<section id="d52298e88" identifier="/us/pl/117/313/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc09654ee-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Faster Payments to Veterans’ Survivors Act of 2022</shortTitle>”.</content></section>
<section id="d52298e103" identifier="/us/pl/117/313/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TIMEFRAME FOR DESIGNATION OF ALTERNATE BENEFICIARIES AND PAYMENT OF BENEFITS UNDER DEPARTMENT OF VETERANS AFFAIRS LIFE INSURANCE PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="yc096a30f-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">National Service Life Insurance</inline>.—</heading><chapeau><ref href="/us/usc/t38/s1917/f/1">Section 1917(f)(1) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yc096a310-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>two years</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>one year</quotedText>”; and</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yc096a312-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">United States Government Life Insurance</inline>.—</heading><chapeau>Section 1952(c)(1) of such title <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yc096a313-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>two years</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>one year</quotedText>”; and</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yc096a315-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc096a316-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s1917">38 USC 1917 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by this section shall apply with respect to the death of an insured person occurring on or after the date that is two years before the date of the enactment of this Act.</content></subsection>

<section id="d52298e198" identifier="/us/pl/117/313/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>BENEFICIARY DESIGNATION PROCESS UNDER DEPARTMENT OF VETERANS AFFAIRS LIFE INSURANCE PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="yc096f137-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">NSLI</inline>.—</heading><content><ref href="/us/usc/t38/s1917">Section 1917 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> subsection (a) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yc0973f58-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a)</num><paragraph class="inline" id="yc0973f59-e815-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>A person who enrolls in insurance maturing on or after August 1, 1946, may designate a beneficiary of the insurance policy. The insured shall, subject to regulations, at all times have the right to change the beneficiary or beneficiaries of such insurance without the consent of such beneficiary or beneficiaries.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yc0973f5a-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc0973f5b-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><chapeau>If a person enrolled in insurance maturing on or after August 1, 1946, does not designate a beneficiary under paragraph (1) before the veteran dies, or if a designated beneficiary predeceases <page identifier="/us/stat/136/4400">136 STAT. 4400</page>
the veteran, the Secretary shall determine the beneficiary in the following order:</chapeau><subparagraph class="fontsize10" id="yc0973f5c-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The surviving spouse of the insured person.</content></subparagraph>
<subparagraph class="fontsize10" id="yc0973f5d-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The children of the insured person and descendants of deceased children by representation.</content></subparagraph>
<subparagraph class="fontsize10" id="yc0973f5e-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>The parents of the insured person or the survivors of the parents.</content></subparagraph>
<subparagraph class="fontsize10" id="yc0973f5f-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>The duly appointed executor or administrator of the estate of the insured person.</content></subparagraph>
<subparagraph class="fontsize10" id="yc0973f60-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>Other next of kin of the insured person entitled under the laws of domicile of the insured person at the time of the death of the insured person.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yc0973f61-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">USGLI</inline>.—</heading><paragraph class="fontsize10" id="yc0973f62-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s3/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Section 1949 of such title <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="yc0976573-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658164"><num class="fontsize12" value="1949">“§ 1949.</num><heading class="fontsize12"> Beneficiaries</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="yc0976574-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Designation</inline>.—</heading><content>A person who enrolls in United States Government life insurance may designate a beneficiary of the insurance policy. Subject to regulations, the insured person shall at all times have the right to change the beneficiary or beneficiaries of a United States Government life insurance policy without the consent of such beneficiary or beneficiaries.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yc0976575-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Determination in Cases of Non-Designation</inline>.—</heading><chapeau>If a person enrolled in United States Government life insurance does not designate a beneficiary under subsection (a) before the insured person dies, or if a designated beneficiary predeceases the insured person, the Secretary shall determine the beneficiary in the following order:</chapeau><paragraph class="fontsize10" id="yc0976576-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>The surviving spouse of the insured person.</content></paragraph>
<paragraph class="fontsize10" id="yc0976577-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>The children of the insured person and descendants of deceased children by representation.</content></paragraph>
<paragraph class="fontsize10" id="yc0976578-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>The parents of the insured person or the survivors of the parents.</content></paragraph>

<section id="d52298e397" identifier="/us/pl/117/313/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc097657f-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s1981">38 USC 1981 note</ref> prec.</p></sidenote><heading>DEPARTMENT OF VETERANS AFFAIRS IMPROVEMENT OF TREATMENT OF UNDISBURSED LIFE INSURANCE BENEFITS.</heading><subsection class="firstIndent0 fontsize10" id="yc097dab0-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Improvement of Processes</inline>.—</heading><chapeau>The Secretary of Veterans Affairs shall improve the processes and procedures of the Department of Veterans Affairs with respect to identifying, locating, and paying hard-to-find beneficiaries of life insurance policies issued under <ref href="/us/usc/t38/ch19">chapter 19 of title 38, United States Code</ref>, including by—<page identifier="/us/stat/136/4401">136 STAT. 4401</page></chapeau><paragraph class="fontsize10" id="yc097dab1-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>improving the search tools available on the website of the Department;</content></paragraph>
<paragraph class="fontsize10" id="yc097dab2-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>conducting outreach to veterans, veterans service organizations, and the general public with respect to such search tools;</content></paragraph>
<paragraph class="fontsize10" id="yc097dab3-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>improving the processes for searching for information relating to potential recipients through internal Department sources and sources available through other Federal agencies, State government agencies, and non-government entities; and</content></paragraph>
<paragraph class="fontsize10" id="yc097dab4-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc097dab5-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>ensuring the Department has sufficient dedicated staff whose primary responsibilities are identifying, locating, and paying hard-to-find beneficiaries, with the goal of disbursing by not later than two years after the date of the enactment of this Act, all funds that, as of the date of the enactment of this Act, are owed to a beneficiary of a life insurance policy issued under <ref href="/us/usc/t38/ch19">chapter 19 of title 38, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc097dab6-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><content>It is the sense of Congress that the Secretary of Veterans Affairs should work with interagency partners to determine the types of records, reports, and other materials that may be required to identify, locate, and disburse undisbursed life insurance benefits to hard-to-find beneficiaries.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc097dab7-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the progress of the Secretary in carrying out this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc097dab8-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/d" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Undisbursed Life Insurance Benefits Defined</inline>.—</heading><chapeau>The term “<term>undisbursed life insurance benefits</term>”—</chapeau><paragraph class="fontsize10" id="yc097dab9-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>means any amount of money that is owed to a beneficiary of a life insurance policy issued under <ref href="/us/usc/t38/ch19">chapter 19 of title 38, United States Code</ref>, and that has not been disbursed for a period of two years or longer; and</content></paragraph>
<paragraph class="fontsize10" id="yc097daba-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>does not include any amount of money that—</chapeau><subparagraph class="fontsize10" id="yc097dabb-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/313/s4/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>has not been disbursed due to a contested claim; or</content></subparagraph>

Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
