<section id="d64244e102" identifier="/us/pl/117/243/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Big Cat Public Safety Act</shortTitle>”.</content></section>
<section id="d64244e112" identifier="/us/pl/117/243/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><subsection class="firstIndent0 fontsize10" id="yad076f58-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 2 of the Lacey Act Amendments of 1981 (<ref href="/us/usc/t16/s3371">16 U.S.C. 3371</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yad076f59-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (a) through (k) as subsections (b) through (l), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="yad07966a-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> before subsection (b) (as so redesignated) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yad07966b-e818-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Breed</inline>.—</heading><content>The term ‘<term>breed</term>’ means to facilitate propagation or reproduction (whether intentionally or negligently), or to fail to prevent propagation or reproduction.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="yad07966c-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendments</inline>.—</heading><paragraph class="fontsize10" id="yad07966d-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Consolidated farm and rural development act</inline>.—</heading><chapeau>Section 349(a)(3) of the Consolidated Farm and Rural Development Act (<ref href="/us/usc/t7/s1997/a/3">7 U.S.C. 1997(a)(3)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="yad07966e-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>section 2(a)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 2</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yad07966f-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>3371(a)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>3371</quotedText>”.</content></subparagraph>

<paragraph class="fontsize10" id="yad079670-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s2/b/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Lacey act amendments of 1981</inline>.—</heading><content>Section 7(c) of the Lacey Act Amendments of 1981 (<ref href="/us/usc/t16/s3376/c">16 U.S.C. 3376(c)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>section 2(f)(2)(A)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 2(g)(2)(A)</quotedText>”.</content></paragraph>

<section id="d64244e232" identifier="/us/pl/117/243/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PROHIBITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xad0832b1-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 3 of the Lacey Act Amendments of 1981 (<ref href="/us/usc/t16/s3372">16 U.S.C. 3372</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yad0832b2-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="yad0832b3-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in paragraph (2)—</chapeau><clause class="fontsize10" id="yad0832b4-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s3/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> the semicolon at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; or</quotedText>”;</content></clause>

<paragraph class="fontsize10" id="yad0832b8-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/243/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="amend">amending</amendingAction> subsection (e) to read as follows:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yad08f609-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Captive Wildlife Offense</inline>.—</heading><page identifier="/us/stat/136/2337">136 STAT. 2337</page>
<paragraph class="fontsize10" id="yad08f60a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (2), it is unlawful for any person to—</chapeau><subparagraph class="fontsize10" id="yad08f60b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce, or in a manner substantially affecting interstate or foreign commerce; or</content></subparagraph>
<subparagraph class="fontsize10" id="yad08f60c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>breed or possess;</content></subparagraph>
<continuation class="firstIndent1 fontsize10" id="xad08f60d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122">any prohibited wildlife species.</continuation></paragraph>
<paragraph class="fontsize10" id="yad08f60e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on application</inline>.—</heading><chapeau>Paragraph (1) does not apply to—</chapeau><subparagraph class="fontsize10" id="yad08f60f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>an entity exhibiting animals to the public under a Class C license from the Department of Agriculture, or a Federal facility registered with the Department of Agriculture that exhibits animals, if such entity or facility holds such license or registration in good standing and if the entity or facility—</chapeau><clause class="fontsize10" id="yad08f610-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>does not allow any individual to come into direct physical contact with a prohibited wildlife species, unless that individual is—</chapeau><subclause class="fontsize10" id="yad08f611-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>a trained professional employee or contractor of the entity or facility (or an accompanying employee receiving professional training);</content></subclause>
<subclause class="fontsize10" id="yad08f612-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>a licensed veterinarian (or a veterinary student accompanying such a veterinarian); or</content></subclause>
<subclause class="fontsize10" id="yad08f613-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xad08f614-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xad08f615-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Plan.</p></sidenote><chapeau>directly supporting conservation programs of the entity or facility, the contact is not in the course of commercial activity (which may be evidenced by advertisement or promotion of such activity or other relevant evidence), and the contact is incidental to humane husbandry conducted pursuant to a species-specific, publicly available, peer-edited population management and care plan that has been provided to the Secretary with justifications that the plan—</chapeau><item class="fontsize10" id="yad08f616-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>reflects established conservation science principles;</content></item>
<item class="fontsize10" id="yad08f617-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xad08f618-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>incorporates genetic and demographic analysis of a multi-institution population of animals covered by the plan; and</content></item>
<item class="fontsize10" id="yad08f619-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>promotes animal welfare by ensuring that the frequency of breeding is appropriate for the species; and</content></item>
</subclause>
</clause>
<clause class="fontsize10" id="yad08f61a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>ensures that during public exhibition of a lion (Panthera leo), tiger (Panthera tigris), leopard (Panthera pardus), snow leopard (Uncia uncia), jaguar (Panthera onca), cougar (Puma concolor), or any hybrid thereof, the animal is at least 15 feet from members of the public unless there is a permanent barrier sufficient to prevent public contact;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yad08f61b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a State college, university, or agency, or a State-licensed veterinarian;</content></subparagraph>
<subparagraph class="fontsize10" id="yad08f61c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>a wildlife sanctuary that cares for prohibited wildlife species, and—</chapeau><clause class="fontsize10" id="yad08f61d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is a corporation that is exempt from taxation under section 501(a) of the Internal Revenue Code of 1986 and described in sections 501(c)(3) and 170(b)(1)(A)(vi) of such Code;<page identifier="/us/stat/136/2338">136 STAT. 2338</page></content></clause>
<clause class="fontsize10" id="yad08f61e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>does not commercially trade in any prohibited wildlife species, including offspring, parts, and byproducts of such animals;</content></clause>
<clause class="fontsize10" id="yad08f61f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>does not breed any prohibited wildlife species;</content></clause>
<clause class="fontsize10" id="yad08f620-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>does not allow direct contact between the public and any prohibited wildlife species; and</content></clause>
<clause class="fontsize10" id="yad08f621-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>does not allow the transportation and display of any prohibited wildlife species off-site;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yad08f622-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>has custody of any prohibited wildlife species solely for the purpose of expeditiously transporting the prohibited wildlife species to a person described in this paragraph with respect to the species; or</content></subparagraph>
<subparagraph class="fontsize10" id="yad08f623-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><chapeau>an entity or individual that is in possession of any prohibited wildlife species that was born before the date of the enactment of the Big Cat Public Safety Act, and—</chapeau><clause class="fontsize10" id="yad08f624-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xad08f625-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xad08f626-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Registration.</p></sidenote><content>not later than 180 days after the date of the enactment of the such Act, the entity or individual registers each individual animal of each prohibited wildlife species possessed by the entity or individual with the United States Fish and Wildlife Service;</content></clause>
<clause class="fontsize10" id="yad08f627-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>does not breed, acquire, or sell any prohibited wildlife species after the date of the enactment of such Act; and</content></clause>
<clause class="fontsize10" id="yad08f628-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>does not allow direct contact between the public and prohibited wildlife species.”</content></clause>
