<section id="d122968e88" identifier="/us/pl/117/166/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4d063a20-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s631">15 USC 631 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">PPP and Bank Fraud Enforcement Harmonization Act of 2022</shortTitle>”.</content></section>
<section id="d122968e103" identifier="/us/pl/117/166/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4d063a21-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading>FRAUD ENFORCEMENT HARMONIZATION.</heading><subsection class="firstIndent0 fontsize10" id="y4d066132-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/166/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Paycheck Protection Program</inline>.—</heading><content>Section 7(a)(36) of the Small Business Act (<ref href="/us/usc/t15/s636/a/36">15 U.S.C. 636(a)(36)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="indentUp2 fontsize10" id="y4d066133-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="W">“(W) </num><heading class="fontsize10"><inline class="smallCaps">Fraud enforcement harmonization</inline>.—</heading><content>Notwithstanding any other provision of law, any criminal charge or civil enforcement action alleging that a borrower engaged in fraud with respect to a covered loan guaranteed under this paragraph shall be filed not later than 10 years after the offense was committed.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y4d066134-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/166/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Paycheck Protection Program Second Draw Loans</inline>.—</heading><content>Section 7(a)(37) of the Small Business Act (<ref href="/us/usc/t15/s636/a/37">15 U.S.C. 636(a)(37)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="indentUp2 fontsize10" id="y4d066135-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="P">“(P) </num><heading class="fontsize10"><inline class="smallCaps">Fraud enforcement harmonization</inline>.—</heading><content>Notwithstanding any other provision of law, any criminal charge or civil enforcement action alleging that a borrower engaged in fraud with respect to a covered loan guaranteed under this paragraph shall be filed not later than 10 years after the offense was committed.”</content></subparagraph>
