<section id="d22530e88" identifier="/us/pl/118/192/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb548d233-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s101">5 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">No Congressionally Obligated Recurring Revenue Used as Pensions To Incarcerated Officials Now Act</shortTitle>” or the “<shortTitle role="act">No CORRUPTION Act</shortTitle>”.</content></section>
<section id="d22530e106" identifier="/us/pl/118/192/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FORFEITURE OF PENSION.</heading><subsection class="firstIndent0 fontsize10" id="yb5492054-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/192/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb5492055-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t5/s8332/o">Section 8332(o) of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yb5492056-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/192/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (4), (5), and (6) as paragraphs (5), (6), and (7), respectively;</content></paragraph>
<paragraph class="fontsize10" id="yb5492057-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/192/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (3) the following:<quotedContent><paragraph class="indentDown1 firstIndent0 fontsize10" id="yb5494768-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4)</num><subparagraph class="inline" id="yb5494769-e80e-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><content>Subject to subparagraph (B), an individual convicted of an offense described in paragraph (2) shall not be eligible to receive any payment of an annuity pursuant to the retirement system under this subchapter or chapter 84, except that this sentence applies only to such payments based on service rendered as a Member (irrespective of when rendered).</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="yb549476a-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>If the conviction of an individual described in subparagraph (A) is overturned on appeal by a court of competent jurisdiction, the individual shall receive payments that the individual would have received but for the application of subparagraph (A).</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="yb549476b-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>This paragraph applies only to a conviction that occurs after the date of enactment of the No Congressionally Obligated Recurring Revenue Used as Pensions To Incarcerated Officials Now Act.”</content></subparagraph>

<paragraph class="fontsize10" id="yb549476d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/192/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in paragraph (6), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>paragraph (4)(B)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>paragraph (5)(B)</quotedText>”.<page identifier="/us/stat/138/2661">138 STAT. 2661</page></content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yb549476e-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/192/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Technical and Conforming Amendment</inline>.—</heading><content><ref href="/us/usc/t38/s719/e/2">Section 719(e)(2) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>section 8332(o)(5)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 8332(o)(6)</quotedText>”.</content></subsection>
