<section id="d26815e103" identifier="/us/pl/118/153/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Disaster Contract Improvement Act</shortTitle>”.</content></section>
<section id="d26815e113" identifier="/us/pl/118/153/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>OVERSIGHT ON DEBRIS REMOVAL.</heading><subsection class="firstIndent0 fontsize10" id="y0ba070ba-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y0ba070bb-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrator</inline>.—</heading><content>The term “<term>Administrator</term>” means the Administrator of the Federal Emergency Management Agency.</content></paragraph>
<paragraph class="fontsize10" id="y0ba070bc-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Debris removal program</inline>.—</heading><content>The term “<term>debris removal program</term>” means the program established under section 407 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5173">42 U.S.C. 5173</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0ba070bd-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Advisory Working Group</inline>.—</heading><paragraph class="fontsize10" id="y0ba070be-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070bf-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Administrator shall establish an advisory working group to encourage and foster collaborative efforts among individuals and entities engaged in disaster recovery relating to debris removal.</content></paragraph>
<paragraph class="fontsize10" id="y0ba070c0-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>The advisory working group established under paragraph (1) shall be comprised of—</chapeau><subparagraph class="fontsize10" id="y0ba070c1-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>representatives from the Federal Emergency Management Agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070c2-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>representatives from the Army Corps of Engineers;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070c3-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>representatives from the Natural Resources Conservation Service of the Department of Agriculture;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070c4-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>representatives of States, Tribal governments, and units of local government; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070c5-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>subject matter experts in debris removal, including not less than 1 representative from the debris services contractor industry.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0ba070c6-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070c7-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x0ba070c8-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the advisory working group established under subsection (b)(1), shall—</chapeau><paragraph class="fontsize10" id="y0ba070c9-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>determine whether guidance and procedures in effect as of the date of enactment of this Act with respect to the oversight and cost of debris removal contracts entered into under the debris removal program are sufficient; and<page identifier="/us/stat/138/1689">138 STAT. 1689</page></content></paragraph>
<paragraph class="fontsize10" id="y0ba070ca-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>if the Administrator, in consultation with the advisory working group established under subsection (b)(1), determines that the guidance and procedures described in paragraph (1) are insufficient, develop and implement additional such guidance and procedures, including—</chapeau><subparagraph class="fontsize10" id="y0ba070cb-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a requirement that each State, Tribal government, and unit of local government receiving a grant under the debris removal program take the primary role in the oversight function of debris removal;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070cc-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>guidance for State, Tribal, and local debris monitors relating to debris removal operations, debris operations oversight, and contractor oversight, including contractor monitoring;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070cd-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>guidance for streamlining the reimbursement of debris costs overall, including debris management planning and support for resilience in debris removal operations;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070ce-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070cf-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Lists.</p></sidenote><content>checklists, job aids, eligibility requirements, contract requirements, debris management planning guidance, sample bids, and other items, as determined necessary by the Administrator, for State and local debris monitors;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070d0-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070d1-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>a list of the specific debris removal monitoring responsibilities expected to be completed by a State that receives a grant under the debris removal program;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070d2-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070d3-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>a list of the specific debris removal monitoring responsibilities expected to be completed by recipients of a grant under the debris removal program; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070d4-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/c/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>guidance for State and Tribal governments and units of local government to reduce duplication and inefficiency in debris removal contracting across the Federal Government, State and Tribal governments, and units of local government.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0ba070d5-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Training</inline>.—</heading><content>The Administrator shall conduct outreach to States, Tribal governments, and units of local government with respect to any guidance or support materials developed under this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y0ba070d6-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070d7-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">GAO Study</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study that—</chapeau><paragraph class="fontsize10" id="y0ba070d8-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>studies the use and adoption rate of advance contracts for debris removal by selected States, Tribal governments, and units of local government;</content></paragraph>
<paragraph class="fontsize10" id="y0ba070d9-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>identifies the benefits and challenges of advance contracts for debris removal;</content></paragraph>
<paragraph class="fontsize10" id="y0ba070da-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>with respect to the reporting and information sharing processes, as of the date of enactment of this Act, for advance contracts for debris removal between States and units of local government and Federal partners—</chapeau><subparagraph class="fontsize10" id="y0ba070db-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070dc-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>assesses those processes; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070dd-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070de-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x0ba070df-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>makes any necessary recommendations for those processes;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0ba070e0-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>studies—</chapeau><subparagraph class="fontsize10" id="y0ba070e1-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the process for setting Federal reimbursement rates for the debris removal program;</content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070e2-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the use of penalties, as of the date of enactment of this Act, for violations of law and regulations relating to debris removal; and<page identifier="/us/stat/138/1690">138 STAT. 1690</page></content></subparagraph>
<subparagraph class="fontsize10" id="y0ba070e3-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>fraud, waste, and abuse relating to the debris removal program, including case studies; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0ba070e4-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/153/s2/e/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0ba070e5-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x0ba070e6-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>makes any necessary recommendations for improvements to oversight and fraud prevention across the debris removal program.</content></paragraph>
