<section id="d3148e88" identifier="/us/pl/118/64/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa69fe91c-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Recruit and Retain Act</shortTitle>”.</content></section>
<section id="d3148e103" identifier="/us/pl/118/64/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IMPROVING COPS GRANTS FOR POLICE HIRING PURPOSES.</heading><subsection class="firstIndent0 fontsize10" id="ya6a0102d-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Grant Use Expansion</inline>.—</heading><chapeau>Section 1701(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381/b">34 U.S.C. 10381(b)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya6a0102e-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (5) through (23) as paragraphs (6) through (24), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="ya6a0102f-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (4) the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="ya6a03740-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>to support hiring activities by law enforcement agencies experiencing declines in officer recruitment applications by reducing application-related fees, such as fees for background checks, psychological evaluations, and testing;”</content></paragraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ya6a03741-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Technical Amendment</inline>.—</heading><content>Section 1701(b)(23) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381/b/23">34 U.S.C. 10381(b)(23)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>(21)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(22)</quotedText>”.</content></subsection>

<section id="d3148e171" identifier="/us/pl/118/64/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>ADMINISTRATIVE COSTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa6a05e52-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381">34 U.S.C. 10381</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya6a05e53-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (i) through (n) as subsections (j) through (o), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="ya6a05e54-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (h) the following:<quotedContent><clause class="indentDown1 firstIndent0 fontsize10" id="ya6a05e55-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Administrative Costs</inline>.—</heading><content>Not more than 2 percent of a grant made for the hiring or rehiring of additional career law enforcement officers may be used for costs incurred to administer such grant.”</content></clause>

<section id="d3148e214" identifier="/us/pl/118/64/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>PIPELINE PARTNERSHIP PROGRAM.</heading><content class="firstIndent0 fontsize10" id="xa6a2f666-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10381">34 U.S.C. 10381</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after subsection (o) the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="ya6a34487-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="p">“(p) </num><heading class="fontsize10"><inline class="smallCaps">COPS Pipeline Partnership Program</inline>.—</heading><paragraph class="fontsize10" id="ya6a36b98-e80a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Eligible entity defined</inline>.—</heading><chapeau>In this subsection, the term ‘<term>eligible entity</term>’ means a law enforcement agency in partnership with not less than 1 educational institution, which may include 1 or any combination of the following:</chapeau><subparagraph class="fontsize10" id="ya6a36b99-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>An elementary school.<page identifier="/us/stat/138/1436">138 STAT. 1436</page></content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36b9a-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>A secondary school.</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36b9b-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>An institution of higher education.</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36b9c-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>A Hispanic-serving institution.</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36b9d-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>A historically Black college or university.</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36b9e-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>A Tribal college.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya6a36b9f-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Grants</inline>.—</heading><chapeau>The Attorney General shall award competitive grants to eligible entities for recruiting activities that—</chapeau><subparagraph class="fontsize10" id="ya6a36ba0-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>support substantial student engagement for the exploration of potential future career opportunities in law enforcement;</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36ba1-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>strengthen recruitment by law enforcement agencies experiencing a decline in recruits, or high rates of resignations or retirements;</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36ba2-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>enhance community interactions between local youth and law enforcement agencies that are designed to increase recruiting; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a36ba3-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>otherwise improve the outcomes of local law enforcement recruitment through activities such as dedicated programming for students, work-based learning opportunities, project-based learning, mentoring, community liaisons, career or job fairs, work site visits, job shadowing, apprenticeships, or skills-based internships.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya6a36ba4-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><content>Of the amounts made available to carry out this part for a fiscal year, the Attorney General may use not more than $3,000,000 to carry out this subsection.”</content></paragraph>

<section id="d3148e322" identifier="/us/pl/118/64/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>COPS GRANT GUIDANCE FOR AGENCIES OPERATING BELOW BUDGETED STRENGTH.</heading><content class="firstIndent0 fontsize10" id="xa6a3b9c5-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1704 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10384">34 U.S.C. 10384</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="ya6a3e0d6-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Guidance for Understaffed Law Enforcement Agencies</inline>.—</heading><paragraph class="fontsize10" id="ya6a3e0d7-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="ya6a3e0d8-e80a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Covered applicant</inline>.—</heading><content>The term ‘<term>covered applicant</term>’ means an applicant for a hiring grant under this part seeking funding for a law enforcement agency operating below the budgeted strength of the law enforcement agency.</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a3e0d9-e80a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Budgeted strength</inline>.—</heading><content>The term ‘<term>budgeted strength</term>’ means the employment of the maximum number of sworn law enforcement officers the budget of a law enforcement agency allows the agency to employ.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya6a3e0da-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa6a407eb-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Procedures</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Attorney General shall establish consistent procedures for covered applicants, including guidance that—</chapeau><subparagraph class="fontsize10" id="ya6a407ec-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>clarifies that covered applicants remain eligible for funding under this part; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a407ed-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>enables covered applicants to attest that the funding from a grant awarded under this part is not being used by the law enforcement agency to supplant State or local funds, as described in subsection (a).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya6a407ee-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Paperwork reduction</inline>.—</heading><content>In developing the procedures and guidance under paragraph (2), the Attorney General shall take measures to reduce paperwork requirements for grants to covered applicants.”</content></paragraph>

<section id="d3148e409" identifier="/us/pl/118/64/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>STUDY ON POLICE RECRUITMENT.</heading><subsection class="firstIndent0 fontsize10" id="ya6a4cb3f-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Study</inline>.—</heading><paragraph class="fontsize10" id="ya6a4cb40-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Comptroller General of the United States shall conduct a study to consider the comprehensive effects of recruitment and attrition rates on Federal, State, Tribal, and local law enforcement agencies in the United States, to identify—</chapeau><subparagraph class="fontsize10" id="ya6a4cb41-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>the primary reasons that law enforcement officers—</chapeau><clause class="fontsize10" id="ya6a4cb42-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>join law enforcement agencies; and</content></clause>
<clause class="fontsize10" id="ya6a4cb43-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>resign or retire from law enforcement agencies;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya6a4cb44-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>how the reasons described in subparagraph (A) may have changed over time;</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a4cb45-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the effects of recruitment and attrition on public safety;</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a4cb46-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the effects of electronic media on recruitment efforts;</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a4cb47-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>barriers to the recruitment and retention of Federal, State, and local law enforcement officers; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya6a4cb48-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa6a4cb49-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa6a4cb4a-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote>recommendations for potential ways to address barriers to the recruitment and retention of law enforcement officers, including the barriers identified in subparagraph (E).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya6a4cb4b-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Representative cross-section</inline>.—</heading><subparagraph class="fontsize10" id="ya6a4cb4c-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa6a4cb4d-e80a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Survey.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Comptroller General of the United States shall endeavor to ensure accurate representation of law enforcement agencies in the study conducted pursuant to paragraph (1) by surveying a broad cross-section of law enforcement agencies—</chapeau><clause class="fontsize10" id="ya6a4cb4e-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>from various regions of the United States;</content></clause>
<clause class="fontsize10" id="ya6a4cb4f-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>of different sizes; and</content></clause>
<clause class="fontsize10" id="ya6a4cb50-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>from rural, suburban, and urban jurisdictions.</content></clause>

<subparagraph class="fontsize10" id="ya6a4cb51-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Methods description</inline>.—</heading><content>The study conducted pursuant to paragraph (1) shall include in the report under subsection (b) a description of the methods used to identify a representative sample of law enforcement agencies.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="ya6a4cb52-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 540 days after the date of enactment of this Act, the Comptroller General of the United States shall—</chapeau><paragraph class="fontsize10" id="ya6a4cb53-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report containing the study conducted under subsection (a); and</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ya6a4cb57-e80a-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/64/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Confidentiality</inline>.—</heading><content>The Comptroller General of the United States shall ensure that the study conducted under subsection (a) protects the privacy of participating law enforcement agencies.</content></subsection>
