<section id="d117184e92" identifier="/us/pl/117/225/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">First Responder Fair Return for Employees on Their Initial Retirement Earned Act</shortTitle>” or the “<shortTitle role="act">First Responder Fair RETIRE Act</shortTitle>”.</content></section>
<section id="d117184e105" identifier="/us/pl/117/225/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39c8c292-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s8336">5 USC 8336 note</ref>.</p></sidenote><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x39c8e9a3-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y39c8e9a4-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>it is in the best national and homeland security interests of the United States for Federal agencies to retain the specialized knowledge and experience of individuals who suffer an injury or illness while serving in a covered position (as defined under the amendments made by this Act); and</content></paragraph>
<paragraph class="fontsize10" id="y39c8e9a5-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Federal agencies should ensure, to the greatest extent possible, that an individual who can no longer carry out the duties of a covered position, and is reappointed to a position in the civil service that is not a covered position, is reappointed within the same Federal agency, in the same geographic location, and at a level of pay commensurate to the position which the individual held immediately prior to such injury or illness.</content></paragraph>
</section>
<section id="d117184e127" identifier="/us/pl/117/225/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>RETIREMENT FOR CERTAIN EMPLOYEES.</heading><subsection class="firstIndent0 fontsize10" id="y39ca7046-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">CSRS</inline>.—</heading><content><ref href="/us/usc/t5/s8336/c">Section 8336(c) of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 firstIndent0 fontsize10" id="y39cae577-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3)</num><subparagraph class="inline" id="y39cae578-e819-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39cae579-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definitions.</p></sidenote><chapeau>In this paragraph—</chapeau><clause class="fontsize10" id="y39cae57a-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>the term ‘<term>affected individual</term>’ means an individual covered under this subchapter who—</chapeau><subclause class="fontsize10" id="y39cae57b-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>is performing service in a covered position;</content></subclause>
<subclause class="fontsize10" id="y39cae57c-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>while on duty, becomes ill or is injured as a direct result of the performance of such duties before the date on which the individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), (m), or (n), as applicable;</content></subclause>
<subclause class="fontsize10" id="y39cae57d-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>because of the illness or injury described in subclause (II), is permanently unable to render useful and <page identifier="/us/stat/136/2294">136 STAT. 2294</page>
efficient service in the employee’s covered position, as determined by the agency in which the individual was serving when such individual incurred the illness or injury; and</content></subclause>
<subclause class="fontsize10" id="y39cae57e-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><chapeau>is appointed to a position in the civil service that—</chapeau><item class="fontsize10" id="y39cae57f-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>is not a covered position; and</content></item>
<item class="fontsize10" id="y39cae580-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>is within an agency that regularly appoints individuals to supervisory or administrative positions related to the activities of the former covered position of the individual;</content></item>
</subclause>
</clause>
<clause class="fontsize10" id="y39cae581-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the term ‘<term>covered position</term>’ means a position as a law enforcement officer, customs and border protection officer, firefighter, air traffic controller, nuclear materials courier, member of the Capitol Police, or member of the Supreme Court Police.</content></clause>
</subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cae582-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Unless an affected individual files an election described in subparagraph (E), creditable service by the affected individual in a position described in subparagraph (A)(i)(IV) shall be treated as creditable service in a covered position for purposes of this chapter and determining the amount to be deducted and withheld from the pay of the affected individual under section 8334.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cae583-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39cae584-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>Subparagraph (B) shall only apply if the affected employee transitions to a position described in subparagraph (A)(i)(IV) without a break in service exceeding 3 days.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cae585-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><chapeau>The service of an affected individual shall no longer be eligible for treatment under subparagraph (B) if such service occurs after the individual—</chapeau><clause class="fontsize10" id="y39cae586-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is transferred to a supervisory or administrative position related to the activities of the former covered position of the individual; or</content></clause>
<clause class="fontsize10" id="y39cae587-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>meets the age and service requirements that would subject the individual to mandatory separation under section 8335 if such individual had remained in the former covered position.</content></clause>
</subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cae588-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>In accordance with procedures established by the Director of the Office of Personnel Management, an affected individual may file an election to have any creditable service performed by the affected individual treated in accordance with this chapter without regard to subparagraph (B).</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cae589-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>Nothing in this paragraph shall be construed to apply to such affected individual any other pay-related laws or regulations applicable to a covered position.”</content></subparagraph>
</paragraph>

<subsection class="firstIndent0 fontsize10" id="y39cae58a-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">FERS</inline>.—</heading><paragraph class="fontsize10" id="y39cae58b-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau><ref href="/us/usc/t5/s8412/d">Section 8412(d) of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="y39cae58c-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</content></subparagraph>
<subparagraph class="fontsize10" id="y39cae58d-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(1)</quotedText>” before “<quotedText>An employee</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y39cae58e-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentDown2 firstIndent0 fontsize10" id="y39cb33af-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2)</num><subparagraph class="inline" id="y39cb33b0-e819-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39cb33b1-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definitions.</p></sidenote><chapeau>In this paragraph—</chapeau><clause class="fontsize10" id="y39cb33b2-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>the term ‘<term>affected individual</term>’ means an individual covered under this chapter who—</chapeau><subclause class="fontsize10" id="y39cb33b3-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>is performing service in a covered position;</content></subclause>
<subclause class="fontsize10" id="y39cb33b4-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>while on duty, becomes ill or is injured as a direct result of the performance of such duties before the date on which the individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), as applicable;<page identifier="/us/stat/136/2295">136 STAT. 2295</page></content></subclause>

<subclause class="fontsize10" id="y39cb33b6-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><chapeau>is appointed to a position in the civil service that—</chapeau><item class="fontsize10" id="y39cb33b7-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>is not a covered position; and</content></item>
<item class="fontsize10" id="y39cb33b8-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>is within an agency that regularly appoints individuals to supervisory or administrative positions related to the activities of the former covered position of the individual;</content></item>

<clause class="fontsize10" id="y39cb33b9-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the term ‘<term>covered position</term>’ means a position as a law enforcement officer, customs and border protection officer, firefighter, air traffic controller, nuclear materials courier, member of the Capitol Police, or member of the Supreme Court Police.</content></clause>

<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cb33ba-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Unless an affected individual files an election described in subparagraph (E), creditable service by the affected individual in a position described in subparagraph (A)(i)(IV) shall be treated as creditable service in a covered position for purposes of this chapter and determining the amount to be deducted and withheld from the pay of the affected individual under section 8422.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cb33bb-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39cb33bc-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>Subparagraph (B) shall only apply if the affected employee transitions to a position described in subparagraph (A)(i)(IV) without a break in service exceeding 3 days.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y39cb33bd-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><chapeau>The service of an affected individual shall no longer be eligible for treatment under subparagraph (B) if such service occurs after the individual—</chapeau><clause class="fontsize10" id="y39cb33be-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is transferred to a supervisory or administrative position related to the activities of the former covered position of the individual; or</content></clause>

<paragraph class="fontsize10" id="y39cb5ad2-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Technical and conforming amendments</inline>.—</heading><subparagraph class="fontsize10" id="y39cb5ad3-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b/2/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau><ref href="/us/usc/t5/ch84">Chapter 84 of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><clause class="fontsize10" id="y39cb5ad4-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/b/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in section 8414(b)(3), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(1)</quotedText>” after “<quotedText>subsection (d)</quotedText>”;</content></clause>

<subsection class="firstIndent0 fontsize10" id="y39cb5adf-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">CIA Employees</inline>.—</heading><content>Section 302 of the Central Intelligence Agency Retirement Act (<ref href="/us/usc/t50/s2152">50 U.S.C. 2152</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y39cbd010-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Employees Disabled on Duty</inline>.—</heading><paragraph class="fontsize10" id="y39cbd011-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection—</chapeau><subparagraph class="fontsize10" id="y39cbd012-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the term ‘<term>affected employee</term>’ means an employee of the Agency covered under <ref href="/us/usc/t5/ch84/schII">subchapter II of chapter 84 of title 5, United States Code</ref>, who—</chapeau><clause class="fontsize10" id="y39cbd013-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is performing service in a position designated under subsection (a);</content></clause>
<clause class="fontsize10" id="y39cbd014-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>while on duty in the position designated under subsection (a), becomes ill or is injured as a direct result of the performance of such duties before the date on which the employee becomes entitled to an annuity under section 233 of this Act or <ref href="/us/usc/t5/s8412/d/1">section 8412(d)(1) of title 5, United States Code</ref>;</content></clause>
<clause class="fontsize10" id="y39cbd015-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>because of the illness or injury described in clause (ii), is permanently unable to render useful and efficient service in the employee’s covered position, as determined by the Director; and</content></clause>
<clause class="fontsize10" id="y39cbd016-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>is appointed to a position in the civil service that is not a covered position but is within the Agency; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y39cbd017-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the term ‘<term>covered position</term>’ means a position as—</chapeau><clause class="fontsize10" id="y39cbd018-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a law enforcement officer described in section 8331(20) or 8401(17) of <ref href="/us/usc/t5">title 5, United States Code</ref>;</content></clause>
<clause class="fontsize10" id="y39cbd019-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a customs and border protection officer described in section 8331(31) or 8401(36) of <ref href="/us/usc/t5">title 5, United States Code</ref>;</content></clause>
<clause class="fontsize10" id="y39cbd01a-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a firefighter described in section 8331(21) or 8401(14) of <ref href="/us/usc/t5">title 5, United States Code</ref>;</content></clause>
<clause class="fontsize10" id="y39cbd01b-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>an air traffic controller described in section 8331(30) or 8401(35) of <ref href="/us/usc/t5">title 5, United States Code</ref>;</content></clause>
<clause class="fontsize10" id="y39cbd01c-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>a nuclear materials courier described in section 8331(27) or 8401(33) of <ref href="/us/usc/t5">title 5, United States Code</ref>;</content></clause>
<clause class="fontsize10" id="y39cbd01d-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>a member of the United States Capitol Police;</content></clause>
<clause class="fontsize10" id="y39cbd01e-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>a member of the Supreme Court Police;</content></clause>
<clause class="fontsize10" id="y39cbd01f-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">“(viii) </num><content>an affected employee; or</content></clause>
<clause class="fontsize10" id="y39cbd020-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">“(ix) </num><content>a special agent described in section 804(15) of the Foreign Service Act of 1980 (<ref href="/us/usc/t22/s4044/15">22 U.S.C. 4044(15)</ref>).</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y39cbd021-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of service after disability</inline>.—</heading><content>Unless an affected employee files an election described in paragraph (3), creditable service by the affected employee in a position described in paragraph (1)(A)(iv) shall be treated as creditable service in a covered position for purposes of this Act and chapter <page identifier="/us/stat/136/2297">136 STAT. 2297</page>
84 of <ref href="/us/usc/t5">title 5, United States Code</ref>, including eligibility for an annuity under section 233 of this Act or 8412(d)(1) of <ref href="/us/usc/t5">title 5, United States Code</ref>, and determining the amount to be deducted and withheld from the pay of the affected employee under <ref href="/us/usc/t5/s8422">section 8422 of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y39cbd022-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39cbd023-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Break in service</inline>.—</heading><content>Paragraph (2) shall only apply if the affected employee transitions to a position described in paragraph (1)(A)(iv) without a break in service exceeding 3 days.</content></paragraph>
<paragraph class="fontsize10" id="y39cbd024-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on treatment of service</inline>.—</heading><content>The service of an affected employee shall no longer be eligible for treatment under paragraph (2) if such service occurs after the employee is transferred to a supervisory or administrative position related to the activities of the former covered position of the employee.</content></paragraph>
<paragraph class="fontsize10" id="y39cbd025-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Opt out</inline>.—</heading><content>An affected employee may file an election to have any creditable service performed by the affected employee treated in accordance with <ref href="/us/usc/t5/ch84">chapter 84 of title 5, United States Code</ref>, without regard to paragraph (2).”</content></paragraph>

<item class="fontsize10" id="y39cc455c-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>while on duty as a special agent, becomes ill or is injured as a direct result of the performance of such duties before the date on which the individual becomes entitled to an annuity under section 811;</content></item>

<paragraph class="fontsize10" id="y39cc4572-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">CIA employees</inline>.—</heading><content>The Director of the Central Intelligence Agency shall promulgate regulations to carry out the amendment made by subsection (c).</content></paragraph>
<paragraph class="fontsize10" id="y39cc4573-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Foreign service retirement and disability system</inline>.—</heading><content>The Secretary of State shall promulgate regulations to carry out the amendment made by subsection (d).</content></paragraph>
<paragraph class="fontsize10" id="y39cc4574-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39cc4575-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirement.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Agency certification</inline>.—</heading><chapeau>The regulations promulgated to carry out the amendments made by this Act shall include a requirement that the head of the agency at which an affected employee or special agent (as the case may be) incurred the applicable illness or injury certifies that such illness or injury—</chapeau><subparagraph class="fontsize10" id="y39cc4576-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/e/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>was incurred in the course of the employee’s or special agent’s duties; and</content></subparagraph>
<subparagraph class="fontsize10" id="y39cc4577-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/e/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>permanently precludes the employee or special agent from rendering useful and efficient service in the covered position but would not preclude the employee or special agent from continuing to serve in the Federal service.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y39cc4578-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/e/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Agency reappointment</inline>.—</heading><content>The regulations promulgated to carry out the amendments made by this Act shall ensure that, to the greatest extent possible, the head of each agency appoints affected employees or special agents to supervisory or administrative positions related to the activities of the former covered position of the employee or special agent.</content></paragraph>
<paragraph class="fontsize10" id="y39cc4579-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/e/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of service</inline>.—</heading><content>The regulations promulgated to carry out the amendments made by this Act shall ensure that the creditable service of an affected employee or special agent (as the case may be) that is not in a covered position pursuant to an election made under such amendments shall be treated as the same type of service as the covered position in which the employee or agent suffered the qualifying illness or injury.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y39cc457a-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x39cc457b-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s8336">5 USC 8336 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date; Applicability</inline>.—</heading><chapeau>The amendments made by this Act—</chapeau><paragraph class="fontsize10" id="y39cc457c-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>shall take effect on the date of enactment of this Act; and<page identifier="/us/stat/136/2299">136 STAT. 2299</page></content></paragraph>
<paragraph class="fontsize10" id="y39cc457d-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/225/s3/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>shall apply to an individual who suffers an illness or injury described in section 8336(c)(3)(A)(i)(II) or <ref href="/us/usc/t5/s8412/d/2/A/i/II">section 8412(d)(2)(A)(i)(II) of title 5, United States Code</ref>, as amended by this section, section 302(d)(1)(A)(ii) of the Central Intelligence Agency Retirement Act, as amended by this section, or section 806(a)(6)(D)(i)(I)(bb) of the Foreign Service Act of 1980, as amended by this section, on or after the date that is 2 years after the date of enactment of this Act.</content></paragraph>

<section id="d117184e999" identifier="/us/pl/117/225/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
