<section id="d37907e88" identifier="/us/pl/118/183/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf9d1876e-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t43/s1571">43 USC 1571 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Colorado River Salinity Control Fix Act</shortTitle>”.</content></section>
<section id="d37907e103" identifier="/us/pl/118/183/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SALINITY CONTROL UNITS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xf9d1d58f-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 205 of the Colorado River Basin Salinity Control Act (<ref href="/us/usc/t43/s1595">43 U.S.C. 1595</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yf9d1d590-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/183/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> the section designation and all that follows through “<quotedText>(a) The Secretary</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="centered fontsize12" id="yf9d1fca1-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="205">“SEC. 205. </num><heading class="fontsize12">SALINITY CONTROL UNITS; AUTHORITY AND FUNCTIONS OF THE SECRETARY OF THE INTERIOR.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="yf9d1fca2-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Allocation of Costs</inline>.—</heading><content>The Secretary”</content></subsection>

<paragraph class="fontsize10" id="yf9d1fca3-e80e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/183/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (1) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yf9d271d4-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Nonreimbursable costs; reimbursable costs</inline>.—</heading><subparagraph class="fontsize10" id="yf9d271d5-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Nonreimbursable costs</inline>.—</heading><clause class="fontsize10" id="yf9d271d6-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In recognition of Federal responsibility for the Colorado River as an interstate stream and for international comity with Mexico, Federal ownership of the land of the Colorado River Basin from which most of the dissolved salts originate, and the policy established in the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1251/etseq">33 U.S.C. 1251 et seq.</ref>) and except as provided in clause (ii), the following shall be nonreimbursable:</chapeau><subclause class="fontsize10" id="yf9d271d7-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>75 percent of the total costs of construction and replacement of each unit or separable feature of a unit authorized by section 202(a)(1), including 90 percent of—</chapeau><item class="fontsize10" id="yf9d271d8-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the costs of operation and maintenance of each unit or separable feature of a unit authorized by that section; and</content></item>
<item class="fontsize10" id="yf9d271d9-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the total costs of construction, operation, and maintenance of the associated measures to replace incidental fish and wildlife values foregone.</content></item>
</subclause>
<subclause class="fontsize10" id="yf9d271da-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><chapeau>75 percent of the total costs of construction and replacement of each unit or separable <page identifier="/us/stat/138/2626">138 STAT. 2626</page>
feature of a unit authorized by section 202(a)(2), including 100 percent of—</chapeau><item class="fontsize10" id="yf9d271db-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the costs of operation and maintenance of each unit or separable feature of a unit authorized by that section; and</content></item>
<item class="fontsize10" id="yf9d271dc-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the total costs of construction, operation, and maintenance of the associated measures to replace incidental fish and wildlife values foregone.</content></item>
</subclause>
<subclause class="fontsize10" id="yf9d271dd-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>75 percent of the total costs of construction, operation, maintenance, and replacement of each unit or separable feature of a unit authorized by section 202(a)(3), including 75 percent of the total costs of construction, operation, and maintenance of the associated measures to replace incidental fish and wildlife values foregone.</content></subclause>
<subclause class="fontsize10" id="yf9d271de-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>70 percent of the total costs of construction, operation, maintenance, and replacement of each unit or separable feature of a unit authorized by paragraphs (4) and (6) of section 202(a), including 70 percent of the total costs of construction, operation, and maintenance of the associated measures to replace incidental fish and wildlife values foregone.</content></subclause>
<subclause class="fontsize10" id="yf9d271df-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><chapeau>70 percent of the total costs of construction and replacement of each unit or separable feature of a unit authorized by section 202(a)(5), including 100 percent of—</chapeau><item class="fontsize10" id="yf9d271e0-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the costs of operation and maintenance of each unit or separable feature of a unit authorized by that section; and</content></item>
<item class="fontsize10" id="yf9d271e1-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the total costs of construction, operation, and maintenance of the associated measures to replace incidental fish and wildlife values foregone.</content></item>
</subclause>
<subclause class="fontsize10" id="yf9d271e2-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">“(VI) </num><content>85 percent of the total costs of implementation of the on-farm measures authorized by section 202(c), including 85 percent of the total costs of the associated measures to replace incidental fish and wildlife values foregone.</content></subclause>

<clause class="fontsize10" id="yf9d271e3-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Special rule for nonreimbursable costs for fiscal years 2024 and 2025</inline>.—</heading><chapeau>Notwithstanding clause (i), for each of fiscal years 2024 and 2025, the following shall be nonreimbursable:</chapeau><subclause class="fontsize10" id="yf9d271e4-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>75 percent of all costs described in clause (i)(I).</content></subclause>
<subclause class="fontsize10" id="yf9d271e5-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>75 percent of all costs described in clause (i)(II).</content></subclause>
<subclause class="fontsize10" id="yf9d271e6-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>70 percent of all costs described in clause (i)(V).</content></subclause>
<subclause class="fontsize10" id="yf9d271e7-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>The percentages of all costs described in subclauses (III), (IV), and (VI) of clause (i).</content></subclause>

</subparagraph>
<subparagraph class="fontsize10" id="yf9d271e8-e80e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Reimbursable costs</inline>.—</heading><content>The total costs remaining after the allocations under clauses (i) and (ii) of subparagraph (A) shall be reimbursable as provided for in paragraphs (2), (3), (4), and (5).”</content></subparagraph>
