America’s Conservation Enhancement Reauthorization Act of 2024.
SECTION 1.

SHORT TITLE; TABLE OF CONTENTS.(a) Short Title.—This Act may be cited as the “America’s Conservation Enhancement Reauthorization Act of 2024”. <num value="I">TITLE I—</num><heading>WILDLIFE ENHANCEMENT, DISEASE, AND PREDATION</heading> <section id="d21932e238" identifier="/us/pl/118/198/tI/s101" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><heading>LOSSES OF LIVESTOCK DUE TO DEPREDATION BY FEDERALLY PROTECTED SPECIES.</heading><content style="-uslm-lc:I658120">  Section 102(d) of the America’s Conservation Enhancement Act (<ref href="/us/usc/t7/s8355/d">7 U.S.C. 8355(d)</ref>) <amendingAction type="amend">is amended</amendingAction>, in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2025</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2030</quotedText>”.</content></section> <section id="d21932e257" identifier="/us/pl/118/198/tI/s102" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>BLACK VULTURE LIVESTOCK PROTECTION PROGRAM.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x888d8f73-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 103 of the America’s Conservation Enhancement Act (<ref href="/us/usc/t7/s8356">7 U.S.C. 8356</ref>) <amendingAction type="amend">is amended</amendingAction>—<page identifier="/us/stat/138/2679">138 STAT. 2679</page></chapeau><paragraph class="fontsize10" id="y888d8f74-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/198/tI/s102/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the section heading, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</content></paragraph> <paragraph class="fontsize10" id="y888d8f79-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/198/tI/s102/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y888ddd9a-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Black Vulture Livestock Protection Program</inline>.—</heading><paragraph class="fontsize10" id="y888ddd9b-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x888ddd9c-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary, in coordination with States, shall carry out, through fiscal year 2030, a black vulture livestock protection program (referred to in this subsection as the ‘program’) that allows 1 public entity or Farm Bureau organization per State to hold a statewide depredation permit to protect commercial agriculture livestock from black vulture predation.</content></paragraph> <paragraph class="fontsize10" id="y888ddd9d-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>Each public entity or Farm Bureau organization that holds a depredation permit under the program—</chapeau><subparagraph class="fontsize10" id="y888ddd9e-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x888ddd9f-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote>shall—</chapeau><clause class="fontsize10" id="y888ddda0-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>demonstrate sufficient experience and capacity to provide government regulated services to the public, as determined by the Secretary;</content></clause> <clause class="fontsize10" id="y888ddda1-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x888ddda2-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p><p class="leftAlign firstIndent0 fontsize8" id="x888ddda3-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Approval.</p></sidenote><content>submit a complete depredation permit application, as determined by the Secretary, for review and approval according to procedures of the United States Fish and Wildlife Service;</content></clause> <clause class="fontsize10" id="y888ddda4-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x888ddda5-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Compliance.</p></sidenote><content>be responsible for complying with, and ensuring subpermittee compliance with, as applicable, all permit conditions; and</content></clause> <clause class="fontsize10" id="y888ddda6-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>be responsible for collecting, managing, and reporting required information under the permit; and</content></clause> </subparagraph> <subparagraph class="fontsize10" id="y888ddda7-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>may subpermit to livestock producers to take black vultures for the purposes of livestock protection.</content></subparagraph> </paragraph> <paragraph class="fontsize10" id="y888ddda8-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Study</inline>.—</heading><content>The Secretary, in consultation with the Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service, shall carry out a study on whether prescribed take levels of black vultures may be increased for subpermittees within a biologically sustainable take level for the population.</content></paragraph> <paragraph class="fontsize10" id="y888ddda9-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 1 year after the date of enactment of the America’s Conservation Enhancement Reauthorization Act of 2024, the Secretary, in consultation with the Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service, shall submit to the Chair and Ranking Member of the Committee on Environment and Public Works of the Senate and the Chair and Ranking Member of the Committee on Natural Resources of the House of Representatives a report on the status of the program, including the results of the study required under paragraph (3).”</content></paragraph> </subsection> </quotedContent>.<page identifier="/us/stat/138/2680">138 STAT. 2680</page></content></paragraph> </section> <section id="d21932e425" identifier="/us/pl/118/198/tI/s103" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><heading>CHRONIC WASTING DISEASE TASK FORCE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x888e2bca-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 104 of the America’s Conservation Enhancement Act (<ref href="/us/usc/t16/s667h">16 U.S.C. 667h</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y888e2bcb-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/198/tI/s103/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y888e2bcc-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/198/tI/s103/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>after the completion of the study required by subsection (c)</quotedText>”; and</content></subparagraph> <subparagraph class="fontsize10" id="y888e2bcd-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/198/tI/s103/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (5)(A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>180 days after the date on which the study is completed under subsection (c)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>90 days after the date of the enactment of the America’s Conservation Enhancement Reauthorization Act of 2024. The efforts of the Task Force shall not be contingent on the completion of the study required by subsection (c)</quotedText>”; and</content></subparagraph> </paragraph> <paragraph class="fontsize10" id="y888e2bce-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/198/tI/s103/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (d)(1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2025</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2030</quotedText>”.</content></paragraph> </section> <section id="d21932e476" identifier="/us/pl/118/198/tI/s104" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="104">SEC. 104. </num><heading>PROTECTION OF WATER, OCEANS, COASTS, AND WILDLIFE FROM INVASIVE SPECIES.</heading><content style="-uslm-lc:I658120">  Section 10(p) of the Fish and Wildlife Coordination Act (<ref href="/us/usc/t16/s666c–1/p">16 U.S.C. 666c–1(p)</ref>) <amendingAction type="amend">is amended</amendingAction>, in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2025</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2030</quotedText>”.</content></section> <section id="d21932e496" identifier="/us/pl/118/198/tI/s105" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="105">SEC. 105. </num><heading>NORTH AMERICAN WETLANDS CONSERVATION ACT.</heading><content style="-uslm-lc:I658120">  Section 7(c) of the North American Wetlands Conservation Act (<ref href="/us/usc/t16/s4406/c">16 U.S.C. 4406(c)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>2025</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2030</quotedText>”.</content></section> <section id="d21932e515" identifier="/us/pl/118/198/tI/s106" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="106">SEC. 106. </num><heading>NATIONAL FISH AND WILDLIFE FOUNDATION ESTABLISHMENT ACT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x888e79ef-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 10 of the National Fish and Wildlife Foundation Establishment Act (<ref href="/us/usc/t16/s3709">16 U.S.C. 3709</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y888e79f0-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/198/tI/s106/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a)(1), in the matter preceding subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2025</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2030</quotedText>”;
