<section id="d54510e88" identifier="/us/pl/117/63/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">VA Transparency &amp; Trust Act of 2021</shortTitle>”.</content></section>
<section id="d54510e98" identifier="/us/pl/117/63/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CONGRESSIONAL OVERSIGHT OF CORONAVIRUS PANDEMIC FUNDING MADE AVAILABLE TO DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="y0d2d71bc-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Plan and Reports by Secretary</inline>.—</heading><paragraph class="fontsize10" id="y0d2d71bd-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Plan</inline>.—</heading><content>Not later than 30 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a detailed plan for obligating and expending covered funds, including a detailed justification for each type of obligation of such funds.</content></paragraph>
<paragraph class="fontsize10" id="y0d2d71be-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Biweekly reports</inline>.—</heading><content>Every 14 days during the period beginning on the date on which the plan under paragraph (1) is submitted and ending seven days after the date on which the Secretary has expended all covered funds, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report detailing the obligation and expenditure of, and the planned uses for, such funds during the period covered by the report, including a written justification for any deviation in such obligations, expenditures, or planned uses from such plan.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0d2d71bf-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0d2d71c0-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Inspector General Audits</inline>.—</heading><chapeau>Not later than 120 days after the date of the enactment of this Act, and semiannually thereafter for three years or until the Secretary has expended all covered funds, whichever occurs first, the Inspector General of the Department of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report examining the obligations and expenditures made using covered funds during the period covered by the report. Each such report shall include—</chapeau><paragraph class="fontsize10" id="y0d2d71c1-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a comparison of how the funds are being obligated and expended to how the funds were planned to be obligated and expended in the plan under subsection (a)(1);</content></paragraph>
<paragraph class="fontsize10" id="y0d2d71c2-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>areas of waste, fraud, and abuse, if any; and<page identifier="/us/stat/135/1485">135 STAT. 1485</page></content></paragraph>
<paragraph class="fontsize10" id="y0d2d71c3-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>any other matter the Inspector General determines relevant.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0d2d71c4-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Comptroller General Reviews</inline>.—</heading><paragraph class="fontsize10" id="y0d2d71c5-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Interim report</inline>.—</heading><chapeau>Not later than September 30, 2022, the Comptroller General of the United States shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate an interim report containing a review of obligations and expenditures made using covered funds. The report shall include—</chapeau><subparagraph class="fontsize10" id="y0d2d71c6-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a review of the process of the Department of Veterans Affairs for preparing the request for funds;</content></subparagraph>
<subparagraph class="fontsize10" id="y0d2d71c7-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an explanation of how the expenditure of such funds met the goals of the Department during the public health emergency for which the funds were made available;</content></subparagraph>
<subparagraph class="fontsize10" id="y0d2d71c8-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0d2d71c9-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x0d2d71ca-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>any recommendations to improve the process of identifying needs and expending funds during similar situations in the future; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0d2d71cb-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/c/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>a review of the plans of the Department to continue programs or investments that were begun with such funds but will continue after such funds are expended.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0d2d71cc-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Final report</inline>.—</heading><content>Not later than September 30, 2024, the Comptroller General shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a final report on the matters specified under paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0d2d71cd-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/d" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Covered Funds Defined</inline>.—</heading><chapeau>In this section, the term “<term>covered funds</term>” means funds that are made available to the Department of Veterans Affairs pursuant to—</chapeau><paragraph class="fontsize10" id="y0d2d71ce-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Families First Coronavirus Response Act (<ref href="/us/pl/116/127">Public Law 116–127</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y0d2d71cf-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Coronavirus Aid, Relief, and Economic Security Act (<ref href="/us/pl/116/136">Public Law 116–136</ref>); or</content></paragraph>
<paragraph class="fontsize10" id="y0d2d71d0-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/63/s2/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the American Rescue Plan Act of 2021 (<ref href="/us/pl/117/2">Public Law 117–2</ref>).</content></paragraph>
