<section id="d38732e88" identifier="/us/pl/118/172/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x59473edd-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s1101">31 USC 1101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Eliminate Useless Reports Act of 2024</shortTitle>”.</content></section>
<section id="d38732e103" identifier="/us/pl/118/172/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SUNSETS FOR AGENCY REPORTS.</heading><subsection class="firstIndent0 fontsize10" id="y5948022e-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/172/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t31/s1125">Section 1125 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y5948022f-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/172/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (c) as subsection (d);</content></paragraph>
<paragraph class="fontsize10" id="y59480230-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/172/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> subsections (a) and (b) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y5948c581-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y5948c582-e80f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Budget justification materials</inline>.—</heading><content>The term ‘<term>budget justification materials</term>’ has the meaning given the term in section 3(b)(2) of the Federal Funding Accountability and Transparency Act of 2006 (<ref href="/us/usc/t31/s6101">31 U.S.C. 6101 note</ref>; <ref href="/us/pl/109/282">Public Law 109–282</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y5948c583-e80f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Plan or report</inline>.—</heading><chapeau>The term ‘<term>plan or report</term>’ means any plan or report submitted to Congress, any committee of Congress, or subcommittee thereof, by not less than 1 agency—</chapeau><subparagraph class="fontsize10" id="y5948c584-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>in accordance with Federal law; or</content></subparagraph>
<subparagraph class="fontsize10" id="y5948c585-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>at the direction or request of a congressional report.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5948c586-e80f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Recurring plan or report</inline>.—</heading><content>The term ‘<term>recurring plan or report</term>’ means a plan or report submitted on a recurring basis.</content></paragraph>
<paragraph class="fontsize10" id="y5948c587-e80f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Relevant congressional committee</inline>.—</heading><chapeau>The term ‘<term>relevant congressional committee</term>’—</chapeau><subparagraph class="fontsize10" id="y5948c588-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>means a congressional committee to which a recurring plan or report is required to be submitted; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5948c589-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>does not include any plan or report that is required to be submitted solely to the Committee on Armed Services of the House of Representatives or the Senate.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y5948c58a-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Agency Identification of Unnecessary Reports</inline>.—</heading><paragraph class="fontsize10" id="y5948c58b-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The head of each agency shall include in the budget justification materials of the agency the following:</chapeau><subparagraph class="fontsize10" id="y5948c58c-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>Subject to paragraphs (2) and (3), the following:</chapeau><clause class="fontsize10" id="y5948c58d-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>A list of each recurring plan or report submitted by the agency.<page identifier="/us/stat/138/2594">138 STAT. 2594</page></content></clause>
<clause class="fontsize10" id="y5948c58e-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>An identification of whether the recurring plan or report listed in clause (i) was included in the most recent report issued by the Clerk of the House of Representatives concerning the reports that any agency is required by law or directed or requested by a committee report to make to Congress, any committee of Congress, or subcommittee thereof.</content></clause>
<clause class="fontsize10" id="y5948c58f-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>If applicable, the unique alphanumeric identifier for the recurring plan or report as required by section 7243(b)(1)(C)(vii) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<ref href="/us/pl/117/263">Public Law 117–263</ref>).</content></clause>
<clause class="fontsize10" id="y5948c590-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5948c591-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>The identification of any recurring plan or report the head of the agency determines to be outdated or duplicative.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5948c592-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>With respect to each recurring plan or report identified in subparagraph (A)(iv), the following:</chapeau><clause class="fontsize10" id="y5948c593-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5948c594-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x5948c595-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tion.</p></sidenote><content>A recommendation on whether to sunset, modify, consolidate, or reduce the frequency of the submission of the recurring plan or report.</content></clause>
<clause class="fontsize10" id="y5948c596-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>A citation to each provision of law or directive or request in a congressional report that requires or requests the submission of the recurring plan or report.</content></clause>
<clause class="fontsize10" id="y5948c597-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>A list of the relevant congressional committees for the recurring plan or report.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5948c598-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>A justification explaining, with respect to each recommendation described in subparagraph (B)(i) relating to a recurring plan or report—</chapeau><clause class="fontsize10" id="y5948c599-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>why the head of the agency made the recommendation, which may include an estimate of the resources expended by the agency to prepare and submit the recurring plan or report; and</content></clause>
<clause class="fontsize10" id="y5948c59a-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the understanding of the head of the agency of the purpose of the recurring plan or report.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5948c59b-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Agency consultation</inline>.—</heading><subparagraph class="fontsize10" id="y5948c59c-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In preparing the list required under paragraph (1)(A), if, in submitting a recurring plan or report, an agency is required to coordinate or consult with another agency or entity, the head of the agency submitting the recurring plan or report shall consult with the head of each agency or entity with whom consultation or coordination is required.</content></subparagraph>
<subparagraph class="fontsize10" id="y5948c59d-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Inclusion in list</inline>.—</heading><chapeau>If, after a consultation under subparagraph (A), the head of each agency or entity consulted under that subparagraph agrees that a recurring plan or report is outdated or duplicative, the head of the agency required to submit the recurring plan or report shall—</chapeau><clause class="fontsize10" id="y5948c59e-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>include the recurring plan or report in the list described in paragraph (1)(A); and</content></clause>
<clause class="fontsize10" id="y5948c59f-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>identify each agency or entity with which the head of the agency is required to coordinate or consult in submitting the recurring plan or report.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5948c5a0-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Disagreement</inline>.—</heading><content>If the head of any agency or entity consulted under subparagraph (A) does not agree that a recurring plan or report is outdated or duplicative, the head of the agency required to submit the recurring <page identifier="/us/stat/138/2595">138 STAT. 2595</page>
plan or report shall not include the recurring plan or report in the list described in paragraph (1)(A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5948c5a1-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Government-wide or multi-agency plan and report submissions</inline>.—</heading><chapeau>With respect to a recurring plan or report required to be submitted by not less than 2 agencies, the Director of the Office of Management and Budget shall—</chapeau><subparagraph class="fontsize10" id="y5948c5a2-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5948c5a3-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determine whether the requirement to submit the recurring plan or report is outdated or duplicative; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5948c5a4-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5948c5a5-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x5948c5a6-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>make recommendations to Congress accordingly.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5948c5a7-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Plan and report submissions conformity to the access to congressionally mandated reports act</inline>.—</heading><content>With respect to an agency recommendation, citation, or justification made under subparagraph (B) or (C) of paragraph (1) or a recommendation by the Director of the Office of Management and Budget under paragraph (3), the agency or Director, as applicable, shall also provide this information to the Director of the Government Publishing Office in conformity with the agency submission requirements under section 7244(a) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<ref href="/us/pl/117/263">Public Law 117–263</ref>; chapter 41 of title 44 note) in conformity with guidance issued by the Director of the Office of Management and Budget under section 7244(b) of such Act.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y5948c5a8-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction on Agency Requirements</inline>.—</heading><content>Nothing in this section shall be construed to exempt the head of an agency from a requirement to submit a recurring plan or report.”</content></subsection>

<paragraph class="fontsize10" id="y5948c5a9-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/172/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (d), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>in the budget of the United States Government, as provided by section 1105(a)(37)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>in the budget justification materials of each agency</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5948c5aa-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/172/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Budget Contents</inline>.—</heading><content><ref href="/us/usc/t31/s1105/a">Section 1105(a) of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> paragraph (39).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5948c5ab-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/172/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5948c5ac-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><inline class="smallCaps">Conformity to the Access to Congressionally Mandated Reports Act</inline>.—</heading><paragraph class="fontsize10" id="y5948c5ad-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/172/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Amendment</inline>.—</heading><content>Subsections (a) and (b) of section 7244 of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (<ref href="/us/pl/117/263">Public Law 117–263</ref>; <ref href="/us/usc/t44/ch41">chapter 41 of title 44, United States Code</ref>, note)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5948c5ae-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t44">44 USC note</ref></p><p class="leftAlign firstIndent0 fontsize8" id="x5948c5af-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">prec. 4101.</p></sidenote>, are amended to read as follows:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y5948ebc0-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Submission of Electronic Copies of Reports</inline>.—</heading><content>Not earlier than 30 days or later than 60 days after the date on which a congressionally mandated report is submitted to either House of Congress or to any committee of Congress or subcommittee thereof, the head of the Federal agency submitting the congressionally mandated report shall submit to the Director the information required under subparagraphs (A) through (D) of section 7243(b)(1) with respect to the congressionally mandated report. Notwithstanding section 7246, nothing in this subtitle shall relieve a Federal agency of any other requirement to publish the congressionally mandated report on the online portal of the Federal agency or otherwise submit the congressionally mandated report to Congress or specific committees of Congress, or subcommittees thereof.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y5948ebc1-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this subsection and periodically thereafter as appropriate, the Director of the Office of Management and Budget, in consultation with the Director, shall issue guidance to agencies on the implementation of this subtitle as well as the requirements of <ref href="/us/usc/t31/s1125/b">section 1125(b) of title 31, United States Code</ref>.”</content></subsection>

Inhofe National Defense Authorization Act for Fiscal Year 2023 (<ref href="/us/pl/117/263">Public Law 117–263</ref>; <ref href="/us/usc/t44/ch41">chapter 41 of title 44, United States Code</ref>, note) for publication on the online portal established under section 7243 of such Act.</content></paragraph>
