<section id="d20044e88" identifier="/us/pl/118/231/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da5da01-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s101">5 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Government Service Delivery Improvement Act</shortTitle>”.</content></section>
<section id="d20044e103" identifier="/us/pl/118/231/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FEDERAL GOVERNMENT SERVICE DELIVERY.</heading><subsection class="firstIndent0 fontsize10" id="y6da6eb72-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/231/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendment</inline>.—</heading><content><ref href="/us/usc/t5/ch3">Chapter 3 of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subchapter id="y6da7aec3-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658174"><num class="fontsize10 smallCaps" value="III">“SUBCHAPTER III—</num><heading class="fontsize10 smallCaps"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7aec4-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5">5 USC </ref></p><p class="leftAlign firstIndent0 fontsize8" id="x6da7aec5-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">prec. 321.</p></sidenote>FEDERAL GOVERNMENT SERVICE DELIVERY</heading><section class="centered fontsize12" id="y6da7aec6-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="321">“§ 321.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7aec7-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s321">5 USC 321</ref>.</p></sidenote>Definitions</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6da7aec8-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  “In this subchapter:</chapeau><paragraph class="fontsize10" id="y6da7aec9-e80d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term ‘<term>agency</term>’ has the meaning given that term in section 3502 of title 44.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aeca-e80d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term ‘<term>Director</term>’ means the Director of the Office of Management and Budget.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aecb-e80d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Government service delivery</inline>.—</heading><content>The term ‘<term>Government service delivery</term>’ means any action by an agency related to providing a benefit or service to an individual, business, or organization (such as a grantee or State, local, or Tribal entity), including any such action of a contractor or nonprofit organization acting on behalf of the agency or administering a federally-funded program.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aecc-e80d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Government service delivery channel</inline>.—</heading><content>The term ‘<term>Government service delivery channel</term>’ means the format or medium of an interaction or transaction with the Federal Government, including in-person, through the mail, through a digital service, by telephone, through a contact center, on a website, through outreach and communication, and through collaboration with a third party, or through other ways in which an individual or entity significantly interacts with the Federal Government.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aecd-e80d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">High impact service provider</inline>.—</heading><content>The term ‘<term>high impact service provider</term>’ means an agency program identified by the Director due to the scale and impact of the public-facing services of the program.<page identifier="/us/stat/138/2830">138 STAT. 2830</page></content></paragraph>

<section class="centered fontsize12" id="y6da7aece-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="322">“§ 322.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7aecf-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s322">5 USC 322</ref>.</p></sidenote>Federal Government service delivery</heading><subsection class="firstIndent0 fontsize10" id="y6da7aed0-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7aed1-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Designation.</p><p class="leftAlign firstIndent0 fontsize8" id="x6da7aed2-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Appointment.</p></sidenote><inline class="smallCaps">Federal Government Service Delivery Lead</inline>.—</heading><chapeau>The Director shall designate or appoint a senior official as the Federal Government Service Delivery Lead within the Office of Management and Budget whose responsibility is to coordinate governmentwide efforts to improve Government service delivery by agencies. The individual shall have the following duties and authorities:</chapeau><paragraph class="fontsize10" id="y6da7aed3-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Facilitate and coordinate governmentwide efforts to improve Government service delivery provided by agencies, particularly with respect to high impact service providers.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aed4-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Carry out the duties and powers prescribed by the Director.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aed5-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Serve as the lead, governmentwide official responsible for supporting Government service delivery.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aed6-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>Advise the Director concerning the improvement of Government service delivery provided by agencies.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aed7-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><chapeau>In consultation with each lead agency service delivery official and any other agency stakeholder as appropriate, develop and oversee the implementation of governmentwide Government service delivery standards, policies, and guidelines for services and programs provided by agencies, including standards, policies, and guidelines to—</chapeau><subparagraph class="fontsize10" id="y6da7aed8-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>understand the needs of an individual, business, or organization interacting with an agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y6da7aed9-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>solicit and consider voluntary feedback on the Government service delivery by the agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y6da7aeda-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>assess Government service delivery processes;</content></subparagraph>
<subparagraph class="fontsize10" id="y6da7aedb-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>consider the factors of ease, efficiency, transparency, accessibility, fairness, burden (as defined in section 3502 of title 44), and duration, including wait and processing times, with respect to Government service delivery; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6da7aedc-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>encourage the adoption of commercial products and services in accordance with section 3307 of title 41.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6da7aedd-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>Collect and report qualitative and quantitative information or data on Government service delivery through existing reporting mechanisms.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aede-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>Evaluate the quality of Government service delivery, including through the establishment of performance metrics developed using the standards, policies, and guidelines developed pursuant to paragraph (5) and the information or data collected and reported pursuant to paragraph (6).</content></paragraph>
<paragraph class="fontsize10" id="y6da7aedf-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>Engage with stakeholders to identify leading practices in service design and delivery that would improve Government service delivery across and within agencies.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aee0-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><content>Ensure agency service delivery initiatives, including those related to the 21st Century Integrated Digital Experience Act (<ref href="/us/usc/t15/s3501">15 U.S.C. 3501 note</ref>; <ref href="/us/pl/115/336">Public Law 115–336</ref>), are identified in agency congressional budget justifications.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aee1-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><content>Coordinate with Office of Management and Budget stakeholders and other agency stakeholders on Government service delivery.</content></paragraph>
<paragraph class="fontsize10" id="y6da7aee2-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><content>In collaboration with relevant agency officials as appropriate, and in coordination with relevant Office of Management and Budget stakeholders, ensure that websites of agencies, including those associated with high impact service providers, are consistent with the objectives of this subchapter, <page identifier="/us/stat/138/2831">138 STAT. 2831</page>
the 21st Century Integrated Digital Experience Act, and any other applicable law.</content></paragraph>
</subsection>
</section>
<section class="centered fontsize12" id="y6da7d5f3-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="323">“§ 323.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7d5f4-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s323">5 USC 323</ref></p></sidenote>Lead agency officials for Government service delivery</heading><subsection class="firstIndent0 fontsize10" id="y6da7d5f5-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Responsibility for Government Service Delivery</inline>.—</heading><content>The head of each agency shall be responsible for the Government service delivery of the agency which shall, at a minimum, include improving and enhancing Government services to better achieve the mission of the agency and build and maintain trust, transparency, and accountability.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6da7d5f6-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7d5f7-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x6da7d5f8-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Designation.</p><p class="leftAlign firstIndent0 fontsize8" id="x6da7d5f9-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Appointment.</p></sidenote><inline class="smallCaps">Lead Agency Service Delivery Officials</inline>.—</heading><chapeau>Not later than one year after the date of the enactment of this subchapter, the head of each agency shall designate or appoint a senior official of the agency (who may be the deputy head of the agency) to implement this subchapter who shall have the following duties and authorities:</chapeau><paragraph class="fontsize10" id="y6da7d5fa-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Report directly to the head or deputy head of the agency.</content></paragraph>
<paragraph class="fontsize10" id="y6da7d5fb-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Possess sufficient operational authority to effectuate implementation of Government service delivery improvements within the agency, particularly with respect to high impact service providers.</content></paragraph>
<paragraph class="fontsize10" id="y6da7d5fc-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Coordinate and execute, as appropriate, under the direction of the head of the agency, and in collaboration with relevant agency officials as appropriate, efforts to improve and enhance the Government service delivery and Government service delivery channels of the agency.</content></paragraph>
<paragraph class="fontsize10" id="y6da7d5fd-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>At the direction of the Federal Government Service Delivery Lead, submit an implementation plan for improving agency Government service delivery.</content></paragraph>
<paragraph class="fontsize10" id="y6da7d5fe-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>Coordinate the collection and reporting of the data and information required pursuant to section 322 and use such data and information to improve Government service delivery.</content></paragraph>
<paragraph class="fontsize10" id="y6da7d5ff-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>Facilitate collaboration among and between offices, and components within the agency and with other agencies as appropriate, in coordination with the Federal Government Service Delivery Lead, to improve and enhance Government service delivery.</content></paragraph>
<paragraph class="fontsize10" id="y6da7d600-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>Assist with the implementation by the agency of the 21st Century Integrated Digital Experience Act (<ref href="/us/usc/t15/s3501">15 U.S.C. 3501 note</ref>; <ref href="/us/pl/115/336">Public Law 115–336</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y6da7d601-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>Assist in the incorporation of the Government service delivery requirements established under this subchapter in agency plans (such as strategic plans or annual performance plans).</content></paragraph>

<section class="centered fontsize12" id="y6da7d602-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="324">“§ 324.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7d603-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s324">5 USC 324</ref>.</p></sidenote>Rule of construction</heading><content class="indentUp0 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “Nothing in this subchapter may be construed to diminish or reduce the authority of agency Chief Information Officers for information resources management provided in section 11315 of title 40 or those authorities to manage information resources to accomplish agency missions as established in section 3502 of title 44.”</content></section>

<subsection class="firstIndent0 fontsize10" id="y6da7d605-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/231/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">GAO Report</inline>.—</heading><chapeau>Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the relevant congressional committees a report that includes the following:</chapeau><paragraph class="fontsize10" id="y6da7d606-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/231/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7d607-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote>An assessment of the implementation and effectiveness of <ref href="/us/usc/t5/ch3/schIII">subchapter III of chapter 3 of title 5, United States Code</ref>, as added by subsection (a).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y6da7d613-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/231/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6da7d614-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Compliance.</p></sidenote><inline class="smallCaps">No New Funds Authorized</inline>.—</heading><content>No new funds are authorized to be appropriated by this Act or any amendment made by this Act and the head of each agency shall comply with this Act and any amendment made by this Act using existing funds.</content></subsection>
