<section id="d20270e88" identifier="/us/pl/118/227/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Clifton Opportunities Now for Vibrant Economic Yields Act</shortTitle>” or as the “<shortTitle role="act">CONVEY Act</shortTitle>”.</content></section>
<section id="d20270e101" identifier="/us/pl/118/227/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CONVEYANCE OF FEDERAL LAND TO MESA COUNTY, COLORADO.</heading><subsection class="firstIndent0 fontsize10" id="y8b61652d-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y8b61652e-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Clifton parcel</inline>.—</heading><content>The term “<term>Clifton parcel</term>” means the approximately 31.1 acres of Federal land depicted as “31.1 Acres to be Conveyed to Mesa County” on the map titled “Clifton Opportunities Now for Vibrant Economic Yields (CONVEY) Act” and dated April 19, 2023.</content></paragraph>
<paragraph class="fontsize10" id="y8b61652f-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">County</inline>.—</heading><content>The term “<term>County</term>” means Mesa County, Colorado.</content></paragraph>
<paragraph class="fontsize10" id="y8b616530-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8b616531-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Notwithstanding the Secretarial Order dated August 26, 1902, and the Secretarial Order dated July 25, 1908, the Secretary shall convey to the County, as soon as practicable, all rights, title, and interest of the United States in and to the Clifton parcel.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8b616532-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>The conveyance under this section shall be—</chapeau><paragraph class="fontsize10" id="y8b616533-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>subject to valid existing rights; and</content></paragraph>
<paragraph class="fontsize10" id="y8b616534-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>for not less than fair market value, as determined in accordance with subsection (d).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8b616535-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Appraisal</inline>.—</heading><paragraph class="fontsize10" id="y8b616536-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The fair market value of the Clifton parcel shall be determined by an independent appraisal obtained by the Secretary.</content></paragraph>
<paragraph class="fontsize10" id="y8b616537-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Appraisal standards</inline>.—</heading><chapeau>The appraisal required by paragraph (1) shall be conducted in accordance with the—</chapeau><subparagraph class="fontsize10" id="y8b616538-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Uniform Appraisal Standards for Federal Land Acquisitions; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8b616539-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Uniform Standards of Professional Appraisal Practice.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8b61653a-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Costs of Conveyance</inline>.—</heading><content>The County shall pay all costs associated with the conveyance required under subsection (b), <page identifier="/us/stat/138/2821">138 STAT. 2821</page>
including all costs associated with any survey conducted for the purpose of accomplishing such conveyance.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8b61653b-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Proceeds From Conveyance</inline>.—</heading><chapeau>The proceeds from the conveyance required under subsection (b) shall be—</chapeau><paragraph class="fontsize10" id="y8b61653c-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>deposited into the Federal Land Disposal Account established by the Federal Land Transaction Facilitation Act (<ref href="/us/usc/t43/s2301/etseq">43 U.S.C. 2301 et seq.</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="y8b61653d-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>available for expenditure under that Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8b61653e-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Map and Legal Description</inline>.—</heading><paragraph class="fontsize10" id="y8b61653f-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As soon as practicable after the date of the enactment of this Act, the Secretary shall finalize a map and a legal description of all land to be conveyed under this Act.</content></paragraph>
<paragraph class="fontsize10" id="y8b616540-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Controlling document</inline>.—</heading><content>In the case of a discrepancy between the map and the legal description created under paragraph (1), the map shall control.</content></paragraph>
<paragraph class="fontsize10" id="y8b616541-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Corrections</inline>.—</heading><content>The Secretary and the County, by mutual agreement, may correct any minor errors in the map or the legal description created under paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="y8b616542-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/227/s2/g/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Map on file</inline>.—</heading><content>The map and the legal description created under paragraph (1) shall be kept on file and available for public inspection in each appropriate office of the Bureau of Land Management.</content></paragraph>
