<section id="d66880e92" identifier="/us/pl/117/200/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Joint Consolidation Loan Separation Act</shortTitle>”.</content></section>
<section id="d66880e102" identifier="/us/pl/117/200/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SEPARATING JOINT CONSOLIDATION LOANS.</heading><subsection class="firstIndent0 fontsize10" id="yee4b16aa-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/200/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 455(g) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1087e/g">20 U.S.C. 1087e(g)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yee4b16ab-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/200/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>A borrower</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yee4b16ac-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A borrower”</content></paragraph>
</quotedContent>; and</content></paragraph>
<paragraph class="fontsize10" id="yee4b16ad-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/200/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yee4b8bde-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Separating joint consolidation loans</inline>.—</heading><subparagraph class="fontsize10" id="yee4b8bdf-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><clause class="fontsize10" id="yee4b8be0-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Authorization</inline>.—</heading><content>A married couple, or 2 individuals who were previously a married couple, and who received a joint consolidation loan as such married couple under subparagraph (C) of section 428C(a)(3) (as such subparagraph was in effect on June 30, 2006), may apply to the Secretary, in accordance with subparagraph (C) of this paragraph, for each individual borrower in the married couple (or previously married couple) to receive a separate Federal Direct Consolidation Loan under this part.</content></clause>
<clause class="fontsize10" id="yee4b8be1-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility for borrowers in default</inline>.—</heading><content>Notwithstanding any other provision of this Act, a married couple, or 2 individuals who were previously a married couple, who are in default on a joint consolidation loan may be eligible to receive a separate Federal Direct Consolidation Loan under this part in accordance with this paragraph.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yee4b8be2-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Secretarial requirements</inline>.—</heading><chapeau>Notwithstanding section 428C(a)(3)(A) or any other provision of law, for each individual borrower who applies under subparagraph (A), the Secretary shall—</chapeau><clause class="fontsize10" id="yee4b8be3-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>make a separate Federal Direct Consolidation Loan under this part that—</chapeau><subclause class="fontsize10" id="yee4b8be4-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>shall be for an amount equal to the product of—</chapeau><item class="fontsize10" id="yee4b8be5-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the unpaid principal and accrued unpaid interest of the joint consolidation loan <page identifier="/us/stat/136/2220">136 STAT. 2220</page>
(as of the date that is the day before such separate consolidation loan is made) and any outstanding charges and fees with respect to such loan; and</content></item>
<item class="fontsize10" id="yee4b8be6-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><chapeau>the percentage of the joint consolidation loan attributable to the loans of the individual borrower for whom such separate consolidation loan is being made, as determined—</chapeau><subitem class="fontsize10" id="yee4b8be7-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="AA">“(AA) </num><content>on the basis of the loan obligations of such borrower with respect to such joint consolidation loan (as of the date such joint consolidation loan was made); or</content></subitem>
<subitem class="fontsize10" id="yee4b8be8-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><content>in the case in which both borrowers request, on the basis of proportions outlined in a divorce decree, court order, or settlement agreement; and</content></subitem>

</subclause>
<subclause class="fontsize10" id="yee4b8be9-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>has the same rate of interest as the joint consolidation loan (as of the date that is the day before such separate consolidation loan is made); and</content></subclause>
</clause>
<clause class="fontsize10" id="yee4b8bea-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xee4b8beb-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notification.</p></sidenote><content>in a timely manner, notify each individual borrower that the joint consolidation loan had been repaid and of the terms and conditions of their new loans.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yee4b8bec-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Application for separate direct consolidation loan</inline>.—</heading><clause class="fontsize10" id="yee4b8bed-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Joint application</inline>.—</heading><content>Except as provided in clause (ii), to receive separate consolidation loans under this part, both individual borrowers in a married couple (or previously married couple) shall jointly apply under subparagraph (A).</content></clause>
<clause class="fontsize10" id="yee4b8bee-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Separate application</inline>.—</heading><chapeau>An individual borrower in a married couple (or previously married couple) may apply for a separate consolidation loan under subparagraph (A) separately and without regard to whether or when the other individual borrower in the married couple (or previously married couple) applies under subparagraph (A), in a case in which—</chapeau><subclause class="fontsize10" id="yee4b8bef-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>the individual borrower certifies to the Secretary that such borrower—</chapeau><item class="fontsize10" id="yee4b8bf0-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>has experienced an act of domestic violence (as defined in section 40002 of the Violence Against Women Act of 1994 (<ref href="/us/usc/t34/s12291">34 U.S.C. 12291</ref>) from the other individual borrower;</content></item>
<item class="fontsize10" id="yee4b8bf1-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>has experienced economic abuse (as defined in section 40002 of the Violence Against Women Act of 1994 (<ref href="/us/usc/t34/s12291">34 U.S.C. 12291</ref>) from the other individual borrower; or</content></item>
<item class="fontsize10" id="yee4b8bf2-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>is unable to reasonably reach or access the loan information of the other individual borrower; or</content></item>
</subclause>
<subclause class="fontsize10" id="yee4b8bf3-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xee4b8bf4-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the Secretary determines that authorizing each individual borrower to apply separately under <page identifier="/us/stat/136/2221">136 STAT. 2221</page>
subparagraph (A) would be in the best fiscal interests of the Federal Government.</content></subclause>
</clause>
<clause class="fontsize10" id="yee4b8bf5-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Remaining obligation from separate application</inline>.—</heading><content>In the case of an individual borrower who receives a separate consolidation loan due to the circumstances described in clause (ii), the other non-applying individual borrower shall become solely liable for the remaining balance of the joint consolidation loan.”</content></clause>

<subsection class="firstIndent0 fontsize10" id="yee4b8bf6-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/200/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><chapeau>Section 428C(a)(3)(B)(i)(V) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1078–3/3/B/i/V">20 U.S.C. 1078–3(3)(B)(i)(V)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yee4b8bf7-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/200/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>or</quotedText>” at the end of item (bb);</content></paragraph>
<paragraph class="fontsize10" id="yee4b8bf8-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/200/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> the period at the end of item (cc) and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; or</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yee4b8bf9-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/200/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><item class="indentUp4 fontsize10" id="yee4bb30a-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="dd">“(dd) </num><content>for the purpose of separating a joint consolidation loan into 2 separate Federal Direct Consolidation Loans under section 455(g)(2).”</content></item>
