<section id="d48870e92" identifier="/us/pl/118/157/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Improving Federal Building Security Act of 2024</shortTitle>”.</content></section>
<section id="d48870e102" identifier="/us/pl/118/157/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>RESPONDING TO SECURITY RECOMMENDATIONS.</heading><subsection class="firstIndent0 fontsize10" id="ye1754e3c-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="ye1754e3d-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term “<term>agency</term>” has the meaning given the term in <ref href="/us/usc/t5/s551">section 551 of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="ye175754e-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Facility security committee</inline>.—</heading><chapeau>The term “<term>Facility Security Committee</term>” means a committee that—</chapeau><subparagraph class="fontsize10" id="ye175754f-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>consists of representatives of—</chapeau><clause class="fontsize10" id="ye1757550-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>all Federal tenants in a specific non-military facility;</content></clause>
<clause class="fontsize10" id="ye1757551-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the security organization for the facility; and</content></clause>
<clause class="fontsize10" id="ye1757552-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the owning or leasing Federal tenant; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye1757553-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is responsible for addressing facility-specific security issues and approving the implementation of security measures and practices in the facility.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1757554-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Homeland Security.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye1757555-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Response</inline>.—</heading><paragraph class="fontsize10" id="ye1757556-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1757557-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 90 days after the date on which the Federal Protective Service issues a security recommendation to a Facility Security Committee to improve facility security, the head of the Facility Security Committee, or a designee thereof, shall—</chapeau><subparagraph class="fontsize10" id="ye1757558-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>respond to the Secretary—</chapeau><clause class="fontsize10" id="ye1757559-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>indicating if the Facility Security Committee intends to adopt or reject the recommendation; and</content></clause>
<clause class="fontsize10" id="ye175755a-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>describing the financial implications of adopting or rejecting the recommendation, including if the benefits outweigh the costs; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye175755b-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>if the Facility Security Committee intends to reject the recommendation, provide the Secretary a justification for accepting the risk posed by rejecting the recommendation.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye175755c-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Method</inline>.—</heading><chapeau>The Secretary shall—<page identifier="/us/stat/138/1720">138 STAT. 1720</page></chapeau><subparagraph class="fontsize10" id="ye175755d-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>develop a method to monitor the recommendations and responses described in paragraph (1); and</content></subparagraph>
<subparagraph class="fontsize10" id="ye175755e-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>take reasonable action to ensure Facility Security Committee responsiveness under paragraph (1).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye175755f-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Annual Report</inline>.—</heading><paragraph class="fontsize10" id="ye1757560-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1757561-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 270 days after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives a report that, for the fiscal year preceding the report, includes—</chapeau><subparagraph class="fontsize10" id="ye1757562-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1757563-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Summary.</p></sidenote><content>a summary of the security recommendations issued by the Federal Protective Service to Facility Security Committees to improve facility security;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1757564-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the percentage of recommendations described in subparagraph (A) that were accepted and the percentage of such recommendations that were rejected;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1757565-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the percentage of Facility Security Committees that failed to respond to a recommendation described in subparagraph (A) in a timely manner;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1757566-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1757567-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Summary.</p></sidenote><content>a summary of justifications provided by Facility Security Committees if a Facility Security Committee rejected a recommendation described in subparagraph (A);</content></subparagraph>
<subparagraph class="fontsize10" id="ye1757568-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1757569-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Summary.</p></sidenote><content>a summary of the financial implications of Facility Security Committee responses to recommendations described in subparagraph (A), including if the benefits outweigh the costs;</content></subparagraph>
<subparagraph class="fontsize10" id="ye175756a-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe175756b-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>an analysis of steps taken by Facility Security Committees to mitigate the risk posed by rejecting a recommendation described in subparagraph (A); and</content></subparagraph>
<subparagraph class="fontsize10" id="ye175756c-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/1/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe175756d-e80f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>an analysis of any trends found among the findings in the report.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye175756e-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>Each report required under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</content></paragraph>
<paragraph class="fontsize10" id="ye175756f-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><content>The Secretary shall brief the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives on an annual basis on the findings of the most recently submitted report under paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye1757570-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Report on Surveillance Technology</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives an unredacted report on—</chapeau><paragraph class="fontsize10" id="ye1757571-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>all surveillance technology recommended by the Federal Protective Service; and</content></paragraph>
<paragraph class="fontsize10" id="ye1757572-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any intended use of the technology described in paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye1757573-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">No Additional Funds</inline>.—</heading><content>No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye1757574-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Sunset and Report</inline>.—</heading><paragraph class="fontsize10" id="ye1757575-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>This Act shall cease to be effective on the date that is 5 years after the date of enactment of this Act.<page identifier="/us/stat/138/1721">138 STAT. 1721</page></content></paragraph>
<paragraph class="fontsize10" id="ye1757576-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">GAO report</inline>.—</heading><content>Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the effectiveness of this Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye1757577-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Application</inline>.—</heading><chapeau>This Act shall only apply to—</chapeau><paragraph class="fontsize10" id="ye1757578-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>General Services Administration facilities under protection of the Federal Protective Service; and</content></paragraph>
<paragraph class="fontsize10" id="ye1757579-e80f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/118/157/s2/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>non-General Services Administration facilities that pay fees to the Federal Protective Service for protection.</content></paragraph>
