<section id="d23204e92" identifier="/us/pl/118/186/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLES.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Detection Equipment and Technology Evaluation to Counter the Threat of Fentanyl and Xylazine Act of 2024</shortTitle>” or the “<shortTitle role="act">DETECT Fentanyl and Xylazine Act of 2024</shortTitle>”.</content></section>
<section id="d23204e105" identifier="/us/pl/118/186/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ENHANCING THE CAPACITY TO DETECT AND IDENTIFY DRUGS SUCH AS FENTANYL AND XYLAZINE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe91048cc-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 302 of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s182">6 U.S.C. 182</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ye91048cd-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (13), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="ye91048ce-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (14), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ye91048cf-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="ye9106fe0-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">“(15) </num><chapeau>carrying out, in coordination with the Drug Enforcement Administration, research, development, testing, evaluation, and cost-benefit analyses to improve the safety, effectiveness, and efficiency of equipment and the effectiveness and efficiency of reference libraries for use by Federal, State, local, Tribal, and territorial law enforcement agencies for the accurate detection of drugs, such as fentanyl and xylazine, including—</chapeau><subparagraph class="fontsize10" id="ye9106fe1-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>portable equipment that can detect and identify drugs with minimal or no handling of the sample;</content></subparagraph>
<subparagraph class="fontsize10" id="ye9106fe2-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>equipment that can separate complex mixtures containing low concentrations of drugs and high concentrations of cutting agents into their component parts to enable signature extraction for field identification and detection; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye9106fe3-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>technologies that use machine learning or artificial intelligence (as defined in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<ref href="/us/usc/t15/s9401">15 U.S.C. 9401</ref>)) and other techniques to predict whether the substances in a sample are controlled substance analogues or other new psychoactive substances not yet included in available reference libraries.”</content></subparagraph>

<section id="d23204e176" identifier="/us/pl/118/186/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe9106fe4-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s182">6 USC 182 note</ref>.</p></sidenote><heading>REQUIREMENTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe910be05-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In carrying out section 302(15) of the Homeland Security Act of 2002, as added by section 2, the Under Secretary for Science and Technology shall—</chapeau><paragraph class="fontsize10" id="ye910be06-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>follow the recommendations, guidelines, and best practices described in the Artificial Intelligence Risk Management Framework (NIST AI 100–1) or any successor document published by the National Institute of Standards and Technology; and</content></paragraph>
<paragraph class="fontsize10" id="ye910be07-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>establish the Directorate of Science and Technology’s research, development, testing, evaluation, and cost-benefit analysis priorities under such section 302(15) based on the latest available information, including specific drugs identified as threats in—</chapeau><subparagraph class="fontsize10" id="ye910be08-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the latest Homeland Threat Assessment published by the Department of Homeland Security;</content></subparagraph>
<subparagraph class="fontsize10" id="ye910be09-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the latest State and Territory Report on Enduring and Emerging Threats published by the Drug Enforcement Administration; or</content></subparagraph>
<subparagraph class="fontsize10" id="ye910be0a-e80e-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/186/s3/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>any successor documents.</content></subparagraph>

<section id="d23204e214" identifier="/us/pl/118/186/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe910be0b-e80e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s182">6 USC 182 note</ref>.</p></sidenote><heading>RULE OF CONSTRUCTION.</heading><content style="-uslm-lc:I658120">  Nothing in this Act may be construed to limit the authority of agencies currently managing, overseeing, or otherwise involved in drug equipment and reference libraries.</content></section>
