<section id="d50345e88" identifier="/us/pl/117/338/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd29a1aa8-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s609">47 USC 609 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Martha Wright-Reed Just and Reasonable Communications Act of 2022</shortTitle>”.</content></section>
<section id="d50345e103" identifier="/us/pl/117/338/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TECHNICAL AMENDMENTS.</heading><subsection class="firstIndent0 fontsize10" id="yd29a8fd9-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 276 of the Communications Act of 1934 (<ref href="/us/usc/t47/s276">47 U.S.C. 276</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd29a8fda-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)(1)(A)—</chapeau><subparagraph class="fontsize10" id="yd29a8fdb-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>per call</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="yd29a8fdc-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, and all rates and charges are just and reasonable,</quotedText>” after “<quotedText>fairly compensated</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="yd29a8fdd-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>each and every</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="yd29a8fde-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>call using</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>communications using</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd29a8fdf-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or other calling device</quotedText>” after “<quotedText>payphone</quotedText>”; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd29a8fe0-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (d), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and advanced communications services described in subparagraphs (A), (B), (D), and (E) of section 3(1)</quotedText>” after “<quotedText>inmate telephone service</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd29a8fe1-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Definition of Advanced Communications Services</inline>.—</heading><chapeau>Section 3(1) of the Communications Act of 1934 (<ref href="/us/usc/t47/s153/1">47 U.S.C. 153(1)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd29a8fe2-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="yd29a8fe3-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (D), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yd29a8fe4-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="fontsize10" id="yd29a8fe5-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>any audio or video communications service used by inmates for the purpose of communicating with individuals outside the correctional institution where the inmate is held, regardless of technology used.”</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yd29a8fe6-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Application of the Act</inline>.—</heading><content>Section 2(b) of the Communications Act of 1934 (<ref href="/us/usc/t47/s152/b">47 U.S.C. 152(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 276,</quotedText>” after “<quotedText>sections 223 through 227, inclusive,</quotedText>”.</content></subsection>

<section id="d50345e258" identifier="/us/pl/117/338/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd29a8fe7-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s152">47 USC 152 note</ref>.</p></sidenote><heading>IMPLEMENTATION.</heading><subsection class="firstIndent0 fontsize10" id="yd29ade08-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Rulemaking</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd29ade09-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote>—</heading><content>Not earlier than 18 months and not later than 24 months after the date of enactment of this Act, the Federal <page identifier="/us/stat/136/6157">136 STAT. 6157</page>
Communications Commission shall promulgate any regulations necessary to implement this Act and the amendments made by this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd29ade0a-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Use of Data</inline>.—</heading><chapeau>In implementing this Act and the amendments made by this Act, including by promulgating regulations under subsection (a) and determining just and reasonable rates, the Federal Communications Commission—</chapeau><paragraph class="fontsize10" id="yd29ade0b-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>may use industry-wide average costs of telephone service and advanced communications services and the average costs of service of a communications service provider; and</content></paragraph>
<paragraph class="fontsize10" id="yd29ade0c-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/338/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>shall consider costs associated with any safety and security measures necessary to provide a service described in paragraph (1) and differences in the costs described in paragraph (1) by small, medium, or large facilities or other characteristics.</content></paragraph>

<section id="d50345e305" identifier="/us/pl/117/338/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd29ade0d-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s152">47 USC 152 note</ref>.</p></sidenote><heading>EFFECT ON OTHER LAWS.</heading><content style="-uslm-lc:I658120">  Nothing in this Act shall be construed to modify or affect any Federal, State, or local law to require telephone service or advanced communications services at a State or local prison, jail, or detention facility or prohibit the implementation of any safety and security measures related to such services at such facilities.</content></section>
