<section id="d33710e94" identifier="/us/pl/118/229/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Fishery Improvement to Streamline untimely regulatory Hurdles post Emergency Situation Act</shortTitle>” or the “<shortTitle role="act">FISHES Act</shortTitle>”.</content></section>
<section id="d33710e107" identifier="/us/pl/118/229/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SPEND PLANS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x8408bfd3-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 312(a)(6) of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1861a/a/6">16 U.S.C. 1861a(a)(6)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y8408bfd4-e80d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/229/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (D), to read as follows:<quotedContent><subparagraph class="fontsize10" id="y8408e6e5-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Spend plans</inline>.—</heading><clause class="fontsize10" id="y8408e6e6-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>To receive an allocation from funds available under paragraph (9), a requester with an affirmative fishery resource disaster determination shall submit a spend plan to the Secretary, not more than 120 days after receiving notification that funds are available, that shall include the following information, if applicable:</chapeau><subclause class="fontsize10" id="y8408e6e7-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>Objectives and outcomes, with an emphasis on addressing the factors contributing to the fishery resource disaster and minimizing future uninsured losses, if applicable.</content></subclause>
<subclause class="fontsize10" id="y8408e6e8-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>Statement of work.</content></subclause>
<subclause class="fontsize10" id="y8408e6e9-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>Budget details.</content></subclause>

<clause class="fontsize10" id="y8408e6ea-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Review</inline>.—</heading><subclause class="fontsize10" id="y8408e6eb-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8408e6ec-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x8408e6ed-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notice.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall review a spend plan submitted under clause (i) to determine if it is complete and provide notice within 10 days.</content></subclause>
<subclause class="fontsize10" id="y8408e6ee-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Incomplete spend plan</inline>.—</heading><content>If the Secretary determines that a spend plan submitted under clause (i) is not complete, when providing the notice required by subclause (I), the Secretary shall provide a detailed description of the information that is necessary for the spend plan to be determined complete.”</content></subclause>

<subclause class="fontsize10" id="y84090e01-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">Timeline</inline>.—</heading><content>Funds shall be made available to grantees not later than 90 days after the date the Secretary receives a complete spend plan.</content></subclause>
<subclause class="fontsize10" id="y84090e02-e80d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Review of completed spend plan and apportionment of funds</inline>.—</heading><content>If so requested, the Director of the Office of Management and Budget may review a completed spend plan concurrently with the Secretary. The Director of the Office of Management and Budget may not delay the timeline described in subclause (I).”</content></subclause>
