<section id="d53670e100" identifier="/us/pl/117/77/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dcdc99e-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1901">2 USC 1901 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Capitol Police Emergency Assistance Act of 2021</shortTitle>”.</content></section>
<section id="d53670e115" identifier="/us/pl/117/77/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>EMERGENCY ASSISTANCE FOR THE CAPITOL POLICE.</heading><subsection class="firstIndent0 fontsize10" id="y9dce65df-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Assistance by Executive Departments and Agencies</inline>.—</heading><chapeau>Section 911(a) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (<ref href="/us/usc/t2/s1970/a">2 U.S.C. 1970(a)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y9dce65e0-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or in accordance with paragraph (4)</quotedText>” before “<quotedText>and on a permanent</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y9dce65e1-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in paragraph (4)(B)—</chapeau><subparagraph class="fontsize10" id="y9dce65e2-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding clause (i), by <amendingAction type="delete">striking</amendingAction> “<quotedText>advance</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9dce65e3-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in clause (ii)—</chapeau><clause class="fontsize10" id="y9dce65e4-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in subclause (I), by <amendingAction type="delete">striking</amendingAction> “<quotedText>or</quotedText>” after the semicolon;</content></clause>
<clause class="fontsize10" id="y9dce65e5-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in subclause (II), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” after the semicolon and <amendingAction type="insert">inserting</amendingAction> “<quotedText>or</quotedText>”; and</content></clause>
<clause class="fontsize10" id="y9dce65e6-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subclause class="fontsize10" id="y9dce65e7-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>the Chief of the Capitol Police, if the Chief of the Capitol Police has determined that the provision of assistance is necessary to prevent the significant disruption of governmental function and public order within the United States Capitol Buildings and Grounds, as described in section 9 of the Act entitled ‘An Act to define the area of the United States Capitol Grounds, to regulate the use thereof, and for other purposes’, approved July 31, 1946 (<ref href="/us/usc/t2/s1961">2 U.S.C. 1961</ref>); and”</content></subclause>
</quotedContent>; and</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9dce65e8-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y9dce65e9-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dce65ea-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Revocation</inline>.—</heading><content>The Capitol Police Board may revoke a request for assistance provided under paragraph (4)(B)(ii)(III) upon consultation with appropriate Members of the Senate and House of Representatives in leadership positions.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y9dce65eb-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Capitol Police Special Officers</inline>.—</heading><chapeau>Section 1017 of division H of the Consolidated Appropriations Resolution, 2003 (<ref href="/us/usc/t2/s1974">2 U.S.C. 1974</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y9dce65ec-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y9dce65ed-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or as determined by the Chief of the Capitol Police in accordance with section 911(a)(4)(B)(ii)(III) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (<ref href="/us/usc/t2/s1970/a/4/B/ii/III">2 U.S.C. 1970(a)(4)(B)(ii)(III)</ref>),</quotedText>” after “<quotedText>Congress,</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9dce65ee-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><p class="indentDown2 firstIndent0 fontsize10" id="x9dce8cff-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">“An<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dce8d00-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote> appointment under this section due to an emergency determined by the Chief of the Capitol Police under paragraph (4)(B)(ii)(III) of section 911(a) of division B of the Department of Defense and Emergency Supplemental Appropriations for Recovery from and Response to Terrorist Attacks on the United States Act, 2002 (<ref href="/us/usc/t2/s1970/a">2 U.S.C. 1970(a)</ref>) shall be in effect for the period of the emergency, unless and until the Capitol Police Board revokes the request for assistance under paragraph (5) of such section.”</p></quotedContent>;</content></subparagraph>

<paragraph class="fontsize10" id="y9dce8d01-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> subsections (c) and (e);</content></paragraph>
<paragraph class="fontsize10" id="y9dce8d02-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (d), (f), and (g) as subsections (c), (d), and (e), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="y9dce8d03-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in subsection (d), as redesignated by paragraph (3) of this subsection, by <amendingAction type="delete">striking</amendingAction> “<quotedText>President pro tempore</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Majority Leader</quotedText>”.</content></paragraph>

<section id="d53670e313" identifier="/us/pl/117/77/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dce8d04-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1901b">2 USC 1901b</ref>.</p></sidenote><heading>JOINT OVERSIGHT HEARINGS.</heading><subsection class="firstIndent0 fontsize10" id="y9dce8d05-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives (referred to in this section as the “Committees”) are authorized to jointly conduct oversight hearings regarding the Capitol Police Board and may request the attendance of all members of the Capitol Police Board at any such hearing. Members of the Capitol Police Board shall attend a joint hearing under this section, as requested and under such rules or procedures as may be adopted by the Committees.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9dce8d06-e812-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/77/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dceb417-e812-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Timing</inline>.—</heading><content>The Committees may conduct oversight hearings under this section as determined appropriate by the Committees, but shall conduct not less than one oversight hearing under this section during each Congress.<page identifier="/us/stat/135/1524">135 STAT. 1524</page></content></subsection>
