<section id="d39211e88" identifier="/us/pl/118/165/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9aa23346-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s101">6 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">First Responder Access to Innovative Technologies Act</shortTitle>”.</content></section>
<section id="d39211e103" identifier="/us/pl/118/165/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>APPROVAL OF CERTAIN EQUIPMENT.</heading><subsection class="firstIndent0 fontsize10" id="y9aa2a877-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 2008 of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s609">6 U.S.C. 609</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y9aa2a878-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (f)—</chapeau><subparagraph class="fontsize10" id="y9aa2a879-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>If an applicant</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="y9aa2a87a-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Application requirement</inline>.—</heading><content>If an applicant”</content></paragraph>
</quotedContent>; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9aa2a87b-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraphs:<quotedContent><paragraph class="indentDown1 fontsize10" id="y9aa2cf8c-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Review process</inline>.—</heading><content>The Administrator shall implement a uniform process for reviewing applications that, in accordance with paragraph (1), contain explanations to use grants provided under section 2003 or 2004 to purchase equipment or systems that do not meet or exceed any applicable national voluntary consensus standards developed under section 647 of the Post-Katrina Emergency Management Reform Act of 2006 (<ref href="/us/usc/t6/s747">6 U.S.C. 747</ref>).</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y9aa2cf8d-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Factors</inline>.—</heading><chapeau>In carrying out the review process under paragraph (2), the Administrator shall consider the following:</chapeau><subparagraph class="fontsize10" id="y9aa2cf8e-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Current or past use of proposed equipment or systems by Federal agencies or the Armed Forces.</content></subparagraph>
<subparagraph class="fontsize10" id="y9aa2cf8f-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The absence of a national voluntary consensus standard for such equipment or systems.</content></subparagraph>
<subparagraph class="fontsize10" id="y9aa2cf90-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>The existence of an international consensus standard for such equipment or systems, and whether such equipment or systems meets such standard.</content></subparagraph>
<subparagraph class="fontsize10" id="y9aa2cf91-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>The nature of the capability gap identified by the applicant and how such equipment or systems will address such gap.</content></subparagraph>
<subparagraph class="fontsize10" id="y9aa2cf92-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>The degree to which such equipment or systems will serve the needs of the applicant better than equipment or systems that meet or exceed existing consensus standards.<page identifier="/us/stat/138/2582">138 STAT. 2582</page></content></subparagraph>
<subparagraph class="fontsize10" id="y9aa2cf93-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>Any other factor determined appropriate by the Administrator.”</content></subparagraph>

<paragraph class="fontsize10" id="y9aa2cf94-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y9aa2cf95-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Review Process</inline>.—</heading><content>The Administrator shall implement a uniform process for reviewing applications to use grants provided under section 2003 or 2004 to purchase equipment or systems not included on the Authorized Equipment List maintained by the Administrator.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y9aa2cf96-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9aa2cf97-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><inline class="smallCaps">Inspector General Report</inline>.—</heading><chapeau>Not later than three years after the date of the enactment of this Act, the Inspector General of the Department of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report assessing the implementation of the review process established under paragraph (2) of subsection (f) of section 2008 of the Homeland Security Act of 2002 (as added by subsection (a) of this section), including information on the following:</chapeau><paragraph class="fontsize10" id="y9aa2cf98-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The number of requests to purchase equipment or systems that do not meet or exceed any applicable consensus standard evaluated under such review process.</content></paragraph>
<paragraph class="fontsize10" id="y9aa2cf99-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The capability gaps identified by applicants and the number of such requests granted or denied.</content></paragraph>
<paragraph class="fontsize10" id="y9aa2cf9a-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/165/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The processing time for the review of such requests.</content></paragraph>
