<section id="d20277e88" identifier="/us/pl/118/38/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9c6a94a7-e80b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s101">5 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Overtime Pay for Protective Services Act of 2023</shortTitle>”.</content></section>
<section id="d20277e103" identifier="/us/pl/118/38/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>EXTENSION OF OVERTIME PAY EXCEPTION THROUGH 2028 FOR PROTECTIVE SERVICES.</heading><subsection class="firstIndent0 fontsize10" id="y9c6d53c8-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendments</inline>.—</heading><chapeau>Section 2 of the Overtime Pay for Protective Services Act of 2016 (<ref href="/us/usc/t5/s5547">5 U.S.C. 5547 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y9c6d53c9-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the section heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText>2023</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2028</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y9c6d53ca-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y9c6d53cb-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the subsection heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">Definition</headingText></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Definitions</headingText></quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y9c6d53cc-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>In this section, the term</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“In this section—<paragraph class="indentDown1 fontsize10" id="y9c6d7add-e80b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term”</content></paragraph>

<subparagraph class="fontsize10" id="y9c6d7ade-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>2023.</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“2028; and<paragraph class="indentDown1 fontsize10" id="y9c6d7adf-e80b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the term ‘<term>protective services</term>’ does not include routine administrative or technical work that supports the daily operations of the United States Secret Service.”</content></paragraph>

<paragraph class="fontsize10" id="y9c6d7ae0-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (b)(1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>during each of calendar years 2016 through 2023</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>for protective services during each of calendar years 2016 through 2028</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9c6d7ae1-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9c6d7ae2-e80b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s5547">5 USC 5547 note</ref>.</p></sidenote><inline class="smallCaps">Retroactive Effective Date</inline>.—</heading><content>If this Act is enacted after December 31, 2023, the amendments made by subsection (a) shall take effect as if enacted on December 31, 2023.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9c6d7ae3-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="y9c6d7ae4-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="y9c6d7ae5-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate committees of congress</inline>.—</heading><chapeau>The term “<term>appropriate committees of Congress</term>” means—</chapeau><clause class="fontsize10" id="y9c6d7ae6-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Committee on Appropriations of the Senate;</content></clause>
<clause class="fontsize10" id="y9c6d7ae7-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate;</content></clause>
<clause class="fontsize10" id="y9c6d7ae8-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the Committee on the Judiciary of the Senate;</content></clause>
<clause class="fontsize10" id="y9c6d7ae9-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the Committee on Appropriations of the House of Representatives;</content></clause>
<clause class="fontsize10" id="y9c6d7aea-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>the Committee on Homeland Security of the House of Representatives;<page identifier="/us/stat/138/14">138 STAT. 14</page></content></clause>
<clause class="fontsize10" id="y9c6d7aeb-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>the Committee on Oversight and Accountability of the House of Representatives; and</content></clause>
<clause class="fontsize10" id="y9c6d7aec-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/A/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>the Committee on the Judiciary of the House of Representatives.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9c6d7aed-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/1/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term “<term>Director</term>” means the Director of the United States Secret Service.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9c6d7aee-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report on plans to reduce overtime usage</inline>.—</heading><subparagraph class="fontsize10" id="y9c6d7aef-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Director shall submit to the appropriate committees of Congress a report describing the steps that the United States Secret Service is taking to address the increased protective service demands placed upon United States Secret Service personnel.</content></subparagraph>
<subparagraph class="fontsize10" id="y9c6d7af0-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The report required under subparagraph (A) shall include the following:</chapeau><clause class="fontsize10" id="y9c6d7af1-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9c6d7af2-e80b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analysis.</p></sidenote>An analysis of the current (as of the date on which the report is submitted) operational demands and staffing levels with respect to the United States Secret Service.</content></clause>
<clause class="fontsize10" id="y9c6d7af3-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9c6d7af4-e80b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x9c6d7af5-e80b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p><p class="leftAlign firstIndent0 fontsize8" id="x9c6d7af6-e80b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Strategies.</p></sidenote>Recommended strategies for reducing overtime requirements for United States Secret Service personnel, including—</chapeau><subclause class="fontsize10" id="y9c6d7af7-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the appointment of additional personnel;</content></subclause>
<subclause class="fontsize10" id="y9c6da108-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>solutions such that sufficient resources are available throughout each year without the need for exceptions to, or waivers of, premium pay limitations;</content></subclause>
<subclause class="fontsize10" id="y9c6da109-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/B/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>the redistribution of workload among United States Secret Service personnel; and</content></subclause>
<subclause class="fontsize10" id="y9c6da10a-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/2/B/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>other improvements in operational efficiency with respect to the United States Secret Service.</content></subclause>

</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9c6da10b-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Annual projections</inline>.—</heading><subparagraph class="fontsize10" id="y9c6da10c-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><clause class="fontsize10" id="y9c6da10d-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content>In accordance with the schedule described in clause (ii), the Director shall submit to the appropriate committees of Congress a report that contains projections for the information described in paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (<ref href="/us/pl/115/160">Public Law 115–160</ref>; <ref href="/us/stat/132/1246">132 Stat. 1246</ref>), which shall be divided by calendar quarter.</content></clause>
<clause class="fontsize10" id="y9c6da10e-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Schedule described</inline>.—</heading><chapeau>The schedule described in this clause is as follows:</chapeau><subclause class="fontsize10" id="y9c6da10f-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>Not later than 30 days after the date of enactment of this Act, a report with respect to calendar year 2024.</content></subclause>
<subclause class="fontsize10" id="y9c6da110-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>Not later than December 31 of each of calendar years 2024 through 2027, a report with respect to the calendar year following the calendar year in which the report is submitted.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9c6da111-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Quarterly updates</inline>.—</heading><content>With respect to each annual report required under subparagraph (A), the Director shall, on the last day of each calendar quarter of the calendar year that is covered by the report, submit to the appropriate committees of Congress an updated version of that report <page identifier="/us/stat/138/15">138 STAT. 15</page>
that contains projections for the information described in that subparagraph for the remainder of that calendar year, which shall be divided by calendar quarter.</content></subparagraph>
<subparagraph class="fontsize10" id="y9c6da112-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Deeming of period</inline>.—</heading><content>Solely for the purposes of a report required under this paragraph, a reference in any of paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (<ref href="/us/pl/115/160">Public Law 115–160</ref>; <ref href="/us/stat/132/1246">132 Stat. 1246</ref>) to a numerical value for a previous calendar year shall be deemed to be a projection of that numerical value for an upcoming calendar year or for the remainder of a calendar year, as applicable.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9c6da113-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Effect of amendments</inline>.—</heading><chapeau>Not later than January 30 of each of calendar years 2025 through 2029, the Director shall submit to the appropriate committees of Congress a report on the effects of the amendments made by subsection (a), which shall include, with respect to the calendar year preceding the calendar year in which the report is submitted, the following:</chapeau><subparagraph class="fontsize10" id="y9c6da114-e80b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/38/s2/c/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The information described in paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (<ref href="/us/pl/115/160">Public Law 115–160</ref>; <ref href="/us/stat/132/1246">132 Stat. 1246</ref>).</content></subparagraph>
