<section id="d2357e102" identifier="/us/pl/118/85/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Launch Communications Act</shortTitle>”.</content></section>
<section id="d2357e112" identifier="/us/pl/118/85/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ACCESS TO ELECTROMAGNETIC SPECTRUM FOR COMMERCIAL SPACE LAUNCHES AND REENTRIES.</heading><subsection class="firstIndent0 fontsize10" id="yfb380ed6-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Service Rules; Allocation</inline>.—</heading><paragraph class="fontsize10" id="yfb380ed7-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfb380ed8-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 90 days after the date of the enactment of this Act, the Commission shall—</chapeau><subparagraph class="fontsize10" id="yfb380ed9-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>complete any proceeding in effect as of such date of enactment related to the adoption of service rules for access to the frequencies described in subsection (c) for commercial space launches and commercial space reentries, including technical specifications, eligibility requirements, and coordination procedures to preserve the defense capabilities of the United States; and</content></subparagraph>
<subparagraph class="fontsize10" id="yfb380eda-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>allocate on a secondary basis such frequencies for commercial space launches and commercial space reentries.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfb380edb-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Coordination with national telecommunications and information administration</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfb380edc-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirements.</p></sidenote>The coordination procedures adopted under paragraph (1)(A) shall include requirements for persons conducting commercial space launches and commercial space reentries to coordinate with the Assistant Secretary regarding access to the frequencies described in subsection (c) for commercial space launches and commercial space reentries.</content></paragraph>
<paragraph class="fontsize10" id="yfb380edd-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>Access to the frequencies described in subsection (c) in accordance with the service rules adopted under subparagraph (A) of paragraph (1), and the allocation of such frequencies under subparagraph (B) of that paragraph, shall be limited to the use of such frequencies for commercial space launches and commercial space reentries.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfb380ede-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Streamlining of Process for Granting Authorizations</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfb380edf-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xfb380ee0-e809-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Regulations.</p></sidenote>Not later than 180 days after the date of the enactment of this Act, the Commission shall issue new regulations to streamline the process for granting authorizations for access to the frequencies described in subsection (c) for commercial space launches and commercial space reentries so as to provide for—</chapeau><page identifier="/us/stat/138/1547">138 STAT. 1547</page>
<paragraph class="fontsize10" id="yfb380ee1-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>authorizations that include access to such frequencies for multiple commercial space launches from 1 or more Federal space launch sites and multiple commercial space reentries to 1 or more Federal space reentry sites;</content></paragraph>
<paragraph class="fontsize10" id="yfb380ee2-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>authorizations that include access to such frequencies for multiple commercial space launches from 1 or more private space launch sites and multiple commercial space reentries to 1 or more private space reentry sites, upon successful coordination with any Federal space launch site within a range for access to such frequencies such that such a commercial space launch or commercial space reentry would not cause harmful interference with Federal systems;</content></paragraph>
<paragraph class="fontsize10" id="yfb380ee3-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>authorizations that include access to multiple uses of such frequencies for commercial space launch or commercial space reentry;</content></paragraph>
<paragraph class="fontsize10" id="yfb3835f4-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>electronic filing and processing of applications for authorizations for access to such frequencies for commercial space launches and commercial space reentries; and</content></paragraph>
<paragraph class="fontsize10" id="yfb3835f5-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>improved coordination by the Commission with the Assistant Secretary (who shall coordinate with the head of any other Federal agency, as the Assistant Secretary considers appropriate) to increase the speed of review of applications for authorizations for access to such frequencies for commercial space launches and commercial space reentries, including coordination to increase automation similar to the automation described in the service rules established by the Commission and the Assistant Secretary to promote the development and use, by entities other than the Federal Government, of spectrum in other bands, including bands with the frequencies between 71 and 76 gigahertz, between 81 and 86 gigahertz, and between 92 and 95 gigahertz.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfb3835f6-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Frequencies Described</inline>.—</heading><content>The frequencies described in this subsection are the frequencies between 2025 and 2110 megahertz, between 2200 and 2290 megahertz, and between 2360 and 2395 megahertz.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfb3835f7-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Each range of frequencies described in this section shall be construed to be inclusive of the upper and lower frequencies in the range.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfb3835f8-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yfb3835f9-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/e/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Assistant secretary</inline>.—</heading><content>The term “<term>Assistant Secretary</term>” means the Assistant Secretary of Commerce for Communications and Information.</content></paragraph>
<paragraph class="fontsize10" id="yfb3835fa-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/e/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Commercial space launch</inline>.—</heading><content>The term “<term>commercial space launch</term>” means a launch licensed under <ref href="/us/usc/t51/ch509">chapter 509 of title 51, United States Code</ref>.<page identifier="/us/stat/138/1548">138 STAT. 1548</page></content></paragraph>
<paragraph class="fontsize10" id="yfb3835fb-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/e/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Commercial space reentry</inline>.—</heading><content>The term “<term>commercial space reentry</term>” means a reentry licensed under <ref href="/us/usc/t51/ch509">chapter 509 of title 51, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="yfb3835fc-e809-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/85/s2/e/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Commission</inline>.—</heading><content>The term “<term>Commission</term>” means the Federal Communications Commission.</content></paragraph>
