<section id="d234e90" identifier="/us/pl/119/71/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">VA Budget Shortfall Accountability Act</shortTitle>”.</content></section>
<section id="d234e100" identifier="/us/pl/119/71/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FUNDING SHORTFALLS IN CERTAIN ADMINISTRATIONS OF THE DEPARTMENT OF VETERANS AFFAIRS: REVIEWS; REPORTS.</heading><subsection class="firstIndent0 fontsize10" id="y22e9eeea-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">First GAO Review</inline>.—</heading><paragraph class="fontsize10" id="y22ea15fb-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Review required</inline>.—</heading><chapeau>Not later than 30 days after the date of the enactment of this Act, the Comptroller General of the United States shall begin a review regarding the circumstances surrounding, and the causes of—</chapeau><subparagraph class="fontsize10" id="y22ea3d0c-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the shortfall in the funding of the Veterans Benefits Administration for fiscal year 2024; and</content></subparagraph>
<subparagraph class="fontsize10" id="y22ea3d0d-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the expected shortfall in the funding of the Veterans Health Administration in fiscal year 2025.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y22ea3d0e-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The review under this subsection shall include the following elements:</chapeau><subparagraph class="fontsize10" id="y22ea641f-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>A comparison of monthly obligations and expenditures in relevant accounts against the spending plan of the Department of Veterans Affairs.</content></subparagraph>
<subparagraph class="fontsize10" id="y22ea6420-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Any transfers between accounts described in subparagraph (A).</content></subparagraph>
<subparagraph class="fontsize10" id="y22ea6421-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>The reasons for any significant diversions of obligations or expenditures from such spending plan.</content></subparagraph>
<subparagraph class="fontsize10" id="y22ea6422-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>An analysis of the accuracy of any projections or estimates relevant to diversions described in subparagraph (C).</content></subparagraph>
<subparagraph class="fontsize10" id="y22ea6423-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><chapeau>Remedial actions the Secretary of Veterans Affairs may take—</chapeau><clause class="fontsize10" id="y22ea6424-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2/E/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>to improve the accuracy of supporting information submitted under <ref href="/us/usc/t31/s1105/a">section 1105(a) of title 31, United States Code</ref>, with respect to the Department; and</content></clause>
<clause class="fontsize10" id="y22ea6425-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/2/E/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>to prevent funding shortfalls for the Department.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y22ea6426-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 30 days after completing such review, the Comptroller General shall submit to the Secretary of Veterans Affairs a written report containing the results and findings of such review.<page identifier="/us/stat/139/2000">139 STAT. 2000</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y22ea6427-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Subsequent GAO Reviews</inline>.—</heading><content>In each of the five calendar years following the date of the enactment of this Act, the Comptroller General shall conduct a review including the elements described in subsection (a)(2), and submit a report described in subsection (a)(3), regarding the funding of the Department of Veterans Affairs for the most recent fiscal year to end before the date of such review.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y22ea6428-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Reports of the Secretary of Veterans Affairs</inline>.—</heading><chapeau>Not later than 30 days after the Secretary of Veterans Affairs receives a report of the Comptroller General under subsection (a) or (b), the Secretary shall submit such report to—</chapeau><paragraph class="fontsize10" id="y22ea6429-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committees on Veterans’ Affairs of the House of Representatives and the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="y22ea8b3a-fd07-11f0-85eb-bfa20168462a" identifier="/us/pl/119/71/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committees on Appropriations of the House of Representatives and the Senate.</content></paragraph>
