<section id="d25086e92" identifier="/us/pl/118/160/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Native American Child Protection Act</shortTitle>”.</content></section>
<section id="d25086e102" identifier="/us/pl/118/160/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>INDIAN CHILD PROTECTION AND FAMILY VIOLENCE PREVENTION ACT AMENDMENTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xbf7f74f3-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Indian Child Protection and Family Violence Prevention Act (<ref href="/us/usc/t25/s3202/etseq">25 U.S.C. 3202 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> as follows:</chapeau><paragraph class="fontsize10" id="ybf7f74f4-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>By <amendingAction type="amend">amending</amendingAction> section 403(3)(A) (<ref href="/us/usc/t25/s3202/3/A">25 U.S.C. 3202(3)(A)</ref>) to read as follows:<quotedContent><subparagraph class="fontsize10" id="ybf7f9c05-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>in any case in which—</chapeau><clause class="fontsize10" id="ybf7f9c06-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i)</num><subclause class="inline" id="ybf7f9c07-e80f-11f0-a1e4-69761a48a15a"><num value="I">(I) </num><content>a child is dead or exhibits evidence of skin bruising, bleeding, malnutrition, failure to thrive, burns, fracture of any bone, subdural hematoma, soft tissue swelling; and</content></subclause>
<subclause class="indentUp0 fontsize10" id="ybf7f9c08-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>such condition is not justifiably explained or may not be the product of an accidental occurrence; or</content></subclause>
</clause>
<clause class="fontsize10" id="ybf7f9c09-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a child is subjected to sexual assault, sexual molestation, sexual exploitation, sexual contact, or prostitution; and”</content></clause>

<paragraph class="fontsize10" id="ybf7f9c0a-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>In section 409 (<ref href="/us/usc/t25/s3208">25 U.S.C. 3208</ref>)—</chapeau><subparagraph class="fontsize10" id="ybf7f9c0b-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in subsection (a)—</chapeau><clause class="fontsize10" id="ybf7f9c0c-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>The Secretary of Health and Human Services, acting through the Service and in cooperation with the Bureau</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>The Service, in cooperation with the Bureau</quotedText>”; and</content></clause>
<clause class="fontsize10" id="ybf7f9c0d-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>sexual abuse</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>abuse or neglect</quotedText>”;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ybf7f9c0e-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subsection (b) through the end of the section, by <amendingAction type="delete">striking</amendingAction> “<quotedText>Secretary of Health and Human Services</quotedText>” each place it appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Service</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="ybf7f9c0f-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in subsection (b)(1), by <amendingAction type="insert">inserting</amendingAction> after “<quotedText>Any Indian tribe or intertribal consortium</quotedText>” the following: “<quotedText>, on its own or in partnership with an urban Indian organization,</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="ybf7f9c10-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>in subsections (b)(2)(B) and (d), by <amendingAction type="delete">striking</amendingAction> “<quotedText>such Secretary</quotedText>” each place it appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>the Service</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="ybf7f9c11-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>by <amendingAction type="amend">amending</amendingAction> subsection (c) to read as follows:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="ybf7fc322-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Culturally Appropriate Treatment</inline>.—</heading><content>In awarding grants under this section, the Service shall encourage the use <page identifier="/us/stat/138/2568">138 STAT. 2568</page>
of culturally appropriate treatment services and programs that respond to the unique cultural values, customs, and traditions of applicant Indian Tribes.”</content></subsection>

<subparagraph class="fontsize10" id="ybf7fc323-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>in subsection (d)(2), by <amendingAction type="delete">striking</amendingAction> “<quotedText>the Secretary</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>the Service</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="ybf7fc324-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (e) as subsection (f); and</content></subparagraph>
<subparagraph class="fontsize10" id="ybf7fc325-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/2/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (d) the following:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="ybf7fc326-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 2 years after the date of the enactment of the Native American Child Protection Act, the Service shall submit a report to Congress on the award of grants under this section. The report shall contain—</chapeau><paragraph class="fontsize10" id="ybf7fc327-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>a description of treatment and services for which grantees have used funds awarded under this section; and</content></paragraph>
<paragraph class="fontsize10" id="ybf7fc328-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>any other information that the Service requires.”</content></paragraph>

<paragraph class="fontsize10" id="ybf7fc329-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>In section 410 (<ref href="/us/usc/t25/s3209">25 U.S.C. 3209</ref>)—</chapeau><subparagraph class="fontsize10" id="ybf7fc32a-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in the heading—</chapeau><clause class="fontsize10" id="ybf7fc32b-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>national</quotedText>” before “<quotedText>indian</quotedText>”; and</content></clause>
<clause class="fontsize10" id="ybf7fc32c-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>centers</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>center</quotedText>”;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ybf7fc32d-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="amend">amending</amendingAction> subsections (a) and (b) to read as follows:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="ybf7fea3e-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbf7fea3f-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><inline class="smallCaps">Establishment</inline>.—</heading><content>Not later than 1 year after the date of the enactment of the Native American Child Protection Act, the Secretary shall establish a National Indian Child Resource and Family Services Center.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ybf7fea40-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 2 years after the date of the enactment of the Native American Child Protection Act, the Secretary of the Interior, acting through the Bureau of Indian Affairs, shall submit a report to Congress on the status of the National Indian Child Resource and Family Services Center.”</content></subsection>

prosecution of incidents of family violence and child abuse and child neglect involving Indian children and families.”</content></paragraph>

The advisory board shall consist of 12 members appointed by the Secretary from Indian Tribes, Tribal organizations, and urban Indian organizations with expertise in child abuse and child neglect. Members shall serve without compensation, but may be reimbursed for travel and other expenses while carrying out the duties of the board. The advisory board shall assist the Center in coordinating programs, identifying training and technical assistance materials, and developing intergovernmental agreements relating to family violence, child abuse, and child neglect.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ybf801166-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Application of Indian Self-determination Act to the Center</inline>.—</heading><content>The National Indian Child Resource and Family Services Center shall be subject to the provisions of the Indian Self-Determination Act. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbf801167-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote>The Secretary may also contract for the operation of the Center with a nonprofit Indian organization governed by an Indian-controlled board of directors that have substantial experience in child abuse, child neglect, and family violence involving Indian children and families.”</content></subsection>

<subparagraph class="indentDown2 fontsize10" id="ybf80387f-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>child protective services operational costs including transportation, risk and protective factors assessments, family engagement and kinship navigator services, and relative searches, criminal background checks for prospective placements, and home studies; and</content></subparagraph>
<subparagraph class="indentDown2 fontsize10" id="ybf803880-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>development of a Tribal child protection or multidisciplinary team to assist in the prevention and investigation of child abuse and neglect;”</content></subparagraph>

<subparagraph class="fontsize10" id="ybf80388e-e80f-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/160/s2/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="amend">amending</amendingAction> subsection (g) to read as follows:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="ybf805f9f-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 2 years after the date of the enactment of the Native American Child Protection Act, the Secretary of the Interior, acting through the Bureau of Indian Affairs, shall submit a report to Congress on the award of grants under this section. The report shall contain—</chapeau><paragraph class="fontsize10" id="ybf805fa0-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>a description of treatment and services for which grantees have used funds awarded under this section; and</content></paragraph>
<paragraph class="fontsize10" id="ybf805fa1-e80f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>any other information that the Secretary of the Interior requires.”</content></paragraph>

Each program, project, and activity authorized by this Act or the amendments made by <page identifier="/us/stat/138/2571">138 STAT. 2571</page>
this Act shall be subject to the availability of appropriations made in advance for such purposes.</content></section>
