<section id="d944e98" identifier="/us/pl/118/99/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896d80b1-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s101">40 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Reuse Excess Property Act</shortTitle>”.</content></section>
<section id="d944e113" identifier="/us/pl/118/99/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REPORTING ON EXCESS PERSONAL PROPERTY.</heading><subsection class="firstIndent0 fontsize10" id="y896e9222-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t40/ch5/schII">Subchapter II of chapter 5 of title 40, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y896e9223-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in section 529—</chapeau><subparagraph class="fontsize10" id="y896e9224-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a), in the matter preceding paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives</quotedText>” after “<quotedText>Administrator of General Services</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y896e9225-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y896eb936-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896eb937-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><inline class="smallCaps">Compilation of Data</inline>.—</heading><chapeau>Not later than 180 days following the close of a fiscal year, the Administrator shall compile the data in the reports submitted under subsection (a) and submit to the Committee on Homeland Security Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives and publish on a centralized online website a publicly available report, which shall include—</chapeau><paragraph class="fontsize10" id="y896ee048-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the complete data provided in each report in a user-friendly format;</content></paragraph>
<paragraph class="fontsize10" id="y896ee049-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896ee04a-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Summary.</p></sidenote>a summary of the findings of each report, including the aggregate dollar amount of personal property determined to be no longer required for the purpose of the appropriation used to make the purchase; and</content></paragraph>
<paragraph class="fontsize10" id="y896ee04b-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896ee04c-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x896ee04d-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote>any other recommendations from the Administrator.”</content></paragraph>

<paragraph class="fontsize10" id="y896ee04e-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after section 529 the following:<quotedContent><section class="centered fontsize12" id="y896f075f-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="530">“§ 530.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896f0760-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web postings.</p><p class="leftAlign firstIndent0 fontsize8" id="x896f0761-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s530">40 USC 530</ref>.</p></sidenote>Internal guidance on excess personal property</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y896f0762-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Initial Report</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this section, each executive agency shall submit to the Administrator of General Services and make publicly available on the website of the executive agency the internal guidance of the executive agency on considering using excess personal property to meet the needs of the executive agency, which shall include—</chapeau><paragraph class="fontsize10" id="y896f0763-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896f0764-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Requirement.</p></sidenote>a requirement to consider excess personal property before buying new;<page identifier="/us/stat/138/1579">138 STAT. 1579</page></content></paragraph>
<paragraph class="fontsize10" id="y896f0765-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>when it is practicable to check for and obtain excess personal property;</content></paragraph>
<paragraph class="fontsize10" id="y896f0766-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>how to evaluate the suitability of excess personal property for use; and</content></paragraph>
<paragraph class="fontsize10" id="y896f0767-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>defined roles and responsibilities relevant to considering the use of excess personal property, including the designation of an employee as responsible for searching through available excess personal property for items that meet the needs of the executive agency.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y896f2e78-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Updates</inline>.—</heading><content>Each executive agency shall submit to the Administrator of General Services and update on the website of the executive agency any changes to the internal guidance submitted and made available under subsection (a).”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y896f2e79-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896f2e7a-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><inline class="smallCaps">Report on Interagency Working Group</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Administrator of General Services shall publish a publicly available report on a centralized online website that includes a summary of findings from the interagency working group on the acquisition of personal property that was first convened in February 2023 on ways to improve the use of excess personal property.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y896f2e7b-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Technical and Conforming Amendment</inline>.—</heading><content>The table of sections for <ref href="/us/usc/t40/ch5">chapter 5 of title 40, United States Code</ref>, <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896f2e7c-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">40 USC</p><p class="leftAlign firstIndent0 fontsize8" id="x896f2e7d-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">prec. 501.</p></sidenote><amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after the item relating to section 529 the following:<quotedContent><toc>

<subsection class="firstIndent0 fontsize10" id="y896f2e7e-e809-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/99/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x896f2e7f-e809-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><inline class="smallCaps">GAO Report</inline>.—</heading><content>The Comptroller General of the United States shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives a report that evaluates the frequency with which executive agencies (as defined in <ref href="/us/usc/t40/s102">section 102 of title 40, United States Code</ref>) acquire personal property that was made, produced, or manufactured by any entity, including any corporation, that is organized under the laws of, is headquartered in, or has its principal place of business in the People’s Republic of China, including any Special Administrative Region.</content></subsection>
