<section id="d20431e89" identifier="/us/pl/118/225/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Think Differently Database Act</shortTitle>”.</content></section>
<section id="d20431e99" identifier="/us/pl/118/225/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROMOTING AWARENESS OF AVAILABLE RESOURCES FOR INDIVIDUALS WITH DISABILITIES.</heading><subsection class="firstIndent0 fontsize10" id="y9a7c6e39-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9a7c6e3a-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x9a7c6e3b-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Update.</p><p class="leftAlign firstIndent0 fontsize8" id="x9a7c6e3c-e80d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote>Not later than 3 years after the date of the enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the “Secretary”) shall establish and update periodically a publicly available website to provide information with respect to resources and information for people with a disability and the caregivers and families of such people. Such website shall include—</chapeau><paragraph class="fontsize10" id="y9a7c6e3d-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>information on eligibility to receive medical assistance under a State plan under the Medicaid program under title XIX of the Social Security Act (<ref href="/us/usc/t42/s1396/etseq">42 U.S.C. 1396 et seq.</ref>) (or a waiver of such plan) based on a disability, including general information about eligibility under subclauses (XIII), (XV), (XVI), and (XIX) of section 1902(a)(10)(A)(ii) of the Social Security Act (<ref href="/us/usc/t42/s1396a/a/10/A/ii">42 U.S.C. 1396a(a)(10)(A)(ii)</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y9a7c6e3e-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>which States offer eligibility under subclauses (XIII), (XV), (XVI), and (XIX) of section 1902(a)(10)(A)(ii) of the Social Security Act (<ref href="/us/usc/t42/s1396a/a/10/A/ii">42 U.S.C. 1396a(a)(10)(A)(ii)</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y9a7c6e3f-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>each State’s specific eligibility requirements, if applicable, under subclauses (XIII), (XV), (XVI), and (XIX) of section 1902(a)(10)(A)(ii) of the Social Security Act (<ref href="/us/usc/t42/s1396a/a/10/A/ii">42 U.S.C. 1396a(a)(10)(A)(ii)</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y9a7c6e40-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>information about how to contact each State’s Medicaid office for information about Medicaid, including links and phone numbers for State contacts;</content></paragraph>
<paragraph class="fontsize10" id="y9a7c6e41-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>general information on Medicaid-covered long-term services and supports that may be available to individuals eligible for medical assistance under a State plan under the Medicaid program under title XIX of the Social Security Act (<ref href="/us/usc/t42/s1396/etseq">42 U.S.C. 1396 et seq.</ref>) (or a waiver of such plan); and</content></paragraph>
<paragraph class="fontsize10" id="y9a7c6e42-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>where applicable, the average amount of time that individuals newly enrolled in a State’s waiver program for home and community-based services in the past 12 months <page identifier="/us/stat/138/2818">138 STAT. 2818</page>
were on the list of individuals waiting to enroll in such waiver program, in such a manner and process as described in <ref href="/us/cfr/t42/s441.311/d/1/iii">section 441.311(d)(1)(iii) of title 42, Code of Federal Regulations</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9a7c6e43-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Promotion</inline>.—</heading><content>The Secretary shall, as applicable and appropriate, identify and disseminate promotional activities to improve, among people with a disability and the caretakers and families of such people, the awareness of the resources included in the website established under subsection (a), such as through collaboration with the Social Security Administration during its annual updates to the Red Book.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9a7c6e44-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Model</inline>.—</heading><content>In establishing the website under this section, the Secretary may use the website thinkdifferently.net as a model.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9a7c6e45-e80d-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/225/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplication of Paperwork Reduction Act</inline>.—</heading><content><ref href="/us/usc/t44/ch35">Chapter 35 of title 44, United States Code</ref> (commonly referred to as the “Paperwork Reduction Act of 1995”), shall not apply to the implementation of this section.</content></subsection>
