<section id="d71619e94" identifier="/us/pl/117/178/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Civilian Reservist Emergency Workforce Act of 2021</shortTitle>” or the “<shortTitle role="act">CREW Act</shortTitle>”.</content></section>
<section id="d71619e107" identifier="/us/pl/117/178/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PERSONNEL PERFORMING SERVICE RESPONDING TO PRESIDENTIALLY DECLARED MAJOR DISASTERS AND EMERGENCIES.</heading><content class="firstIndent0 fontsize10" id="xe283afca-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 306 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5149">42 U.S.C. 5149</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="ye283d6db-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Personnel Performing Service Responding to Disasters and Emergencies</inline>.—</heading><paragraph class="fontsize10" id="ye283d6dc-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">USERRA employment and reemployment rights</inline>.—</heading><content>The protections,<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe283d6dd-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote> rights, benefits, and obligations provided under <ref href="/us/usc/t38/ch43">chapter 43 of title 38, United States Code</ref>, shall apply to intermittent personnel appointed pursuant to subsection (b)(1) to perform service to the Federal Emergency Management Agency under sections 401 and 501 or to train for such service.</content></paragraph>
<paragraph class="fontsize10" id="ye283d6de-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Notice of absence from position of employment</inline>.—</heading><content>Preclusion of giving notice of service by necessity of service under subsection (b)(1) to perform service to the Federal Emergency Management Agency under sections 401 and 501 or to train for such service shall be considered preclusion by ‘military necessity’ for purposes of <ref href="/us/usc/t38/s4312/b">section 4312(b) of title 38, United States Code</ref>, pertaining to giving notice of absence from a position of employment.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe283d6df-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote> A determination of such necessity shall be made by the Administrator and shall not be subject to review in any judicial or administrative proceeding.”</content></paragraph>

<section id="d71619e168" identifier="/us/pl/117/178/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>EXTENSION OF CERTAIN EMPLOYMENT AND REEMPLOYMENT RIGHTS TO FEMA RESERVISTS.</heading><subsection class="firstIndent0 fontsize10" id="ye2842500-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t38/s4303">Section 4303 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ye2842501-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (13), by <amendingAction type="insert">inserting</amendingAction> before “<quotedText>, and a period</quotedText>” the following: “<quotedText>, a period for which a person is absent from a position of employment due to an appointment into service in the Federal Emergency Management Agency as intermittent personnel under section 306(b)(1) of the Robert T. Stafford <page identifier="/us/stat/136/2111">136 STAT. 2111</page>
Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5149/b/1">42 U.S.C. 5149(b)(1)</ref>)</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="ye2844c12-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> the second paragraph (16) (relating to uniformed services) as paragraph (17); and</content></paragraph>
<paragraph class="fontsize10" id="ye2844c13-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in paragraph (17), as so redesignated, by <amendingAction type="insert">inserting</amendingAction> before “<quotedText>and any other category</quotedText>” the following: “<quotedText>intermittent personnel who are appointed into Federal Emergency Management Agency service under section 306(b)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5149/b/1">42 U.S.C. 5149(b)(1)</ref>) or to train for such service,</quotedText>”.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ye2844c14-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Modification of Exception for Requirement for Members of Uniformed Services to Provide Notice to Employers to Obtain Certain Employment and Reemployment Rights</inline>.—</heading><chapeau><ref href="/us/usc/t38/s4312/b">Section 4312(b) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ye2844c15-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> the second sentence;</content></paragraph>
<paragraph class="fontsize10" id="ye2844c16-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(1)</quotedText>” before “<quotedText>No notice</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ye2844c17-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/178/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentDown1 firstIndent0 fontsize10" id="ye2844c18-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe2844c19-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><chapeau>A determination of military necessity for purposes of paragraph (1) shall be made—</chapeau><subparagraph class="fontsize10" id="ye2844c1a-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>except as provided in subparagraphs (B) and (C), pursuant to regulations prescribed by the Secretary of Defense;</content></subparagraph>
<subparagraph class="fontsize10" id="ye2844c1b-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>for persons performing service to the Federal Emergency Management Agency under section 327 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5165f">42 U.S.C. 5165f</ref>) and as intermittent personnel under section 306(b)(1) of such Act (<ref href="/us/usc/t42/s5149/b/1">42 U.S.C. 5149(b)(1)</ref>), by the Administrator of the Federal Emergency Management Agency as described in sections 327(j)(2) and 306(d)(2) of such Act (<ref href="/us/usc/t42/s5165f/j/2">42 U.S.C. 5165f(j)(2)</ref> and 5149(d)(2)), respectively; or</content></subparagraph>
<subparagraph class="fontsize10" id="ye2844c1c-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>for intermittent disaster-response appointees of the National Disaster Medical System, by the Secretary of Health and Human Services as described in section 2812(d)(3)(B) of the Public Health Service Act (<ref href="/us/usc/t42/s300hh–11/d/3/B">42 U.S.C. 300hh–11(d)(3)(B)</ref>).</content></subparagraph>
</paragraph>
<paragraph class="indentDown1 firstIndent0 fontsize10" id="ye2844c1d-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>A determination of military necessity under paragraph (1) shall not be subject to judicial review.”</content></paragraph>
