<section id="d23054e98" identifier="/us/pl/118/188/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda235501-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s101">5 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Chance to Compete Act of 2024</shortTitle>”.</content></section>
<section id="d23054e113" identifier="/us/pl/118/188/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><subsection class="firstIndent0 fontsize10" id="yda2529c2-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendatory Definitions</inline>.—</heading><paragraph class="fontsize10" id="yda2529c3-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau><ref href="/us/usc/t5/s3304">Section 3304 of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="yda2529c4-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (b) through (g) as subsections (h) through (m), respectively;</content></subparagraph>
<subparagraph class="fontsize10" id="yda2529c5-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (a) as subsection (b); and</content></subparagraph>
<subparagraph class="fontsize10" id="yda2529c6-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="insert">inserting</amendingAction> before subsection (b), as so redesignated, the following:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="yda25ed17-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yda25ed18-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term ‘<term>agency</term>’ means an Executive agency.</content></paragraph>
<paragraph class="fontsize10" id="yda25ed19-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term ‘<term>Director</term>’ means the Director of the Office.</content></paragraph>
<paragraph class="fontsize10" id="yda25ed1a-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Examination</inline>.—</heading><content>The term ‘<term>examination</term>’ means the process by which an applicant demonstrates knowledge, skills, abilities, and competencies.</content></paragraph>
<paragraph class="fontsize10" id="yda25ed1b-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Examining agency</inline>.—</heading><chapeau>The term ‘<term>examining agency</term>’ means—</chapeau><subparagraph class="fontsize10" id="yda25ed1c-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Office; or</content></subparagraph>
<subparagraph class="fontsize10" id="yda25ed1d-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>an agency to which the Director has delegated examining authority under section 1104(a)(2).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yda25ed1e-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Office</inline>.—</heading><content>The term ‘<term>Office</term>’ means the Office of Personnel Management.</content></paragraph>
<paragraph class="fontsize10" id="yda25ed1f-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Passing score</inline>.—</heading><content>The term ‘<term>passing score</term>’ means a minimum acceptable score or rating, consistent with applicable law, that may include a quantitative or qualitative assessment that an applicant can pass or fail.</content></paragraph>
<paragraph class="fontsize10" id="yda25ed20-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Relevant committees</inline>.—</heading><chapeau>The term ‘<term>relevant committees</term>’ means—</chapeau><subparagraph class="fontsize10" id="yda25ed21-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="yda25ed22-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Committee on Oversight and Accountability of the House of Representatives.<page identifier="/us/stat/138/2645">138 STAT. 2645</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yda25ed23-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Subject matter expert</inline>.—</heading><chapeau>The term ‘<term>subject matter expert</term>’ means an employee or selecting official—</chapeau><subparagraph class="fontsize10" id="yda261434-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>who possesses an understanding of the duties of, and knowledge, skills, and abilities required for, the position for which the employee or selecting official is developing or administering an examination; and</content></subparagraph>
<subparagraph class="fontsize10" id="yda261435-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>whom the delegated examining unit of the examining agency that employs the employee or selecting official designates to assist in the development and administration of technical assessments.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yda261436-e80e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Technical assessment</inline>.—</heading><chapeau>The term ‘<term>technical assessment</term>’ means a position-specific tool that is relevant to the position for which the tool is developed that—</chapeau><subparagraph class="fontsize10" id="yda261437-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>allows for the demonstration of job-related skills, abilities, knowledge, and competencies;</content></subparagraph>
<subparagraph class="fontsize10" id="yda261438-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is based upon a job analysis; and</content></subparagraph>
<subparagraph class="fontsize10" id="yda261439-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>does not solely include or principally rely upon a self-assessment from an automated examination.”</content></subparagraph>

<paragraph class="fontsize10" id="yda26143a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Technical and conforming amendments</inline>.—</heading><subparagraph class="fontsize10" id="yda26143b-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/2/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps"><ref href="/us/usc/t5">Title 5, united states code</ref></inline>.—</heading><chapeau>Part III of <ref href="/us/usc/t5">title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><clause class="fontsize10" id="yda26143c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>in chapter 33—</chapeau><subclause class="fontsize10" id="yda26143d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/a/2/A/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>in section 3302(2), by <amendingAction type="delete">striking</amendingAction> “<quotedText>3304(a)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>3304(b)</quotedText>”; and</content></subclause>

<subsection class="firstIndent0 fontsize10" id="yda26144a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda26144b-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s3304">5 USC 3304 note</ref>.</p></sidenote><inline class="smallCaps">Freestanding Definitions</inline>.—</heading><chapeau>In this Act—</chapeau><paragraph class="fontsize10" id="yda26144c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>each term that is defined in <ref href="/us/usc/t5/s3304/a">section 3304(a) of title 5, United States Code</ref>, as added by subsection (a) of this section, shall have the meaning given the term in such section 3304(a); and</content></paragraph>

<section id="d23054e581" identifier="/us/pl/118/188/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>MODERNIZING FEDERAL HIRING.</heading><content class="firstIndent0 fontsize10" id="xda26feae-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t5/s3304">Section 3304 of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after subsection (b), as redesignated by section 2, the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yda296faf-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Examinations</inline>.—</heading><paragraph class="fontsize10" id="yda296fb0-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>For the purpose of testing applicants for appointment for a position, or class of positions, in the competitive service, an examining agency shall conduct an examination pursuant to subsection (b).</content></paragraph>
<paragraph class="fontsize10" id="yda296fb1-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda296fb2-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Interim examination period</inline>.—</heading><subparagraph class="fontsize10" id="yda296fb3-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Preference for technical assessment</inline>.—</heading><content>During the 3-year period beginning on the date of enactment of the Chance to Compete Act of 2024, an examining agency shall preference the use of a technical assessment, to the maximum extent practicable, to assess the job-related skills, abilities, knowledge, and competencies of an applicant for a position in the competitive service.</content></subparagraph>
<subparagraph class="fontsize10" id="yda296fb4-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Use of alternative assessment</inline>.—</heading><content>During the 3-year period beginning on the date of enactment of the Chance to Compete Act of 2024, if an examining agency determines that the use of a technical assessment to assess the job-related skills, abilities, knowledge, and competencies of an applicant for a position in the competitive service is not practicable, the examining agency may use an alternative assessment for that purpose if the examining agency includes a brief description of the rationale for the use of the alternative assessment in the job posting.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yda296fb5-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Transition planning</inline>.—</heading><subparagraph class="fontsize10" id="yda296fb6-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda296fb7-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later 18 months after the date of enactment of the Chance to Compete Act of 2024, the Director shall submit to the relevant committees a plan to transition Federal hiring practices to adopt technical assessments in accordance with subsection (d), which shall include—</chapeau><clause class="fontsize10" id="yda2996c8-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>the prioritization of—</chapeau><subclause class="fontsize10" id="yda2996c9-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>job classifications; and</content></subclause>
<subclause class="fontsize10" id="yda2996ca-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>resource requirements; and</content></subclause>
</clause>
<clause class="fontsize10" id="yda2996cb-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996cc-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Timeline. </p></sidenote><content>a timeline for full implementation of the transition.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yda2996cd-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Additional consultation</inline>.—</heading><chapeau>In developing the plan under subparagraph (A), the Director shall consult with, at minimum—<page identifier="/us/stat/138/2647">138 STAT. 2647</page></chapeau><clause class="fontsize10" id="yda2996ce-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the Director of the Office of Management and Budget;</content></clause>
<clause class="fontsize10" id="yda2996cf-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the Chair of the Chief Human Capital Officers Council;</content></clause>
<clause class="fontsize10" id="yda2996d0-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>employee representatives; and</content></clause>
<clause class="fontsize10" id="yda2996d1-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>relevant external stakeholders.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yda2996d2-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Implementation of technical assessments</inline>.—</heading><subparagraph class="fontsize10" id="yda2996d3-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996d4-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation of plan</inline>.—</heading><content>Not later than 3 years after the date of enactment of the Chance to Compete Act of 2024, the Director shall implement the plan submitted under paragraph (3).</content></subparagraph>
<subparagraph class="fontsize10" id="yda2996d5-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996d6-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Adoption of technical assessments</inline>.—</heading><content>On and after the date that is 3 years after the date of enactment of the Chance to Compete Act of 2024, an examining agency shall use a technical assessment to examine applicants for positions in the competitive service in accordance with subsection (d).</content></subparagraph>
<subparagraph class="fontsize10" id="yda2996d7-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Waiver</inline>.—</heading><clause class="fontsize10" id="yda2996d8-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The requirement under subparagraph (B) shall not apply to an examining agency with respect to a particular job series if—</chapeau><subclause class="fontsize10" id="yda2996d9-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996da-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the examining agency determines that use of a technical assessment is impracticable for the job series; and</content></subclause>
<subclause class="fontsize10" id="yda2996db-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996dc-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><chapeau>the head of the examining agency submits to the Director and the relevant committees a certification that use of the technical assessment is impracticable, which certification shall include—</chapeau><item class="fontsize10" id="yda2996dd-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>identification of the job series;</content></item>
<item class="fontsize10" id="yda2996de-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>identification of the number of positions that are included in the job series within the agency for which the examining agency is conducting examinations; and</content></item>
<item class="fontsize10" id="yda2996df-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>a description of the rationale for the determination.</content></item>
</subclause>
</clause>
<clause class="fontsize10" id="yda2996e0-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996e1-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effectiveness of waiver</inline>.—</heading><chapeau>A waiver under this subparagraph shall be effective for the period—</chapeau><subclause class="fontsize10" id="yda2996e2-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>beginning on the date that is 1 day after the date on which the applicable certification is submitted under clause (i)(II); and</content></subclause>
<subclause class="fontsize10" id="yda2996e3-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>ending on the date that is 3 years after the date on which the applicable certification is submitted under clause (i)(II).</content></subclause>
</clause>
<clause class="fontsize10" id="yda2996e4-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">No delegation of certification authority</inline>.—</heading><content>The head of an examining agency may not delegate the authority to submit a certification under clause (i)(II).</content></clause>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yda2996e5-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Technical Assessment</inline>.—</heading><paragraph class="fontsize10" id="yda2996e6-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>For the purpose of conducting an examination for a position in the competitive service, an individual who is determined by an examining agency to be a subject matter expert in the subject and job field of the position may—</chapeau><subparagraph class="fontsize10" id="yda2996e7-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>develop, in partnership with human resources employees of the examining agency, a position-specific assessment that is relevant to the position, based on job analysis, which may include—</chapeau><clause class="fontsize10" id="yda2996e8-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a structured interview;<page identifier="/us/stat/138/2648">138 STAT. 2648</page></content></clause>
<clause class="fontsize10" id="yda2996e9-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a work-related exercise;</content></clause>
<clause class="fontsize10" id="yda2996ea-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a custom or generic procedure used to measure an applicant’s employment or career-related qualifications and interests; or</content></clause>
<clause class="fontsize10" id="yda2996eb-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><chapeau>another assessment that—</chapeau><subclause class="fontsize10" id="yda2996ec-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>allows for the demonstration of job-related technical skills, abilities, and knowledge; and</content></subclause>
<subclause class="fontsize10" id="yda2996ed-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>is relevant to the position for which the assessment is developed; and</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yda2996ee-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>administer the assessment developed under subparagraph (A) to—</chapeau><clause class="fontsize10" id="yda2996ef-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996f0-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determine whether an applicant for the position has a passing score to be qualified for the position; or</content></clause>
<clause class="fontsize10" id="yda2996f1-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>rank applicants for the position for category rating purposes under section 3319.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yda2996f2-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Feasibility study on sharing and customization of assessment</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996f3-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 1 year after the date of enactment of the Chance to Compete Act of 2024, the Director shall—</chapeau><subparagraph class="fontsize10" id="yda2996f4-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2996f5-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Examination.</p><p class="leftAlign firstIndent0 fontsize8" id="xda29bd06-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Cost analysis.</p></sidenote>conduct a feasibility study that examines the practicability, including a cost benefit analysis, of—</chapeau><clause class="fontsize10" id="yda29bd07-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the sharing of technical assessments by an examining agency with another examining agency;</content></clause>
<clause class="fontsize10" id="yda29bd08-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>mechanisms for each examining agency to maintain appropriate control over examination material that is shared by the examining agency as described in clause (i);</content></clause>
<clause class="fontsize10" id="yda29bd09-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>limits on customization of a technical assessment that is shared as described in clause (i) and mechanisms to ensure that the resulting technical assessment satisfies the requirements under <ref href="/us/cfr/t5/pt300">part 300 of title 5, Code of Federal Regulations</ref> (or any successor regulation); and</content></clause>
<clause class="fontsize10" id="yda29bd0a-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>the development of an online platform on which examining agencies can share and customize technical assessments as described in this subparagraph; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yda29bd0b-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda29bd0c-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote>submit to the relevant committees a report on the study conducted under subparagraph (A).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yda29bd0d-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Federal Agency Talent Teams</inline>.—</heading><paragraph class="fontsize10" id="yda29bd0e-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda29bd0f-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>An agency may establish 1 or more agency talent teams, including at the component level.</content></paragraph>
<paragraph class="fontsize10" id="yda29bd10-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau>An agency talent team shall provide hiring support to the agency, including by—</chapeau><subparagraph class="fontsize10" id="yda29bd11-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>improving examinations;</content></subparagraph>
<subparagraph class="fontsize10" id="yda29bd12-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>facilitating the writing of job announcements for the competitive service;</content></subparagraph>
<subparagraph class="fontsize10" id="yda29bd13-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>sharing high-quality certificates of eligible applicants; and</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yda29bd15-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda29bd16-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Office of Personnel Management Talent Team</inline>.—</heading><chapeau>The Director may establish a Federal talent team to support agency talent teams by—</chapeau><paragraph class="fontsize10" id="yda29bd17-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>facilitating hiring actions across the Federal Government;<page identifier="/us/stat/138/2649">138 STAT. 2649</page></content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yda29bd1b-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Rulemaking</inline>.—</heading><content>The Director shall promulgate such regulations as are necessary to implement and interpret this section.”</content></subsection>

<section id="d23054e1056" identifier="/us/pl/118/188/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>COMPETITIVE SERVICE CANDIDATE HIRING AND REFORM.</heading><subsection class="firstIndent0 fontsize10" id="yda2a324c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Review</inline>.—</heading><paragraph class="fontsize10" id="yda2a324d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2a324e-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>The Director shall conduct a review of examinations for hiring for each position in the competitive service that an examining agency has determined requires a minimum educational requirement because the position is of a scientific, technical, or professional nature pursuant to <ref href="/us/usc/t5/s3308">section 3308 of title 5, United States Code</ref>, to determine whether data, evidence, or other information justifies the need for educational requirements for the position.</content></paragraph>
<paragraph class="fontsize10" id="yda2a324f-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><chapeau>In carrying out paragraph (1), the Director shall consult with, at minimum—</chapeau><subparagraph class="fontsize10" id="yda2a3250-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>agencies, as deemed appropriate by the Director;</content></subparagraph>
<subparagraph class="fontsize10" id="yda2a3251-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>employee representatives;</content></subparagraph>

<paragraph class="fontsize10" id="yda2bb901-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2bb902-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Delayed reporting</inline>.—</heading><chapeau>If the Director is unable to publish and submit the report within the timeline required under paragraph (1), the Director shall publish on a public-facing website, and submit to the relevant committees, a notification of the delay that—</chapeau><subparagraph class="fontsize10" id="yda2bb903-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>provides a reason for the delay; and</content></subparagraph>

of positions in the competitive service for which an examining agency examined applicants during the applicable period, includes—</chapeau><subparagraph class="fontsize10" id="yda2bb907-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the type of examination used; and</content></subparagraph>
<subparagraph class="fontsize10" id="yda2bb908-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2bb909-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Data.</p></sidenote><content>summary data from examinations that are closed, audited, and anonymous on the use of examinations for the competitive service, including technical assessments.</content></subparagraph>

<paragraph class="fontsize10" id="yda2bb90a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Demographic indicators</inline>.—</heading><content>In carrying out paragraph (1), the Director shall break the data down by applicant demographic indicators to facilitate direct comparability and trendline comparisons to data available as of October 1, 2020, as a baseline.</content></paragraph>
<paragraph class="fontsize10" id="yda2bb90b-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><chapeau>In carrying out this subsection, the Director may only publish and submit to the relevant committees data relating to examinations for which—</chapeau><subparagraph class="fontsize10" id="yda2be01c-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the related announcement is closed;</content></subparagraph>
<subparagraph class="fontsize10" id="yda2be01d-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>certificates have been audited; and</content></subparagraph>
<subparagraph class="fontsize10" id="yda2be01e-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s5/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>all hiring processes are completed.</content></subparagraph>

<section id="d23054e1328" identifier="/us/pl/118/188/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xda2be028-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessments.</p></sidenote><heading>GAO REPORT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xda2c2e49-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">   Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</chapeau><paragraph class="fontsize10" id="yda2c2e4a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/188/s6/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>assesses the implementation of this Act and the amendments made by this Act;</content></paragraph>
