<section id="d24307e101" identifier="/us/pl/118/171/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">DHS Border Services Contracts Review Act</shortTitle>”.</content></section>
<section id="d24307e111" identifier="/us/pl/118/171/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ASSESSMENT OF CONTRACTS FOR COVERED SERVICES BY THE DEPARTMENT OF HOMELAND SECURITY.</heading><subsection class="firstIndent0 fontsize10" id="y5ac0e68b-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><paragraph class="fontsize10" id="y5ac0e68c-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, the Under Secretary for Management of the Department of Homeland Security, in consultation with appropriate officials of the Department, shall submit to the appropriate congressional committees a report regarding active contracts for covered services of the Department awarded on or before—</chapeau><subparagraph class="fontsize10" id="y5ac0e68d-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>September 30, 2023; or</content></subparagraph>
<subparagraph class="fontsize10" id="y5ac0e68e-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the date of the enactment of this Act,</content></subparagraph>
<continuation class="firstIndent1 fontsize10" id="x5ac0e68f-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122">whichever occurs later.</continuation></paragraph>
<paragraph class="fontsize10" id="y5ac0e690-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The report required under paragraph (1) shall include the following:</chapeau><subparagraph class="fontsize10" id="y5ac0e691-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e692-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Criteria.</p></sidenote>The criteria used by the Department of Homeland Security to determine whether contractor personnel were necessary to assist the Department in carrying out its mission along the United States land border with Mexico.</content></subparagraph>
<subparagraph class="fontsize10" id="y5ac0e693-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e694-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote>An analysis of the purpose, quantity, and location of contractor personnel to perform covered services of the Department with respect to effectively—</chapeau><clause class="fontsize10" id="y5ac0e695-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>addressing mission needs along such border; and</content></clause>
<clause class="fontsize10" id="y5ac0e696-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>enhancing the capability of Department personnel to perform primary mission responsibilities, including the number of Department personnel not removed from their primary mission responsibilities by reason of the performance of covered services by contractor personnel.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ac0e697-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>An assessment with respect to the benefits of contractor personnel performing covered services, including whether the performance of such services by contractor <page identifier="/us/stat/138/2591">138 STAT. 2591</page>
personnel is more efficient or effective than the performance of such services by Department employees.</content></subparagraph>
<subparagraph class="fontsize10" id="y5ac0e698-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>An assessment of opportunities to increase the efficiency of the Department with respect to contracting, including whether Department-wide contract vehicles for covered services would be the most cost effective option for the performance of covered services.</content></subparagraph>
<subparagraph class="fontsize10" id="y5ac0e699-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e69a-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Strategy.</p><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e69b-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e69c-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote>A strategy to improve the procurement and delivery of covered services through contracts during the five-year period beginning on the date of the enactment of this Act to—</chapeau><clause class="fontsize10" id="y5ac0e69d-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/E/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>achieve the best value for the Department through the use of full and open competition; and</content></clause>
<clause class="fontsize10" id="y5ac0e69e-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/E/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>ensure no lapse in the performance of such services.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ac0e69f-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e6a0-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e6a1-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote>Recommendations based on findings resulting from the analysis and assessments required in subparagraphs (B) through (D).</content></subparagraph>
<subparagraph class="fontsize10" id="y5ac0e6a2-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/a/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>Any other information relating to contracts for covered services that the Under Secretary for Management determines appropriate.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ac0e6a3-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Implementation Plan</inline>.—</heading><paragraph class="fontsize10" id="y5ac0e6a4-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Under Secretary for Management shall submit with the report required under subsection (a) a plan to implement the recommendations and strategy contained in such report to enhance coordination, minimize overlap, and increase cost effectiveness among contracts for covered services.</content></paragraph>
<paragraph class="fontsize10" id="y5ac0e6a5-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ac0e6a6-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><inline class="smallCaps">Briefing</inline>.—</heading><content>Not later than 180 days after the date on which the Under Secretary for Management submits the report required under subsection (a) and the plan required under paragraph (1) and every 180 days thereafter until such plan is fully implemented, the Under Secretary, or the designee of the Under Secretary, shall provide to the appropriate congressional committees a briefing with respect to the status of such implementation.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ac0e6a7-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on Funding</inline>.—</heading><content>No funds are authorized to be appropriated to carry out this section. This section shall be carried out using amounts otherwise authorized to be made available for such purposes.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5ac0e6a8-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y5ac0e6a9-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/d/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y5ac10dba-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Homeland Security of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5ac10dbb-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ac10dbc-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/d/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Contract for covered services</inline>.—</heading><content>The term “<term>contract for covered services</term>” means a contract (with a total contract value of $50,000,000 or more in 2023 constant dollars, inclusive of contract options) relating to the procurement of covered services for the Department of Homeland Security.</content></paragraph>
<paragraph class="fontsize10" id="y5ac10dbd-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/171/s2/d/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Covered services</inline>.—</heading><content>The term “<term>covered services</term>” means, with respect to the United States land border with <page identifier="/us/stat/138/2592">138 STAT. 2592</page>
Mexico, any service, including related to border security, provided by a contractor to be used by the Department.</content></paragraph>
