorandum of understanding</inline>.—</heading><content>Not later than 30 days after the date on which the rights-of-way are granted under paragraph (1), the Secretary and the Authority shall enter into a memorandum of understanding identifying Federal land on which the Authority may dispose of materials under subparagraph (A) to further the interests of the Bureau of Land Management.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd90b5ba5-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>A right-of-way issued under this subsection shall be subject to the following requirements:</chapeau><subparagraph class="fontsize10" id="yd90b5ba6-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The Secretary may include reasonable terms and conditions, consistent with section 505 of the Federal Land Policy and Management Act of 1976 (<ref href="/us/usc/t43/s1765">43 U.S.C. 1765</ref>), as are necessary to protect Conservation Area resources.</content></subparagraph>
<subparagraph class="fontsize10" id="yd90b5ba7-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Construction of the water pipeline shall not permanently adversely affect conservation area surface resources.</content></subparagraph>
<subparagraph class="fontsize10" id="yd90b5ba8-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>The right-of-way shall not be located through or under any area designated as wilderness.”</content></subparagraph>

</subsection>

<subsection class="firstIndent0 fontsize10" id="yd90b5ba9-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Preservation of Transmission and Utility Corridors and Rights-of-Way</inline>.—</heading><chapeau>The expansion of the Conservation Area boundary under the amendment made by subsection (a)—</chapeau><paragraph class="fontsize10" id="yd90b5baa-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd90b5bab-5ab0-11f1-8e98-618c15b6cdbd" style="-uslm-lc:I658180">Record.</p></sidenote>shall be subject to valid existing rights, including land within a designated utility transmission corridor or a transmission line right-of-way grant approved by the Secretary in a record of decision issued before the date of the enactment of this Act;</content></paragraph>
<paragraph class="fontsize10" id="yd90b5bac-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>shall not preclude—</chapeau><subparagraph class="fontsize10" id="yd90b5bad-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any activity authorized in accordance with a designated corridor or right-of-way referred to in paragraph (1), including the operation, maintenance, repair, or replacement of any authorized utility facility within the corridor or right-of-way; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd90b82be-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>the Secretary from authorizing the establishment of a new utility facility right-of-way within an existing designated transportation and utility corridor referred to in paragraph (1)—</chapeau><clause class="fontsize10" id="yd90b82bf-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/c/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in accordance with the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321/etseq">42 U.S.C. 4321 et seq.</ref>) and other applicable laws; and</content></clause>
<clause class="fontsize10" id="yd90b82c0-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/c/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>subject to such terms and conditions as the Secretary determines to be appropriate.</content></clause>
</subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd90b82c1-5ab0-11f1-8e98-618c15b6cdbd" identifier="/us/pl/119/91/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Management of the Conservation Area</inline>.—</heading><content>Except as provided in the amendment made by subsection (b), nothing in this Act or the amendments made by this Act shall modify the management of the Conservation Area pursuant to section 605 of the <page identifier="/us/stat/140/824">140 STAT. 824</page>
Sloan Canyon National Conservation Area Act (<ref href="/us/usc/t16/s460qqq–3">16 U.S.C. 460qqq–3</ref>).</content></subsection>
