<section id="d28747e90" identifier="/us/pl/118/137/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">No Stolen Trademarks Honored in America Act of 2023</shortTitle>”.</content></section>
<section id="d28747e100" identifier="/us/pl/118/137/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>MODIFICATION OF PROHIBITION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x840f95a8-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 211 of the Department of Commerce and Related Agencies Appropriations Act, 1999 (as contained in <ref href="/us/pl/105/277/dA/s101/b">section 101(b) of division A of Public Law 105–277</ref>; <ref href="/us/stat/112/2681">112 Stat. 2681</ref>–88) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y840f95a9-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)(2)—</chapeau><subparagraph class="fontsize10" id="y840f95aa-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or entity of the executive branch</quotedText>” after “<quotedText>U.S. court</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y840f95ab-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>by a designated national</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y840f95ac-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="insert">inserting</amendingAction> before the period “<quotedText>that was used in connection with a business or assets that were confiscated unless the original owner of the mark, trade name, or commercial name, or the bonafide successor-in-interest has expressly consented</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y840f95ad-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y840f95ae-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or entity of the executive branch</quotedText>” after “<quotedText>U.S. court</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y840f95af-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>by a designated national or its successor-in-interest</quotedText>”;</content></subparagraph>

<paragraph class="fontsize10" id="y840f95b0-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (d) as subsection (e);</content></paragraph>
<paragraph class="fontsize10" id="y840f95b1-e810-11f0-a1e4-69761a48a15a" identifier="/us/pl/118/137/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (c) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y840fbcc2-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x840fbcc3-e810-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>Subsections (a)(2) and (b) of this section shall apply only if the person or entity asserting the rights knew or had reason to know at the time when the person or entity acquired the rights asserted that the mark, trade name, or commercial name was the same as or substantially similar to a mark, trade name, or commercial name that was used in connection with a business or assets that were confiscated.”</content></subsection>
