<section id="d44302e92" identifier="/us/pl/117/59/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Jaime Zapata and Victor Avila Federal Officers and Employees Protection Act</shortTitle>”.</content></section>
<section id="d44302e102" identifier="/us/pl/117/59/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x389d70da-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1114">18 USC 1114 note</ref>.</p></sidenote><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x389dbefb-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y389dbefc-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/59/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>since the founding of the Nation, officers and employees of the United States Government have dutifully and faithfully served the United States overseas, including in situations that place them at serious risk of death or bodily harm, in order to preserve, protect, and defend the interests of the United States;</content></paragraph>
<paragraph class="fontsize10" id="y389dbefd-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/59/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>securing the safety of such officers and employees while serving overseas is of paramount importance and is also in furtherance of preserving, protecting, and defending the interests of the United States;</content></paragraph>
<paragraph class="fontsize10" id="y389dbefe-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/59/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Federal courts, including the United States Court of Appeals for the Second Circuit, the United States Court of Appeals for the Ninth Circuit, and the United States Court of Appeals for the Eleventh Circuit, have correctly interpreted <ref href="/us/usc/t18/s1114">section 1114 of title 18, United States Code</ref>, to apply extraterritorially to protect officers and employees of the United States while the officers and employees are serving abroad;</content></paragraph>
<paragraph class="fontsize10" id="y389dbeff-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/59/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in a case involving a violent attack against Federal law enforcement officers Jaime Zapata and Victor Avila, a panel of a Federal court of appeals held that <ref href="/us/usc/t18/s1114">section 1114 of title 18, United States Code</ref>, does not apply extraterritorially, creating a split among the United States circuit courts of appeals;</content></paragraph>
<paragraph class="fontsize10" id="y389dbf00-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/59/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>in light of the opinion described in paragraph (4), it has become necessary for Congress to clarify the original intent that <ref href="/us/usc/t18/s1114">section 1114 of title 18, United States Code</ref>, applies extraterritorially; and</content></paragraph>
<paragraph class="fontsize10" id="y389dbf01-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/59/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>it is further appropriate to clarify the original intent that sections 111 and 115 of <ref href="/us/usc/t18">title 18, United States Code</ref>, apply extraterritorially as well.<page identifier="/us/stat/135/1469">135 STAT. 1469</page></content></paragraph>

<section id="d44302e163" identifier="/us/pl/117/59/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PROTECTION OF OFFICERS AND EMPLOYEES OF THE UNITED STATES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x389de612-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Part I of <ref href="/us/usc/t18">title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y389de613-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/59/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in section 111, by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y389de614-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Extraterritorial Jurisdiction</inline>.—</heading><content>There is extraterritorial jurisdiction over the conduct prohibited by this section.”</content></subsection>
