<section id="d37635e105" identifier="/us/pl/118/187/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Source code Harmonization And Reuse in Information Technology Act</shortTitle>” or the “<shortTitle role="act">SHARE IT Act</shortTitle>”.</content></section>
<section id="d37635e118" identifier="/us/pl/118/187/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe1a2bbd4-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="ye1a2bbd5-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term “<term>agency</term>” has the meaning given that term in <ref href="/us/usc/t44/s3502">section 3502 of title 44, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="ye1a2bbd6-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><content>The term “<term>appropriate congressional committees</term>” means the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability of the House of Representatives.</content></paragraph>
<paragraph class="fontsize10" id="ye1a2bbd7-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Custom-developed code</inline>.—</heading><chapeau>The term “<term>custom-developed code</term>”—</chapeau><subparagraph class="fontsize10" id="ye1a2bbd8-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>means source code that is—</chapeau><clause class="fontsize10" id="ye1a2bbd9-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>produced in the performance of a contract with an agency or is otherwise exclusively funded by the Federal Government; or</content></clause>
<clause class="fontsize10" id="ye1a2bbda-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>developed by a Federal employee as part of the official duties of the employee;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye1a2bbdb-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>includes—</chapeau><clause class="fontsize10" id="ye1a2bbdc-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>source code, or segregable portions of source code, for which the Federal Government could obtain unlimited rights under part 27 of the Federal Acquisition Regulation or any relevant supplemental acquisition regulations of an agency; and</content></clause>
<clause class="fontsize10" id="ye1a2bbdd-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>source code written for a software project, module, plugin, script, middleware, or application programming interface; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye1a2bbde-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>does not include—</chapeau><clause class="fontsize10" id="ye1a2bbdf-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>source code that is solely exploratory or disposable in nature, including source code written by a developer experimenting with a new language or library; or</content></clause>
<clause class="fontsize10" id="ye1a2bbe0-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>commercial computer software, commercial off-the-shelf software, or configuration scripts for such software.<page identifier="/us/stat/138/2639">138 STAT. 2639</page></content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1a2bbe1-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Federal employee</inline>.—</heading><content>The term “<term>Federal employee</term>” has the meaning given the term in <ref href="/us/usc/t5/s2105/a">section 2105(a) of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="ye1a2bbe2-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Metadata</inline>.—</heading><chapeau>The term “<term>metadata</term>”, with respect to custom-developed code—</chapeau><subparagraph class="fontsize10" id="ye1a2bbe3-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>has the meaning given that term in <ref href="/us/usc/t44/s3502">section 3502 of title 44, United States Code</ref>; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye1a2bbe4-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>includes—</chapeau><clause class="fontsize10" id="ye1a2bbe5-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>information on whether the custom-developed code was—</chapeau><subclause class="fontsize10" id="ye1a2bbe6-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5/B/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>produced pursuant to a contract; or</content></subclause>
<subclause class="fontsize10" id="ye1a2bbe7-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5/B/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>shared in a public or private repository;</content></subclause>
</clause>
<clause class="fontsize10" id="ye1a2bbe8-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any contract number under which the custom-developed code was produced; and</content></clause>
<clause class="fontsize10" id="ye1a2bbe9-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/5/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>any hyperlink to the repository in such the code was shared.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1a2bbea-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Private repository</inline>.—</heading><chapeau>The term “<term>private repository</term>” means a software storage location—</chapeau><subparagraph class="fontsize10" id="ye1a2bbeb-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>that contains source code, documentation, configuration scripts, as appropriate, revision history, and other files; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye1a2bbec-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>access to which is restricted to only authorized users.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1a2bbed-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Public repository</inline>.—</heading><chapeau>The term “<term>public repository</term>” means a software storage location—</chapeau><subparagraph class="fontsize10" id="ye1a2bbee-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>that contains source code, documentation, configuration scripts, as appropriate, revision history, and other files; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye1a2bbef-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>access to which is open to the public.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1a2bbf0-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Software</inline>.—</heading><content>The term “<term>software</term>” has the meaning given the term “<term>computer software</term>” in <ref href="/us/cfr/t48/s2.101">section 2.101 of title 48, Code of Federal Regulations</ref>, or any successor regulation.</content></paragraph>
<paragraph class="fontsize10" id="ye1a2bbf1-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s2/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Source code</inline>.—</heading><content>The term “<term>source code</term>” means a collection of computer commands written in a computer programming language that a computer can execute as a piece of software.</content></paragraph>

<section id="d37635e326" identifier="/us/pl/118/187/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a2bbf2-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="xe1a2bbf3-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading>SOFTWARE REUSE.</heading><subsection class="firstIndent0 fontsize10" id="ye1a3cd64-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sharing</inline>.—</heading><chapeau>Not later than 210 days after the date of enactment of this Act, the head of each agency shall ensure that the custom-developed code of the agency and other key technical components of the code (including documentation, data models, schemas, metadata, architecture designs, configuration scripts, and artifacts required to develop, build, test, and deploy the code) of the code are—</chapeau><paragraph class="fontsize10" id="ye1a3cd65-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>stored at not less than 1 public repository or private repository;</content></paragraph>
<paragraph class="fontsize10" id="ye1a3cd66-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>accessible to Federal employees via procedures developed under subsection (d)(1)(A)(ii)(III); and</content></paragraph>
<paragraph class="fontsize10" id="ye1a3cd67-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>owned by the agency.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye1a3cd68-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Software Reuse Rights in Procurement Contracts</inline>.—</heading><content>The head of an agency that enters into a contract for the custom development of software shall acquire and exercise rights sufficient to enable the governmentwide access to, sharing of, use of, and modification of any custom-developed code created in the development of such software.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye1a3cd69-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Discovery</inline>.—</heading><content>Not later than 210 days after the date of enactment of this Act, the head of each agency shall make metadata <page identifier="/us/stat/138/2640">138 STAT. 2640</page>
created on or after such date for the custom-developed code of the agency publicly accessible.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye1a3cd6a-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Accountability Mechanisms</inline>.—</heading><paragraph class="fontsize10" id="ye1a3cd6b-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency cios</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a3cd6c-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Policies.</p></sidenote>—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Chief Information Officer of each agency, in consultation with the Chief Acquisition Officer, or similar official, of the agency and the Administrator of the Office of Electronic Government, shall develop an agency-wide policy that—</chapeau><subparagraph class="fontsize10" id="ye1a3cd6d-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>implements the requirements of this Act, including—</chapeau><clause class="fontsize10" id="ye1a3cd6e-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>ensuring that custom-developed code follows the best practices established by the Director of the Office and Management and Budget under paragraph (3) for operating repositories and version control systems to keep track of changes and to facilitate collaboration among multiple developers; and</content></clause>
<clause class="fontsize10" id="ye1a3cd6f-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a3cd70-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote>managing the sharing of custom-developed code under subsection (b), and the public accessibility of metadata under subsection (c), including developing—</chapeau><subclause class="fontsize10" id="ye1a3cd71-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a3cd72-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>procedures to determine whether any custom-developed code meets the conditions under section 4(b) for an exemption under this Act;</content></subclause>
<subclause class="fontsize10" id="ye1a3cd73-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>procedures for making metadata for custom-developed code publicly accessible pursuant to subsection (c);</content></subclause>
<subclause class="fontsize10" id="ye1a3cd74-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/A/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>procedures for Federal employees to gain access to public repositories and private repositories that contain custom developed source code; and</content></subclause>
<subclause class="fontsize10" id="ye1a3cd75-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/A/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a3cd76-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Standards.</p></sidenote>standardized reporting practices across the agency to capture key information relating to a contract under which custom-developed source code was produced for reporting statistics about the contract; and</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye1a3cd77-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>corrects or amends any policies of the agency that are inconsistent with the requirements of this Act.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1a3cd78-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Administrator of the office of electronic government</inline>.—</heading><subparagraph class="fontsize10" id="ye1a3cd79-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Minimum standard reporting requirements</inline>.—</heading><chapeau>Not later than 120 days after the date of enactment of this Act, the Administrator of the Office of Electronic Government shall establish minimum standard reporting requirements for the Chief Information Officers of agencies, which shall include information relating to—</chapeau><clause class="fontsize10" id="ye1a3cd7a-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>measuring the frequency of reuse of code, including access and modification under subsection (b);</content></clause>
<clause class="fontsize10" id="ye1a3cd7b-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>whether the shared code is maintained;</content></clause>
<clause class="fontsize10" id="ye1a3cd7c-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>whether there is a feedback mechanism for improvements to or community development of the shared code; and</content></clause>
<clause class="fontsize10" id="ye1a3cd7d-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the number and circumstances of all exemptions granted under section 4(a)(2).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye1a3cd7e-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Reporting requirement</inline>.—</heading><clause class="fontsize10" id="ye1a3cd7f-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a3cd80-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><inline class="smallCaps">Requirement</inline>.—</heading><chapeau>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Administrator of the Office of Electronic <page identifier="/us/stat/138/2641">138 STAT. 2641</page>
Government shall publish on a centralized website a report on the implementation of this Act that includes—</chapeau><subclause class="fontsize10" id="ye1a3cd81-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/B/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a3cd82-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">List.</p></sidenote>a complete list of all exemptions granted under section 4(a)(2); and</content></subclause>
<subclause class="fontsize10" id="ye1a3cd83-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/B/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a3cd84-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Updates.</p></sidenote><content>information showing whether each agency has updated the acquisition and other policies of the agency to be compliant with this Act.</content></subclause>
</clause>
<clause class="fontsize10" id="ye1a3cd85-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Open government data asset</inline>.—</heading><content>The report under clause (i) shall be maintained as an open Government data asset (as defined in <ref href="/us/usc/t44/s3502">section 3502 of title 44, United States Code</ref>).</content></clause>

<paragraph class="fontsize10" id="ye1a3cd86-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s3/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.—</heading><content>The Director of the Office of Management and Budget shall issue guidance, consistent with the purpose of this Act, that establishes best practices and uniform procedures across agencies for the purposes of implementing this subsection.</content></paragraph>

<section id="d37635e555" identifier="/us/pl/118/187/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>EXEMPTIONS.</heading><subsection class="firstIndent0 fontsize10" id="ye1a490d7-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><paragraph class="fontsize10" id="ye1a490d8-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a490d9-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><inline class="smallCaps">Automatic</inline>.—</heading><subparagraph class="fontsize10" id="ye1a490da-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>This Act shall not apply to classified source code or source code developed primarily for use in a national security system (as defined in <ref href="/us/usc/t40/s11103">section 11103 of title 40, United States Code</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="ye1a490db-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">National security</inline>.—</heading><chapeau>An exemption from the requirements under section 3 shall apply to classified source code or source code developed—</chapeau><clause class="fontsize10" id="ye1a490dc-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>primarily for use in a national security system (as defined in <ref href="/us/usc/t40/s11103">section 11103 of title 40, United States Code</ref>); or</content></clause>
<clause class="fontsize10" id="ye1a490dd-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by an agency, or part of an agency, that is an element of the intelligence community (as defined in section 3(4) of the National Security Act of 1947 (<ref href="/us/usc/t50/s3003/4">50 U.S.C. 3003(4)</ref>).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye1a490de-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Freedom of information act</inline>.—</heading><content>An exemption from the requirements under section 3 shall apply to source code the disclosure of which is exempt under <ref href="/us/usc/t5/s552/b">section 552(b) of title 5, United States Code</ref> (commonly known as the “Freedom of Information Act”).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1a490df-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Discretionary</inline>.—</heading><subparagraph class="fontsize10" id="ye1a490e0-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Exemption and guidance</inline>.—</heading><clause class="fontsize10" id="ye1a490e1-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Chief Information Officer of an agency, in consultation with the Federal Privacy Council, or any successor thereto, may exempt from the requirements of section 3 any source code for which a limited exemption described in subparagraph (B) applies.</content></clause>
<clause class="fontsize10" id="ye1a490e2-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Guidance required</inline>.—</heading><content>The Federal Privacy Council shall provide guidance to the Chief Information Officer of each agency relating to the limited exemption described in subparagraph (B)(ii) to ensure consistent application of this paragraph across agencies.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye1a490e3-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Limited exemptions</inline>.—</heading><chapeau>The limited exemptions described in this paragraph are the following:</chapeau><clause class="fontsize10" id="ye1a490e4-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>The head of the agency is prohibited from providing the source code to another individual or entity <page identifier="/us/stat/138/2642">138 STAT. 2642</page>
under another Federal law or regulation, including under—</chapeau><subclause class="fontsize10" id="ye1a490e5-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/B/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the Export Administration Regulations;</content></subclause>
<subclause class="fontsize10" id="ye1a490e6-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/B/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the International Traffic in Arms Regulations;</content></subclause>
<subclause class="fontsize10" id="ye1a490e7-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/B/i/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>the regulations of the Transportation Security Administration relating to the protection of Sensitive Security Information; and</content></subclause>
<subclause class="fontsize10" id="ye1a490e8-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/B/i/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>the Federal laws and regulations governing the sharing of classified information not covered by the exemption in paragraph (1).</content></subclause>
</clause>
<clause class="fontsize10" id="ye1a490e9-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/a/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>The sharing or public accessibility of the source code would create an identifiable risk to the privacy of an individual.</content></clause>
</subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye1a490ea-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Reports Required</inline>.—</heading><paragraph class="fontsize10" id="ye1a490eb-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency reporting</inline>.—</heading><content>Not later than December 31 of each year, the Chief Information Officer of an agency shall submit to the Administrator of the Office of Electronic Government a report of the source code of the agency to which an exemption under paragraph (1) or (2) of subsection (a) applied during the fiscal year ending on September 30 of that year with a brief narrative justification of each exemption.</content></paragraph>
<paragraph class="fontsize10" id="ye1a490ec-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Annual report to congress</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator of the Office of Electronic Government shall submit to the appropriate congressional committees a report on all exemptions granted under paragraph (1) or (2) of subsection (a) by each agency, including a compilation of all information, including the narrative justification, relating to each such exemption.</content></paragraph>
<paragraph class="fontsize10" id="ye1a490ed-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The reports under paragraphs (1) and (2) shall be submitted in unclassified form, with a classified annex as appropriate.</content></paragraph>

<section id="d37635e744" identifier="/us/pl/118/187/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a490ee-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><heading>GAO REPORT.</heading><content style="-uslm-lc:I658120">  Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that includes an assessment of the implementation of this Act.</content></section>
<section id="d37635e754" identifier="/us/pl/118/187/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>RULE OF CONSTRUCTION.</heading><content style="-uslm-lc:I658120">  Nothing in this Act may be construed as requiring the disclosure of information or records that are exempt from public disclosure under <ref href="/us/usc/t5/s552">section 552 of title 5, United States Code</ref> (commonly known as the “Freedom of Information Act”).</content></section>
<section id="d37635e764" identifier="/us/pl/118/187/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a4b7ff-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading>APPLICATION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe1a4b800-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  This Act shall apply to custom-developed code that is developed or revised—</chapeau><paragraph class="fontsize10" id="ye1a4b801-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s7/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by a Federal employee not less than 180 days after the date of enactment of this Act; or</content></paragraph>
<paragraph class="fontsize10" id="ye1a4b802-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/187/s7/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a4b803-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Contracts.</p></sidenote><content>under a contract awarded pursuant to a solicitation issued not less than 180 days after the date of enactment of this Act.<page identifier="/us/stat/138/2643">138 STAT. 2643</page></content></paragraph>
</section>
<section id="d37635e790" identifier="/us/pl/118/187/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1a4b804-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading>REVISION OF FEDERAL ACQUISITION REGULATION.</heading><content style="-uslm-lc:I658120">   Not later than 1 year after the date of enactment of this Act, the Federal Acquisition Regulation shall be revised as necessary to implement the provisions of this Act.</content></section>
<section id="d37635e800" identifier="/us/pl/118/187/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>NO ADDITIONAL FUNDING.</heading><content style="-uslm-lc:I658120">  No additional funds are authorized to be appropriated to carry out this Act.</content></section>
