<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4578dc50-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Think Differently Transportation Act.</p></sidenote>
<section id="d36543e88" identifier="/us/pl/118/205/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4578dc51-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s20101">49 USC 20101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Think Differently Transportation Act</shortTitle>”.</content></section>
<section id="d36543e103" identifier="/us/pl/118/205/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REPORT ON AMTRAK ADA COMPLIANCE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x45792a72-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <ref href="/us/usc/t49/s24315/b">Section 24315(b) of title 49, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y45792a73-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/205/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y45792a74-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/205/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (B), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></subparagraph>
<subparagraph class="fontsize10" id="y45792a75-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/205/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> a semicolon; and</content></subparagraph>
<subparagraph class="fontsize10" id="y45792a76-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/205/s2/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentDown1 fontsize10" id="y45795187-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x45795188-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Plan.</p></sidenote>shall include an action plan for bringing Amtrak-served stations that are not in compliance with the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12101/etseq">42 U.S.C. 12101 et seq.</ref>) into compliance with such Act, as required by the settlement agreement entered into in 2020 between Amtrak and the Department of Justice;</content></subparagraph>
<subparagraph class="indentDown1 fontsize10" id="y45795189-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4579518a-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p><p class="leftAlign firstIndent0 fontsize8" id="x4579518b-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Timelines.</p></sidenote>shall include a status report on—</chapeau><clause class="fontsize10" id="y4579518c-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>Amtrak-served stations for which Amtrak is solely responsible for compliance with such Act based on a station assessment carried out by Amtrak, including a timeline for any required compliance with such Act, as required by the settlement agreement;</content></clause>
<clause class="fontsize10" id="y4579518d-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Amtrak-served stations for which Amtrak has a shared responsibility for compliance with such Act based on a station assessment carried out by Amtrak or by the party responsible for such compliance, including a timeline for any required compliance with such Act for the portions of the station for which Amtrak is the responsible party consistent with the terms of the settlement agreement, identifying who is responsible for compliance (and the status of the compliance of each responsible party with such Act) for such portions and the timeline for compliance in cases in which Amtrak is not the responsible party; and</content></clause>
<clause class="fontsize10" id="y4579518e-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the status of compliance with such Act for all Amtrak-served stations for which Amtrak is not the responsible party, nor is responsible for a portion of the station, and identify the entity or entities that have responsibility <page identifier="/us/stat/138/2698">138 STAT. 2698</page>
for compliance with such Act, based on a station assessment carried out by Amtrak or the party responsible under such Act.”</content></clause>
</subparagraph>

</paragraph>
<paragraph class="fontsize10" id="y4579518f-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/205/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentDown1 firstIndent0 fontsize10" id="y45795190-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Amtrak may meet the requirements described in clauses (ii) and (iii) of paragraph (1)(E) by demonstrating that Amtrak took reasonable measures to obtain cooperation from responsible entities.</content></paragraph>
<paragraph class="indentDown1 firstIndent0 fontsize10" id="y45795191-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x45795192-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote>Amtrak shall submit the action plan and status report required under subparagraphs (D) and (E) of paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y45795193-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>annually while the settlement agreement referred to in paragraph (1)(D) is in effect; and</content></subparagraph>
<subparagraph class="fontsize10" id="y45795194-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>every 5 years beginning on the first day the settlement is no longer in effect.”</content></subparagraph>
