<section id="d24956e86" identifier="/us/pl/118/162/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0c2916a-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Arizona.</p></sidenote><heading>LAND WITHDRAWAL AND RESERVATION.</heading><subsection class="firstIndent0 fontsize10" id="yb0c3a2db-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yb0c3a2dc-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agreement</inline>.—</heading><content>The term “<term>Agreement</term>” means the agreement between the United States and the Association dated September 6, 1917, as amended.</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2dd-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Association</inline>.—</heading><content>The term “<term>Association</term>” means the Salt River Valley Water Users’ Association.</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2de-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Covered land</inline>.—</heading><content>The term “<term>covered land</term>” means the portion of the National Forest System land located on the south side of the Salt River from the March 9, 1903, 1-mile withdrawal area for the Bureau of Reclamation purposes extending an additional 2 miles from the Salt River at Roosevelt Dam to 18.25 river miles downstream, in the State of Arizona, not including the Superstition Mountain Wilderness Area and the Tonto National Monument, as depicted on the Map.</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2df-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">District</inline>.—</heading><content>The term “<term>District</term>” means the Salt River Project Agricultural Improvement and Power District.</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2e0-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>Map</term>” means the map prepared under subsection (e)(1).</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2e1-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">SRP</inline>.—</heading><chapeau>The term “<term>SRP</term>” means—</chapeau><subparagraph class="fontsize10" id="yb0c3a2e2-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the District; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb0c3a2e3-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/a/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Association.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0c3a2e4-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Reservation of Covered Land</inline>.—</heading><content>Subject to valid existing rights, the covered land is reserved to the United States, through the Secretary of the Interior, for the exclusive right to use the covered land and interests in the covered land for the development, generation, and transmission of electrical power and energy for the use and benefit of the Salt River Federal Reclamation Project pursuant to the Agreement.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb0c3a2e5-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Withdrawal of Covered Land</inline>.—</heading><chapeau>The covered land is permanently withdrawn from—</chapeau><paragraph class="fontsize10" id="yb0c3a2e6-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>all forms of entry, appropriation, and disposal under the public land laws;</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2e7-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>location, entry, and patent under the mining laws; and</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2e8-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>operation of the mineral leasing, mineral materials, and geothermal leasing laws.<page identifier="/us/stat/138/2576">138 STAT. 2576</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0c3a2e9-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0c3a2ea-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Approvals.</p></sidenote><inline class="smallCaps">Facilities</inline>.—</heading><chapeau>With respect to facilities constructed by SRP on the covered land for the development, generation, and transmission of electrical power and energy—</chapeau><paragraph class="fontsize10" id="yb0c3a2eb-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0c3a2ec-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote>the design and specifications shall conform to Bureau of Reclamation standards, and final designs shall be subject to review and approval by the Secretary of the Interior;</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2ed-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0c3a2ee-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Inspection.</p></sidenote>all construction work shall be subject to inspection and approval by the Secretary of the Interior;</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2ef-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0c3a2f0-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>upon a determination of substantial completion of such facilities, the Secretary of the Interior shall accept title on behalf of the United States as part of the Salt River Federal Reclamation Project pursuant to—</chapeau><subparagraph class="fontsize10" id="yb0c3a2f1-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/d/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>section 6 of the Act of June 17, 1902 (<ref href="/us/stat/32/389/ch1093">32 Stat. 389, chapter 1093</ref>; <ref href="/us/usc/t43/s498">43 U.S.C. 498</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="yb0c3a2f2-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/d/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Agreement; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0c3a2f3-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>SRP shall be responsible for the care, operation, and maintenance pursuant to the Agreement.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0c3a2f4-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><paragraph class="fontsize10" id="yb0c3a2f5-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As soon as practicable after the date of enactment of this Act, the Secretary of Agriculture shall prepare a map depicting the boundary of the covered land.</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2f6-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Availability</inline>.—</heading><content>The Map shall be on file and available for public inspection in the appropriate offices of the Forest Service and the Bureau of Reclamation.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0c3a2f7-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Management of Covered Land</inline>.—</heading><content>Management of the covered lands shall be in accordance with the Management Memorandum among the District, United States Department of Agriculture, Forest Service, and the Bureau of Reclamation, dated April 27, 1979, as amended.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb0c3a2f8-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Relation to Other Law</inline>.—</heading><paragraph class="fontsize10" id="yb0c3a2f9-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Compliance with environmental laws</inline>.—</heading><content>The Secretary of the Interior is directed to carry out all necessary environmental compliance under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref>, et seq.), the Endangered Species Act of 1973 (<ref href="/us/usc/t16/s1531">16 U.S.C. 1531</ref>, et seq.), and all other applicable environmental laws and regulations, prior to construction of facilities on the covered land for the development, generation, and transmission of electrical power and energy.</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2fa-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Lead agency</inline>.—</heading><content>The Bureau of Reclamation shall be the lead agency with respect to environmental compliance.</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2fb-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Withdrawal not major federal action</inline>.—</heading><content>The withdrawal of the covered land shall not constitute a major Federal action under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321">42 U.S.C. 4321</ref>, et seq.).</content></paragraph>
<paragraph class="fontsize10" id="yb0c3a2fc-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/162/s1/g/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Antideficiency</inline>.—</heading><content>The United States shall not be liable for failure to carry out any obligation or activity authorized to be carried out under this title (including any such obligation or activity under the Agreement) if adequate appropriations <page identifier="/us/stat/138/2577">138 STAT. 2577</page>
are not provided by Congress expressly to carry out the purposes of this Act.</content></paragraph>
