<section id="d22299e98" identifier="/us/pl/118/194/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Stop Institutional Child Abuse Act</shortTitle>”.</content></section>
<section id="d22299e108" identifier="/us/pl/118/194/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>NATIONAL ACADEMIES OF SCIENCES, ENGINEERING, AND MEDICINE STUDY.</heading><subsection class="firstIndent0 fontsize10" id="ya655eb3b-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa655eb3c-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xa655eb3d-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p><p class="leftAlign firstIndent0 fontsize8" id="xa655eb3e-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa655eb3f-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 45 days after the date of enactment of this Act, the Secretary of Health and Human Services shall seek to enter into a contract with the National Academies of Sciences, Engineering, and Medicine (referred to in this section as the “National Academies”) to conduct a study to examine the state of youth in youth residential programs and make recommendations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya655eb40-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa655eb41-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xa655eb42-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p><p class="leftAlign firstIndent0 fontsize8" id="xa655eb43-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa655eb44-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><inline class="smallCaps">Study Components</inline>.—</heading><chapeau>Pursuant to the contract under subsection (a), the National Academies shall, not later than 3 years after the date of enactment of the Stop Institutional Child Abuse Act, and every 2 years thereafter for a period of 10 years, issue a report informed by the study conducted under such subsection that includes—</chapeau><paragraph class="fontsize10" id="ya655eb45-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa655eb46-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Criteria.</p><p class="leftAlign firstIndent0 fontsize8" id="xa655eb47-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote>identification of the nature, prevalence, severity, and scope of child abuse, neglect, and deaths in youth residential programs, including types of abuse and neglect, causes of abuse, neglect, and deaths, and criteria used to assess abuse, neglect, and deaths;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb48-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>identification of all Federal and State funding sources for youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb49-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>identification of Federal data collection sources on youth in youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb4a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>identification of existing regulation of youth residential programs, including alternative licensing standards or licensing exemptions for youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb4b-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>identification of existing standards of care of national accreditation entities that provide accreditation or certification of youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb4c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>identification of existing barriers in policy for blending and braiding of funding sources to serve youth in community-based settings;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb4d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>recommendations for coordination by agencies of data on youth in youth residential programs;<page identifier="/us/stat/138/2665">138 STAT. 2665</page></content></paragraph>
<paragraph class="fontsize10" id="ya655eb4e-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>recommendations for the improvement of oversight of youth residential programs receiving Federal funding;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb4f-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>identification of risk assessment tools, including projects that provide for the development of research-based strategies for risk assessments relating to the health, safety (including with respect to the use of seclusion and restraints), and well-being of youth in youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb50-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><chapeau>recommendations to support the development and implementation of education and training resources for professional and paraprofessional personnel in the fields of health care, law enforcement, judiciary, social work, child protection (including the prevention, identification, and treatment of child abuse and neglect), education, child care, and other relevant fields, and individuals such as court appointed special advocates and guardians ad litem, including education and training resources regarding—</chapeau><subparagraph class="fontsize10" id="ya655eb51-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/10/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the unique needs, experiences, and outcomes of youth with lived experience in youth residential programs;</content></subparagraph>
<subparagraph class="fontsize10" id="ya655eb52-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/10/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the enhancement of interagency communication among child protective service agencies, protection and advocacy systems, State licensing agencies, State Medicaid agencies, and accreditation agencies;</content></subparagraph>
<subparagraph class="fontsize10" id="ya655eb53-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/10/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>best practices to eliminate the use of physical, mechanical, and chemical restraint and seclusion, and to promote the use of positive behavioral interventions and supports, culturally and linguistically sensitive services, mental health supports, trauma- and grief-informed care, and crisis de-escalation interventions; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya655eb54-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/10/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the legal duties of such professional and paraprofessional personnel and youth residential program personnel and the responsibilities of such professionals and personnel to protect the legal rights of children in youth residential programs, consistent with applicable State and Federal law;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya655eb55-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>recommendations to improve accessibility and development of community-based alternatives to youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb56-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><chapeau>recommendations for innovative programs designed to provide community support and resources to at-risk youth, including programs that—</chapeau><subparagraph class="fontsize10" id="ya655eb57-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/12/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>support continuity of education, including removing barriers to access;</content></subparagraph>
<subparagraph class="fontsize10" id="ya655eb58-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/12/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>provide mentorship;</content></subparagraph>
<subparagraph class="fontsize10" id="ya655eb59-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/12/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>support the provision of crisis intervention services and in-home or outpatient mental health and substance use disorder treatment; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya655eb5a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/12/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>provide other resources to families and parents or guardians that assist in preventing the need for out-of-home placement of youth in youth residential programs;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya655eb5b-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/13" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><content>recommendations relating to the development, dissemination, outreach, engagement, or training associated with advancing least-restrictive, evidence-based, trauma and grief-informed, and developmentally and culturally competent care for youth in youth residential programs and youth at risk of being placed in such programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb5c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/14" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><content>recommendations on best practices regarding the health and safety (including reduction or elimination of use <page identifier="/us/stat/138/2666">138 STAT. 2666</page>
of seclusion and restraints), care, and treatment of youth in youth residential programs to convey to States;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb5d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/15" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">(15) </num><content>recommendations to improve the coordination, dissemination, and implementation of best practices regarding the health and safety (including use, reduction, or elimination of seclusion and restraints), care, and treatment of youth in youth residential programs among child welfare systems, licensing agencies, accreditation organizations, other relevant monitoring and enforcement entities, State child welfare agencies, State Medicaid agencies, State mental and behavioral health agencies, consumers, and State protection advocacy centers; and</content></paragraph>
<paragraph class="fontsize10" id="ya655eb5e-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/16" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">(16) </num><chapeau>identification of aggregate data, including process-oriented data such as length of stay and use of restraints, and seclusion and outcome-oriented data such as discharge setting and ability to be safely maintained in school and community at least 12 months after discharge, including—</chapeau><subparagraph class="fontsize10" id="ya655eb5f-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/16/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>recommendations on how such data should be shared across child-placing agencies and stakeholders, including individuals receiving services, families of such individuals, and advocates; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya655eb60-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/b/16/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>identification of barriers to sharing information across child-placing agencies.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ya655eb61-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><chapeau>In carrying out the duties described in subsection (b), the National Academies shall consult with—</chapeau><paragraph class="fontsize10" id="ya655eb62-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>child advocates, including attorneys experienced in working with youth overrepresented in the child welfare system or the juvenile justice system;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb63-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>health professionals, including mental health and substance use disorder professionals, nurses, physicians, social workers, and other health care providers who provide services to youth who may be served by residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb64-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>protection and advocacy systems;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb65-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>individuals experienced in working with youth with disabilities, including emotional, mental health, and substance use disorders;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb66-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>individuals with lived experience as children and youth in youth residential programs, including individuals with intellectual or developmental disabilities and individuals with emotional, mental health, or substance use disorders;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb67-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>representatives of State and local child protective services agencies and other relevant public agencies;</content></paragraph>
<paragraph class="fontsize10" id="ya655eb68-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>parents or guardians of children and youth with emotional, mental health, or substance use disorder needs;</content></paragraph>
<paragraph class="fontsize10" id="ya6561279-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>parents of children and youth with intellectual disabilities and autism;</content></paragraph>
<paragraph class="fontsize10" id="ya656127a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>experts on issues related to child abuse and neglect in youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya656127b-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>administrators of youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya656127c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>education professionals who provide services to youth with complex needs in youth residential programs;</content></paragraph>
<paragraph class="fontsize10" id="ya656127d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>State educational agencies;</content></paragraph>
<paragraph class="fontsize10" id="ya656127e-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/13" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><content>local educational agencies;</content></paragraph>
<paragraph class="fontsize10" id="ya656127f-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/14" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><content>Indian Tribes and Tribal organizations;</content></paragraph>
<paragraph class="fontsize10" id="ya6561280-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/c/15" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">(15) </num><content>State legislators;</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ya656128c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="ya656128d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Child abuse and neglect</inline>.—</heading><content>The term “<term>child abuse and neglect</term>” has the meaning given such term in section 3 of the Child Abuse Prevention and Treatment Act (<ref href="/us/usc/t42/s5101">42 U.S.C. 5101 note</ref>).</content></paragraph>

<paragraph class="fontsize10" id="ya656128f-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe; tribal organization</inline>.—</heading><content>The terms “Indian Tribe” and “Tribal organization” have the meanings given such terms in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>).</content></paragraph>
<paragraph class="fontsize10" id="ya6561290-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Protection and advocacy systems</inline>.—</heading><content>The term “<term>protection and advocacy system</term>” means a system established by a State or Indian Tribe under section 143 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<ref href="/us/usc/t42/s15043">42 U.S.C. 15043</ref>).</content></paragraph>
<paragraph class="fontsize10" id="ya6561291-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term “<term>State</term>” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</content></paragraph>
<paragraph class="fontsize10" id="ya6561292-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Youth</inline>.—</heading><content>The term “<term>youth</term>” means an individual who has not attained the age of 22.</content></paragraph>
<paragraph class="fontsize10" id="ya6561293-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Youth residential program</inline>.—</heading><subparagraph class="fontsize10" id="ya6561294-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The term “<term>youth residential program</term>” means each location of a facility or program operated by a public or private entity that, with respect to one or more youth who are unrelated to the owner or operator of the facility or program—</chapeau><clause class="fontsize10" id="ya6561295-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>provides a residential environment, such as—</chapeau><subclause class="fontsize10" id="ya6561296-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>a program with a wilderness or outdoor experience, expedition, or intervention;</content></subclause>
<subclause class="fontsize10" id="ya6561297-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>a boot camp experience or other experience designed to simulate characteristics of basic military training or correctional regimes;</content></subclause>
<subclause class="fontsize10" id="ya6561298-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>an education or therapeutic boarding school;</content></subclause>
<subclause class="fontsize10" id="ya6561299-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>a behavioral modification program;</content></subclause>
<subclause class="fontsize10" id="ya656129a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><content>a residential treatment center or facility;</content></subclause>
<subclause class="fontsize10" id="ya656129b-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/VI" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">(VI) </num><content>a qualified residential treatment program (as defined in section 472(k)(4) of the Social Security Act (<ref href="/us/usc/t42/s672/k/4">42 U.S.C. 672(k)(4)</ref>));</content></subclause>
<subclause class="fontsize10" id="ya656129c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/VII" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VII">(VII) </num><content>a psychiatric residential treatment program that meets the requirements of subpart D <page identifier="/us/stat/138/2668">138 STAT. 2668</page>
of <ref href="/us/cfr/t42/pt441">part 441 of title 42, Code of Federal Regulations</ref> (or any successor regulations);</content></subclause>
<subclause class="fontsize10" id="ya656129d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/VIII" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VIII">(VIII) </num><content>a group home serving children and youth placed by any placing authority;</content></subclause>
<subclause class="fontsize10" id="ya656129e-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/IX" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IX">(IX) </num><content>an intermediate care facility for individuals with intellectual disabilities; or</content></subclause>
<subclause class="fontsize10" id="ya656129f-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/i/X" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="X">(X) </num><content>any residential program that is utilized as an alternative to incarceration for justice involved youth, adjudicated youth, or youth deemed delinquent; and</content></subclause>
</clause>
<clause class="fontsize10" id="ya65612a0-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>serves youth who have a history or diagnosis of—</chapeau><subclause class="fontsize10" id="ya65612a1-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>an emotional, behavioral, or mental health disorder;</content></subclause>
<subclause class="fontsize10" id="ya65612a2-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>a substance misuse or use disorder, including alcohol misuse or use disorders; or</content></subclause>
<subclause class="fontsize10" id="ya65612a3-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/A/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>an intellectual, developmental, physical, or sensory disability.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya65612a4-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusion</inline>.—</heading><chapeau>The term “<term>youth residential program</term>” does not include—</chapeau><clause class="fontsize10" id="ya65612a5-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>a hospital licensed by a State; or</content></clause>
<clause class="fontsize10" id="ya65612a6-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>a foster family home that—</chapeau><subclause class="fontsize10" id="ya65612a7-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>provides 24-hour substitute care for children placed away from their parents or guardians and for whom the State child welfare services agency has placement and care responsibility; and</content></subclause>
<subclause class="fontsize10" id="ya65612a8-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/194/s2/e/7/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>is licensed and regulated by the State as a foster family home.</content></subclause>
