<section id="d44182e100" identifier="/us/pl/117/60/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x295e16b5-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Confidentiality Opportunities for Peer Support Counseling Act</shortTitle>” or the “<shortTitle role="act">COPS Counseling Act</shortTitle>”.</content></section>
<section id="d44182e118" identifier="/us/pl/117/60/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x295e16b6-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s50901">34 USC 50901</ref>.</p></sidenote><heading>CONFIDENTIALITY OF PEER SUPPORT COMMUNICATIONS.</heading><subsection class="firstIndent0 fontsize10" id="y2960aec7-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y2960aec8-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Law enforcement agency</inline>.—</heading><content>The term “<term>law enforcement agency</term>” means a Federal agency that employs a law enforcement officer.</content></paragraph>
<paragraph class="fontsize10" id="y2960aec9-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Law enforcement officer</inline>.—</heading><content>The term “<term>law enforcement officer</term>” has the meaning given the term “<term>Federal law enforcement officer</term>” in <ref href="/us/usc/t18/s115">section 115 of title 18, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y2960aeca-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Peer support communication</inline>.—</heading><chapeau>The term “<term>peer support communication</term>” includes—</chapeau><subparagraph class="fontsize10" id="y2960aecb-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an oral or written communication made in the course of a peer support counseling session;</content></subparagraph>
<subparagraph class="fontsize10" id="y2960aecc-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a note or report arising out of a peer support counseling session;</content></subparagraph>
<subparagraph class="fontsize10" id="y2960aecd-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>a record of a peer support counseling session; or</content></subparagraph>
<subparagraph class="fontsize10" id="y2960aece-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>with respect to a communication made by a peer support participant in the course of a peer support counseling session, another communication, regarding the first communication, that is made between a peer support specialist and—</chapeau><clause class="fontsize10" id="y2960aecf-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>another peer support specialist;</content></clause>
<clause class="fontsize10" id="y2960aed0-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>a staff member of a peer support counseling program; or</content></clause>
<clause class="fontsize10" id="y2960aed1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/3/D/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>a supervisor of the peer support specialist.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2960aed2-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Peer support counseling program</inline>.—</heading><content>The term “<term>peer support counseling program</term>” means a program provided by a law enforcement agency that provides counseling services from a peer support specialist to a law enforcement officer of the agency.</content></paragraph>
<paragraph class="fontsize10" id="y2960aed3-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Peer support counseling session</inline>.—</heading><content>The term “<term>peer support counseling session</term>” means any counseling formally provided through a peer support counseling program between a peer support specialist and 1 or more law enforcement officers.<page identifier="/us/stat/135/1472">135 STAT. 1472</page></content></paragraph>
<paragraph class="fontsize10" id="y2960d5e4-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Peer support participant</inline>.—</heading><content>The term “<term>peer support participant</term>” means a law enforcement officer who receives counseling services from a peer support specialist.</content></paragraph>
<paragraph class="fontsize10" id="y2960d5e5-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Peer support specialist</inline>.—</heading><chapeau>The term “<term>peer support specialist</term>” means a law enforcement officer who—</chapeau><subparagraph class="fontsize10" id="y2960d5e6-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>has received training in—</chapeau><clause class="fontsize10" id="y2960d5e7-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/7/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>peer support counseling; and</content></clause>
<clause class="fontsize10" id="y2960d5e8-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/7/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>providing emotional and moral support to law enforcement officers who have been involved in or exposed to an emotionally traumatic experience in the course of employment; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y2960d5e9-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/a/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is designated by a law enforcement agency to provide the services described in subparagraph (A).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2960d5ea-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>Except as provided in subsection (c), a peer support specialist or a peer support participant may not disclose the contents of a peer support communication to an individual who was not a party to the peer support communication.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2960d5eb-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><chapeau>Subsection (b) shall not apply to a peer support communication if—</chapeau><paragraph class="fontsize10" id="y2960d5ec-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the peer support communication contains—</chapeau><subparagraph class="fontsize10" id="y2960d5ed-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>an explicit threat of suicide by an individual in which the individual—</chapeau><clause class="fontsize10" id="y2960d5ee-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>shares—</chapeau><subclause class="fontsize10" id="y2960d5ef-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/A/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>an intent to die by suicide; and</content></subclause>
<subclause class="fontsize10" id="y2960d5f0-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/A/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>a plan for a suicide attempt or the means by which the individual plans to carry out a suicide attempt; and</content></subclause>
</clause>
<clause class="fontsize10" id="y2960d5f1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>does not solely share that the individual is experiencing suicidal thoughts;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y2960d5f2-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an explicit threat by an individual of imminent and serious physical bodily harm or death to another individual;</content></subparagraph>
<subparagraph class="fontsize10" id="y2960d5f3-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>information—</chapeau><clause class="fontsize10" id="y2960d5f4-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>relating to the abuse or neglect of—</chapeau><subclause class="fontsize10" id="y2960d5f5-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/C/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>a child; or</content></subclause>
<subclause class="fontsize10" id="y2960d5f6-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/C/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>an older or vulnerable individual; or</content></subclause>
</clause>
<clause class="fontsize10" id="y2960d5f7-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>that is required by law to be reported; or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y2960d5f8-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>an admission of criminal conduct;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2960d5f9-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>the disclosure is permitted by each peer support participant who was a party to, as applicable—</chapeau><subparagraph class="fontsize10" id="y2960d5fa-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the peer support communication;</content></subparagraph>
<subparagraph class="fontsize10" id="y2960d5fb-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the peer support counseling session out of which the peer support communication arose;</content></subparagraph>
<subparagraph class="fontsize10" id="y2960d5fc-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the peer support counseling session of which the peer support communication is a record; or</content></subparagraph>
<subparagraph class="fontsize10" id="y2960d5fd-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the communication made in the course of a peer support counseling session that the peer support communication is regarding;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2960d5fe-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a court of competent jurisdiction issues an order or subpoena requiring the disclosure of the peer support communication; or</content></paragraph>
<paragraph class="fontsize10" id="y2960d5ff-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the peer support communication contains information that is required by law to be disclosed.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2960d600-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><chapeau>Nothing in subsection (b) shall be construed to prohibit the disclosure of—<page identifier="/us/stat/135/1473">135 STAT. 1473</page></chapeau><paragraph class="fontsize10" id="y2960d601-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>an observation made by a law enforcement officer of a peer support participant outside of a peer support counseling session; or</content></paragraph>
<paragraph class="fontsize10" id="y2960d602-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>knowledge of a law enforcement officer about a peer support participant not gained from a peer support communication.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2960d603-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Disclosure of Rights</inline>.—</heading><content>Before the initial peer support counseling session of a peer support participant, a peer support specialist shall inform the peer support participant in writing of the confidentiality requirement under subsection (b) and the exceptions to the requirement under subsection (c).</content></subsection>

<section id="d44182e413" identifier="/us/pl/117/60/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2960d604-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s50902">34 USC 50902</ref>.</p></sidenote><heading>BEST PRACTICES AND SUPPORT.</heading><subsection class="firstIndent0 fontsize10" id="y29625ca5-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y29625ca6-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">First responder</inline>.—</heading><content>The term “<term>first responder</term>” has the meaning given the term “<term>public safety officer</term>” in section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10284">34 U.S.C. 10284</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y29625ca7-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">First responder agency</inline>.—</heading><content>The term “<term>first responder agency</term>” means a Federal, State, local, or Tribal agency that employs or otherwise engages the services of a first responder.</content></paragraph>
<paragraph class="fontsize10" id="y29625ca8-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Peer support counseling program</inline>.—</heading><content>The term “<term>peer support counseling program</term>” means a program provided by a first responder agency that provides counseling services from a peer support specialist to a first responder of the first responder agency.</content></paragraph>
<paragraph class="fontsize10" id="y29625ca9-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Peer support participant</inline>.—</heading><content>The term “<term>peer support participant</term>” means a first responder who receives counseling services from a peer support specialist.</content></paragraph>
<paragraph class="fontsize10" id="y29625caa-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Peer support specialist</inline>.—</heading><chapeau>The term “<term>peer support specialist</term>” means a first responder who—</chapeau><subparagraph class="fontsize10" id="y29625cab-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>has received training in—</chapeau><clause class="fontsize10" id="y29625cac-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/5/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>peer support counseling; and</content></clause>
<clause class="fontsize10" id="y29625cad-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/5/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>providing emotional and moral support to first responders who have been involved in or exposed to an emotionally traumatic experience in the course of the duties of those first responders; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y29625cae-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is designated by a first responder agency to provide the services described in subparagraph (A).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y29625caf-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x29625cb0-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report on Best Practices</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this Act, the Attorney General, in coordination with the Secretary of Health and Human Services, shall develop a report on best practices and professional standards for peer support counseling programs for first responder agencies that includes—</chapeau><paragraph class="fontsize10" id="y29625cb1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>advice on—</chapeau><subparagraph class="fontsize10" id="y29625cb2-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>establishing and operating peer support counseling programs; and</content></subparagraph>
<subparagraph class="fontsize10" id="y29625cb3-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>training and certifying peer support specialists;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y29625cb4-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a code of ethics for peer support specialists;</content></paragraph>
<paragraph class="fontsize10" id="y29625cb5-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x29625cb6-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x29625cb7-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>recommendations for continuing education for peer support specialists;</content></paragraph>
<paragraph class="fontsize10" id="y29625cb8-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>advice on disclosing to first responders any confidentiality rights of peer support participants; and</content></paragraph>
<paragraph class="fontsize10" id="y29625cb9-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>information on—</chapeau><subparagraph class="fontsize10" id="y29625cba-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the different types of peer support counseling programs in use by first responder agencies;<page identifier="/us/stat/135/1474">135 STAT. 1474</page></content></subparagraph>
<subparagraph class="fontsize10" id="y29625cbb-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any differences in peer support counseling programs offered across categories of first responders; and</content></subparagraph>
<subparagraph class="fontsize10" id="y29625cbc-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/b/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the important role senior first responders play in supporting access to mental health resources.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y29625cbd-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x29625cbe-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web postings.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><chapeau>The Attorney General shall support and encourage the implementation of peer support counseling programs in first responder agencies by—</chapeau><paragraph class="fontsize10" id="y29625cbf-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x29625cc0-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><content>making the report developed under subsection (b) publicly available on the website of the Department of Justice; and</content></paragraph>
<paragraph class="fontsize10" id="y29625cc1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/60/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x29625cc2-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>providing a list of peer support specialist training programs on the website of the Department of Justice.</content></paragraph>
