<section id="d970e88" identifier="/us/pl/119/73/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdedcc710-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Trafficking Survivors Relief Act</shortTitle>”.</content></section>
<section id="d970e103" identifier="/us/pl/119/73/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FEDERAL EXPUNGEMENT FOR VICTIMS OF TRAFFICKING.</heading><subsection class="firstIndent0 fontsize10" id="ydee07091-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t18/ch237">Chapter 237 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="ydee32fb2-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658165"><num class="fontsize12" value="3771A">“§ 3771A.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee32fb3-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Courts.</p><p class="leftAlign firstIndent0 fontsize8" id="xdee32fb4-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Records.</p><p class="leftAlign firstIndent0 fontsize8" id="xdee32fb5-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s3771A">18 USC 3771A</ref>.</p></sidenote>Motion to vacate; expungement; mitigating factors</heading><subsection class="firstIndent0 fontsize10" id="ydee32fb6-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="ydee356c7-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term ‘<term>child</term>’ means an individual who has not attained 18 years of age;</content></paragraph>
<paragraph class="fontsize10" id="ydee356c8-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>the term ‘<term>covered prisoner</term>’ means an individual who—</chapeau><subparagraph class="fontsize10" id="ydee356c9-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>was convicted of a level A offense or level B offense;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee356ca-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>was sentenced to a term of imprisonment for the offense described in subparagraph (A); and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee356cb-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>is, or was previously, imprisoned or incarcerated under such sentence for a term of imprisonment;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee356cc-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the terms ‘employee’ and ‘officer’ have the meanings given the terms in section 2105 of title 5;</content></paragraph>
<paragraph class="fontsize10" id="ydee356cd-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>the term ‘<term>Federal offense</term>’ means an offense that is punishable under Federal law;</content></paragraph>
<paragraph class="fontsize10" id="ydee356ce-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>the term ‘<term>level A offense</term>’ means a Federal offense that is not a violent crime;</content></paragraph>
<paragraph class="fontsize10" id="ydee356cf-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><chapeau>the term ‘<term>level B offense</term>’—</chapeau><subparagraph class="fontsize10" id="ydee356d0-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>means a Federal offense that is a violent crime; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee356d1-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>does not include a Federal offense that is a violent crime of which a child was a victim;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee356d2-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>the term ‘<term>victim of trafficking</term>’ has the meaning given that term in section 103 of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7102">22 U.S.C. 7102</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="ydee356d3-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>the term ‘<term>violent crime</term>’ has the meaning given the term ‘<term>crime of violence</term>’ in section 16(a) of this title.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydee356d4-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Motions To Vacate Convictions or Expunge Arrests</inline>.—</heading><paragraph class="fontsize10" id="ydee356d5-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><subparagraph class="fontsize10" id="ydee356d6-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Convictions of level a offenses</inline>.—</heading><content>A person convicted of any level A offense (or an attorney representing <page identifier="/us/stat/139/2004">139 STAT. 2004</page>
such a person) may move the court that imposed the sentence for the level A offense to vacate the judgment of conviction if the level A offense was committed as a direct result of the person having been a victim of trafficking.</content></subparagraph>
<subparagraph class="fontsize10" id="ydee356d7-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Arrests for level a offenses</inline>.—</heading><content>A person arrested for any level A offense (or an attorney representing such a person) may move the district court of the United States for the district and division embracing the place where the person was arrested to expunge all records of the arrest if the conduct or alleged conduct of the person that resulted in the arrest was directly related to the person having been a victim of trafficking.</content></subparagraph>
<subparagraph class="fontsize10" id="ydee356d8-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Arrests for level b offenses</inline>.—</heading><chapeau>A person arrested for any level B offense (or an attorney representing such a person) may move the district court of the United States for the district and division embracing the place where the person was arrested to expunge all records of the arrest if—</chapeau><clause class="fontsize10" id="ydee356d9-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the conduct or alleged conduct of the movant that resulted in the arrest was directly related to the movant having been a victim of trafficking; and</content></clause>
<clause class="fontsize10" id="ydee356da-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii)</num><subclause class="inline" id="ydee356db-fe1e-11f0-85eb-bfa20168462a"><num value="I">(I) </num><content>the movant was acquitted of the level B offense;</content></subclause>
<subclause class="indentUp0 fontsize10" id="ydee356dc-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the Government did not pursue, or the Government moved to dismiss, criminal charges against the movant for the level B offense; or</content></subclause>
<subclause class="indentUp0 fontsize10" id="ydee37ded-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III)</num><item class="inline" id="ydee37dee-fe1e-11f0-85eb-bfa20168462a"><num value="aa">(aa) </num><content>the charges against the movant for the level B offense were reduced to an offense that is a level A offense; and</content></item>
<item class="indentUp0 fontsize10" id="ydee37def-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the movant was acquitted of the level A offense, the Government did not pursue, or the Government moved to dismiss, criminal charges against the movant for the level A offense, or any subsequent conviction of the level A offense was vacated.</content></item>

</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee37df0-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Contents of motion</inline>.—</heading><chapeau>A motion described in paragraph (1) shall—</chapeau><subparagraph class="fontsize10" id="ydee37df1-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>be in writing;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee37df2-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>describe any supporting evidence;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee37df3-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>state the offense; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee37df4-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>include copies of any documents showing that the movant is entitled to relief under this section.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee37df5-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee37df6-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><inline class="smallCaps">Hearing</inline>.—</heading><subparagraph class="fontsize10" id="ydee37df7-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Mandatory hearing</inline>.—</heading><clause class="fontsize10" id="ydee37df8-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Motion in opposition</inline>.—</heading><content>Not later than 30 days after the date on which a motion is filed under paragraph (1), the Government may file a motion in opposition of the motion filed under paragraph (1).</content></clause>
<clause class="fontsize10" id="ydee37df9-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Mandatory hearing</inline>.—</heading><content>If the Government files a motion described in clause (i), not later than 15 days after the date on which the motion is filed, the court shall hold a hearing on the motion.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee37dfa-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Discretionary hearing</inline>.—</heading><content>If the Government does not file a motion described in subparagraph (A)(i), the court may hold a hearing on the motion not later than 45 days after the date on which a motion is filed under paragraph (1).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee37dfb-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee37dfc-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Notices.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Factors</inline>.—</heading><page identifier="/us/stat/139/2005">139 STAT. 2005</page>
<subparagraph class="fontsize10" id="ydee37dfd-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Vacating convictions of level a offenses</inline>.—</heading><chapeau>The court may grant a motion under paragraph (1)(A) if, after notice to the Government and an opportunity to be heard, the court finds, by a preponderance of the evidence, that—</chapeau><clause class="fontsize10" id="ydee37dfe-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the movant was convicted of a level A offense; and</content></clause>
<clause class="fontsize10" id="ydee37dff-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the participation in the level A offense by the movant was a direct result of the movant having been a victim of trafficking.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee37e00-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Expunging arrests for level a offenses</inline>.—</heading><chapeau>The court may grant a motion under paragraph (1)(B) if, after notice to the Government and an opportunity to be heard, the court finds, by a preponderance of the evidence, that—</chapeau><clause class="fontsize10" id="ydee37e01-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the movant was arrested for a level A offense; and</content></clause>
<clause class="fontsize10" id="ydee3a512-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the conduct or alleged conduct that resulted in the arrest was directly related to the movant having been a victim of trafficking.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee3a513-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Expunging arrests for level b offenses</inline>.—</heading><chapeau>The court may grant a motion under paragraph (1)(C) if, after notice to the Government and an opportunity to be heard, the court finds, by a preponderance of the evidence, that—</chapeau><clause class="fontsize10" id="ydee3a514-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the movant was arrested for a level B offense and the conduct or alleged conduct that resulted in the arrest was directly related to the movant having been a victim of trafficking; and</content></clause>
<clause class="fontsize10" id="ydee3a515-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii)</num><subclause class="inline" id="ydee3a516-fe1e-11f0-85eb-bfa20168462a"><num value="I">(I) </num><content>the movant was acquitted of the level B offense;</content></subclause>
<subclause class="indentUp0 fontsize10" id="ydee3a517-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the Government did not pursue, or the Government moved to dismiss, criminal charges against the movant for the level B offense; or</content></subclause>
<subclause class="indentUp0 fontsize10" id="ydee3a518-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III)</num><item class="inline" id="ydee3a519-fe1e-11f0-85eb-bfa20168462a"><num value="aa">(aa) </num><content>the charges against the movant for the level B offense were reduced to a level A offense; and</content></item>
<item class="indentUp0 fontsize10" id="ydee3a51a-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the movant was acquitted of the level A offense, the Government did not pursue, or the Government moved to dismiss, criminal charges against the movant for the level A offense, or any subsequent conviction of that level A offense was vacated.</content></item>

</paragraph>
<paragraph class="fontsize10" id="ydee3a51b-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee3a51c-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Determinations.</p></sidenote><inline class="smallCaps">Supporting evidence</inline>.—</heading><subparagraph class="fontsize10" id="ydee3a51d-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee3a51e-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Testimony.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><chapeau>For purposes of this section, in determining whether the movant is a victim of trafficking, the court—</chapeau><clause class="fontsize10" id="ydee3a51f-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee3a520-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Affidavit.</p></sidenote>shall consider an affidavit or sworn testimony of an anti-human trafficking service provider or clinician; and</content></clause>
<clause class="fontsize10" id="ydee3a521-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>may consider any supporting evidence the court determines is of sufficient credibility and probative value, including sworn testimony from a law enforcement officer detailing the role of the movant in coercing other victims of trafficking into committing criminal offenses.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee3a522-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Affidavit or sworn testimony sufficient evidence</inline>.—</heading><chapeau>The affidavit or sworn testimony described in subparagraph (A)(i) shall be sufficient evidence to vacate <page identifier="/us/stat/139/2006">139 STAT. 2006</page>
a conviction or expunge an arrest under this section if the court determines that—</chapeau><clause class="fontsize10" id="ydee3a523-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the affidavit or sworn testimony is credible; and</content></clause>
<clause class="fontsize10" id="ydee3a524-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>no other evidence is readily available.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee3a525-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Conviction or arrest of other persons not required</inline>.—</heading><content>It shall not be necessary that any person other than the movant be convicted of or arrested for an offense before the movant may file a motion under paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="ydee3a526-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Denial of motion</inline>.—</heading><subparagraph class="fontsize10" id="ydee3a527-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Finality</inline>.—</heading><content>If the court denies a motion filed under paragraph (1), the denial shall be final, except as provided under subparagraph (C) of this paragraph and subject to the discovery of any new and compelling evidence or information.</content></subparagraph>
<subparagraph class="fontsize10" id="ydee3a528-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Reasons for denial</inline>.—</heading><content>If the court denies a motion filed under paragraph (1), the court shall state the reasons for the denial in writing.</content></subparagraph>
<subparagraph class="fontsize10" id="ydee3a529-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Reasonable time to cure deficiencies in motion</inline>.—</heading><content>If the court denies a motion filed under paragraph (1) due to a curable deficiency in the motion, the court shall allow the movant sufficient time to cure the deficiency.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee3a52a-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Appeal</inline>.—</heading><content>An order granting or denying a motion under this section may be appealed in accordance with section 1291 of title 28.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydee3a52b-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Vacatur of Convictions</inline>.—</heading><paragraph class="fontsize10" id="ydee3a52c-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>If the court grants a motion to vacate a conviction of a level A offense under subsection (b), the court shall immediately—</chapeau><subparagraph class="fontsize10" id="ydee3cb3d-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>vacate the conviction for cause;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee3cb3e-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>set aside the verdict and enter a judgment of acquittal; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee3cb3f-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>enter an expungement order that directs that there be expunged from all official records all references to—</chapeau><clause class="fontsize10" id="ydee3cb40-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the arrest of the movant for the level A offense;</content></clause>
<clause class="fontsize10" id="ydee3cb41-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the institution of criminal proceedings against the movant relating to the level A offense; and</content></clause>
<clause class="fontsize10" id="ydee3cb42-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the results of the proceedings.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee3cb43-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>Nothing in this subsection requires a court to amend or remove any fine or restitution order in a criminal or civil proceeding.</content></paragraph>
<paragraph class="fontsize10" id="ydee3cb44-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Effect</inline>.—</heading><content>If a conviction is vacated under an order entered under paragraph (1), the conviction shall not be regarded as a conviction under Federal law and the movant for whom the conviction was vacated shall be considered to have the status occupied by the movant before the arrest or the institution of the criminal proceedings related to such conviction.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydee3cb45-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Expungement of Arrests</inline>.—</heading><paragraph class="fontsize10" id="ydee3cb46-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>If the court grants a motion to expunge all records of an arrest for an offense under subsection (b), the court shall immediately enter an expungement order that directs that there be expunged from all official records all references to—</chapeau><subparagraph class="fontsize10" id="ydee3cb47-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the arrest of the movant for the offense;<page identifier="/us/stat/139/2007">139 STAT. 2007</page></content></subparagraph>
<subparagraph class="fontsize10" id="ydee3cb48-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the institution of any criminal proceedings against the movant relating to the offense; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee3cb49-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the results of the proceedings, if any.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee3cb4a-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Effect</inline>.—</heading><content>If an arrest is expunged under an order entered under paragraph (1) the arrest shall not be regarded as an arrest under Federal law and the movant for whom the arrest is expunged shall be considered to have the status occupied by the movant before the arrest or the institution of the criminal proceedings related to such arrest, if any.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydee3cb4b-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Mitigating Factors</inline>.—</heading><paragraph class="fontsize10" id="ydee3cb4c-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The court that imposed sentence for a level A offense or level B offense upon a covered prisoner may reduce the term of imprisonment for the offense—</chapeau><subparagraph class="fontsize10" id="ydee3cb4d-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>upon—</chapeau><clause class="fontsize10" id="ydee3cb4e-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>motion by the covered prisoner; or</content></clause>
<clause class="fontsize10" id="ydee3cb4f-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the court’s own motion;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee3cb50-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee3cb51-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Notice.</p></sidenote><content>after notice to the Government;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee3cb52-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>after considering—</chapeau><clause class="fontsize10" id="ydee3cb53-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the factors set forth in section 3553(a);</content></clause>
<clause class="fontsize10" id="ydee3cb54-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the nature and seriousness of the danger to any person, if applicable; and</content></clause>
<clause class="fontsize10" id="ydee3cb55-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the community, or any crime victims; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee3cb56-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>if the court finds, by a preponderance of the evidence, that the covered prisoner committed the offense as a direct result of the covered prisoner having been a victim of trafficking.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydee3cb57-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content>Any proceeding under this subsection shall be subject to section 3771.</content></paragraph>
<paragraph class="fontsize10" id="ydee3cb58-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee3cb59-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180">Assessment.</p></sidenote><inline class="smallCaps">Particularized inquiry</inline>.—</heading><content>For any motion under paragraph (1), the Government shall conduct a particularized inquiry of the facts and circumstances of the original sentencing of the covered prisoner in order to assess whether a reduction in sentence would be consistent with this section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydee3f26a-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Additional Actions by Court</inline>.—</heading><content>The court shall, upon granting a motion under this section, take any additional action necessary to grant the movant full relief.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydee3f26b-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">No Fees</inline>.—</heading><content>A person may not be required to pay a filing fee, service charge, copay fee, processing fee, or any other charge for filing a motion under this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydee3f26c-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Confidentiality of Movant</inline>.—</heading><paragraph class="fontsize10" id="ydee3f26d-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A motion under this section and any documents, pleadings, or orders relating to the motion shall be filed under seal.</content></paragraph>
<paragraph class="fontsize10" id="ydee3f26e-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Information not available for public inspection</inline>.—</heading><content>An officer or employee may not make available for public inspection any report, paper, picture, photograph, court file, or other document, in the custody or possession of the officer or employee, that identifies the movant.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ydee5520a-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Government Accountability Office</inline>.—</heading><chapeau>Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</chapeau><paragraph class="fontsize10" id="ydee5520b-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>assesses the impact of the enactment of <ref href="/us/usc/t18/s3771A">section 3771A of title 18, United States Code</ref>, as added by section 2; and</content></paragraph>
<paragraph class="fontsize10" id="ydee5520c-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>includes—</chapeau><subparagraph class="fontsize10" id="ydee5520d-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s3/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of human trafficking survivors who have filed motions for vacatur or expungement under such section 3771A;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee5791e-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s3/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the final determination of each court that adjudicated a motion described in subparagraph (A);</content></subparagraph>
<subparagraph class="fontsize10" id="ydee5791f-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s3/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>recommendations to increase access to post-conviction relief for human trafficking survivors with Federal criminal records; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee57920-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s3/c/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>recommendations for improving the implementation and tracking of professional training of United States attorneys on indicators of human trafficking.</content></subparagraph>

<section id="d970e967" identifier="/us/pl/119/73/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee57921-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10110">34 USC 10110 note</ref>.</p></sidenote><heading>USE OF GRANTS FOR POST-CONVICTION RELIEF REPRESENTATION.</heading><content style="-uslm-lc:I658120">  The Office of Justice Programs or the Office on Violence Against Women, in awarding a grant that may be used for legal representation, may not prohibit a recipient from using the grant for legal representation for post-conviction relief.</content></section>
<section id="d970e979" identifier="/us/pl/119/73/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xdee5a032-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="ydee5a033-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s5/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>this Act is a first step to address the changing tactics of human traffickers, who are using forced criminality as a form of force, fraud, and coercion in their human trafficking enterprises; and</content></paragraph>
<paragraph class="fontsize10" id="ydee5a034-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s5/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Congress is committed to continuing to find solutions as needed to thwart human traffickers and protect survivors of human trafficking.<page identifier="/us/stat/139/2009">139 STAT. 2009</page></content></paragraph>

<section id="d970e999" identifier="/us/pl/119/73/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>HUMAN TRAFFICKING DEFENSE.</heading><subsection class="firstIndent0 fontsize10" id="ydee5ee55-fe1e-11f0-85eb-bfa20168462a" identifier="/us/pl/119/73/s6/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t18/ch1">Chapter 1 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="ydee63c76-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658162"><num class="fontsize12" value="28">“§ 28.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee63c77-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s28">18 USC 28</ref>.</p></sidenote>Human trafficking defense</heading><subsection class="firstIndent0 fontsize10" id="ydee63c78-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="ydee63c79-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term ‘<term>covered Federal offense</term>’ means a level A offense or level B offense, as those terms are defined in section 3771A; and</content></paragraph>
<paragraph class="fontsize10" id="ydee63c7a-fe1e-11f0-85eb-bfa20168462a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the term ‘<term>victim of trafficking</term>’ has the meaning given the term in section 103 of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7102">22 U.S.C. 7102</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydee63c7b-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Duress</inline>.—</heading><content>In a prosecution for a covered Federal offense, a defendant may establish duress by demonstrating that the defendant was a victim of trafficking at the time at which the defendant committed the offense.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydee63c7c-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Record or Proceeding Under Seal</inline>.—</heading><content>In any proceeding in which a defense under subsection (b) is raised, any record or part of the proceeding related to the defense shall, on motion, be placed under seal until such time as a conviction is entered for the offense.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydee63c7d-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Post-Conviction Relief</inline>.—</heading><content>A failure to assert, or failed assertion of, a defense under subsection (b) by an individual who is convicted of a covered Federal offense may not preclude the individual from asserting as a mitigating factor, at sentencing or in a proceeding for any post-conviction relief, that at the time of the commission of the offense, the defendant was a victim of trafficking and committed the offense under duress.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydee63c7e-fe1e-11f0-85eb-bfa20168462a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Federal Aid</inline>.—</heading><content>A failure to assert, or failed assertion of, a defense under subsection (b) by an individual who is convicted of a covered Federal offense may not be used for the purpose of disqualifying the individual from participating in any federally funded program that aids victims of trafficking.”</content></subsection>
