<section id="d46494e88" identifier="/us/pl/117/37/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab7afad-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Puppies Assisting Wounded Servicemembers for Veterans Therapy Act</shortTitle>” or the “<shortTitle role="act">PAWS for Veterans Therapy Act</shortTitle>”.</content></section>
<section id="d46494e106" identifier="/us/pl/117/37/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab7d6be-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s1714">38 USC 1714 note</ref>.</p></sidenote><heading>DEPARTMENT OF VETERANS AFFAIRS PILOT PROGRAM ON DOG TRAINING THERAPY.</heading><subsection class="firstIndent0 fontsize10" id="yfab95d5f-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d60-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 180 days after the date of the enactment of the Act, the Secretary of Veterans Affairs shall commence the conduct of a pilot program to provide canine training to eligible veterans diagnosed with post-traumatic stress disorder (in this section referred to as “PTSD”) as an element of a complementary and integrative health program for such veterans.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d61-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Duration; Medical Centers</inline>.—</heading><paragraph class="fontsize10" id="yfab95d62-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Duration</inline>.—</heading><content>The Secretary shall carry out the pilot program under subsection (a) for a 5-year period beginning on the date of the commencement of the pilot program.</content></paragraph>
<paragraph class="fontsize10" id="yfab95d63-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Medical centers</inline>.—</heading><content>The Secretary shall ensure that such pilot program is carried out by not fewer than five medical centers of the Department of Veterans Affairs located in geographically diverse areas.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d64-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d65-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Agreements With Entities</inline>.—</heading><content>In carrying out the pilot program under subsection (a), the Secretary shall seek to enter into agreements with nongovernmental entities that the Secretary determines have the demonstrated ability to provide the canine training specified in subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d66-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Required Conditions</inline>.—</heading><chapeau>The Secretary shall include in any agreement under subsection (c) conditions requiring that the nongovernmental entity seeking to enter into the agreement—</chapeau><paragraph class="fontsize10" id="yfab95d67-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d68-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><content>submits to the Secretary certification that the entity is an accredited service dog training organization;</content></paragraph>
<paragraph class="fontsize10" id="yfab95d69-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d6a-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>agrees to ensure that veterans participating in the pilot program under subsection (a) receive training from certified service dog training instructors for a period of time determined appropriate by the entity;</content></paragraph>
<paragraph class="fontsize10" id="yfab95d6b-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>agrees to ensure that veterans participating in such pilot program are prohibited from having access to a dog under <page identifier="/us/stat/135/330">135 STAT. 330</page>
such pilot program at any time during such participation without the supervision of a certified service dog training instructor;</content></paragraph>
<paragraph class="fontsize10" id="yfab95d6c-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>agrees to ensure that veterans participating in such pilot program receive training in skills unique to the needs of the veteran to address or alleviate PTSD symptoms of the veteran;</content></paragraph>
<paragraph class="fontsize10" id="yfab95d6d-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/d/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>agrees not to use shock collars or prong collars as training tools and to use positive reinforcement training; and</content></paragraph>
<paragraph class="fontsize10" id="yfab95d6e-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/d/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>agrees to provide any follow-up training support specified in subsection (e)(2), as applicable.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d6f-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Adoption of Dog</inline>.—</heading><paragraph class="fontsize10" id="yfab95d70-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d71-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="xfab95d72-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A veteran who has participated in the pilot program under subsection (a) may adopt a dog that the veteran assisted in training during such pilot program if the veteran and the veteran’s health provider (in consultation with the entity that provided the canine training with respect to the dog under such pilot program) determine that it is in the best interest of the veteran.</content></paragraph>
<paragraph class="fontsize10" id="yfab95d73-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Follow-up training support</inline>.—</heading><content>If a veteran adopts a dog under paragraph (1), the entity that provided the canine training with respect to the dog under the pilot program shall provide follow-up training support for the life of the dog. Such support shall include the provision of a contact plan between the veteran and the entity that enables the veteran to seek and receive assistance from the entity to ensure the dog is being properly cared for.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d74-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility for Other Care and Treatment</inline>.—</heading><content>Participation in the pilot program under subsection (a) may not preclude a veteran from receiving any other medical care or treatment for PTSD furnished by the Department, including therapy, for which the veteran is otherwise eligible.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d75-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Collection of Data</inline>.—</heading><chapeau>In carrying out this section, the Secretary shall—</chapeau><paragraph class="fontsize10" id="yfab95d76-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>develop metrics and other appropriate means to measure, with respect to veterans participating in the pilot program under subsection (a)—</chapeau><subparagraph class="fontsize10" id="yfab95d77-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of such veterans participating;</content></subparagraph>
<subparagraph class="fontsize10" id="yfab95d78-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the satisfaction of such veterans with the pilot program;</content></subparagraph>
<subparagraph class="fontsize10" id="yfab95d79-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/g/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d7a-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>whether participation in the pilot program resulted in any clinically relevant improvements for such veterans, as determined by the health care provider or clinical team that referred the veteran to participate in the pilot program; and</content></subparagraph>
<subparagraph class="fontsize10" id="yfab95d7b-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/g/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>such other factors as the Secretary may determine appropriate; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfab95d7c-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>establish processes to document and track the progress of such veterans under the pilot program with respect to health benefits and improvements.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d7d-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d7e-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xfab95d7f-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report by Secretary</inline>.—</heading><chapeau>Not later than 1 year before the date on which the pilot program under subsection (a) terminates, the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report containing the recommendations of the Secretary regarding—</chapeau><paragraph class="fontsize10" id="yfab95d80-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/h/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>whether to extend or make permanent the pilot program; and<page identifier="/us/stat/135/331">135 STAT. 331</page></content></paragraph>
<paragraph class="fontsize10" id="yfab95d81-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/h/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the feasibility and advisability of expanding the pilot program to address mental health conditions other than PTSD.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d82-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/i" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">GAO Briefing and Study</inline>.—</heading><paragraph class="fontsize10" id="yfab95d83-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/i/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d84-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><content>Not later than 1 year after the date of the commencement of the pilot program under subsection (a), the Comptroller General of the United States shall provide to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a briefing on the methodology established for the pilot program.</content></paragraph>
<paragraph class="fontsize10" id="yfab95d85-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/i/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 270 days after the date on which the pilot program terminates, the Comptroller General shall submit to the committees specified in paragraph (1) a report on the pilot program.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfab95d86-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote> Such report shall include an evaluation of the approach and methodology used for the pilot program with respect to—</chapeau><subparagraph class="fontsize10" id="yfab95d87-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/i/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>assisting veterans with PTSD; and</content></subparagraph>
<subparagraph class="fontsize10" id="yfab95d88-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/i/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>measuring relevant metrics, such as reduction in scores under the Clinician Administered PTSD Scale (CAPS), improvement in psychosocial function, and therapeutic compliance.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yfab95d89-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="j">(j) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yfab95d8a-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>The term “<term>accredited service dog training organization</term>” means an organization described in section 501(c)(3) of the Internal Revenue Code of 1986 that—</chapeau><subparagraph class="fontsize10" id="yfab95d8b-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>provides service dogs to veterans with PTSD; and</content></subparagraph>
<subparagraph class="fontsize10" id="yfab9849c-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is accredited by an accrediting organization with demonstrated experience, national scope, and recognized leadership and expertise in the training of service dogs and education in the use of service dogs (as determined by the Secretary).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfab9849d-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>The term “<term>eligible veteran</term>” means a veteran who—</chapeau><subparagraph class="fontsize10" id="yfab9849e-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is enrolled in the patient enrollment system in the Department of Veterans Affairs under <ref href="/us/usc/t38/s1705">section 1705 of title 38, United States Code</ref>; and</content></subparagraph>
<subparagraph class="fontsize10" id="yfab9849f-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>has been recommended for participation in the pilot program under subsection (a) by a qualified mental health care provider or clinical team based on medical judgment that the veteran may benefit from such participation with respect to the diagnosed PTSD of the veteran.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfab984a0-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s2/j/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The term “<term>service dog training instructor</term>” means an instructor who provides the direct training of veterans with PTSD in the art and science of service dog training and handling.</content></paragraph>

<section id="d46494e418" identifier="/us/pl/117/37/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PROVISION OF SERVICE DOGS AND VETERINARY INSURANCE BENEFITS TO VETERANS WITH POST-TRAUMATIC STRESS DISORDER WHO DO NOT HAVE CERTAIN IMPAIRMENTS.</heading><subsection class="firstIndent0 fontsize10" id="yfab9abb1-e813-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/37/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t38/s1714">Section 1714 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsections:<quotedContent><subsection class="firstIndent0 fontsize10" id="yfab9d2c2-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><content>The Secretary may provide a service dog to a veteran under subsection (c)(3) regardless of whether the veteran has a mobility impairment.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yfab9d2c3-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f)</num><paragraph class="inline" id="yfab9d2c4-e813-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>The Secretary shall provide to any veteran described in paragraph (2) a commercially available veterinary insurance policy for each dog provided to such veteran under subsection (b) or (c).</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yfab9d2c5-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>A veteran described in this paragraph is a veteran who—<page identifier="/us/stat/135/332">135 STAT. 332</page></chapeau><subparagraph class="fontsize10" id="yfab9d2c6-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is diagnosed with post-traumatic stress disorder or a visual, hearing, or substantial mobility impairment;</content></subparagraph>
<subparagraph class="fontsize10" id="yfab9d2c7-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>has received a dog under subsection (b) or (c) in connection with such disorder or impairment; and</content></subparagraph>
<subparagraph class="fontsize10" id="yfab9d2c8-e813-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>meets such other requirements as the Secretary may prescribe.”</content></subparagraph>
