<section id="d123118e102" identifier="/us/pl/117/164/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832194e-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Homicide Victims’ Families’ Rights Act of 2021</shortTitle>”.</content></section>
<section id="d123118e117" identifier="/us/pl/117/164/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832194f-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60901">34 USC 60901</ref>.</p></sidenote><heading>CASE FILE REVIEW.</heading><subsection class="firstIndent0 fontsize10" id="y6832b590-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b591-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The head of an agency shall review the case file regarding a cold case murder upon written application by one designated person to determine if a full reinvestigation would result in either the identification of probative investigative leads or a likely perpetrator.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6832b592-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Review</inline>.—</heading><chapeau>The review under subsection (a) shall include—</chapeau><paragraph class="fontsize10" id="y6832b593-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b594-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>an analysis of what investigative steps or follow-up steps may have been missed in the initial investigation;</content></paragraph>
<paragraph class="fontsize10" id="y6832b595-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b596-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>an assessment of whether witnesses should be interviewed or reinterviewed;</content></paragraph>
<paragraph class="fontsize10" id="y6832b597-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b598-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Examination.</p></sidenote><content>an examination of physical evidence to see if all appropriate forensic testing and analysis was performed in the first instance or if additional testing might produce information relevant to the investigation; and</content></paragraph>
<paragraph class="fontsize10" id="y6832b599-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b59a-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Update.</p></sidenote><content>an update of the case file using the most current investigative standards as of the date of the review to the extent it would help develop probative leads.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6832b59b-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Certification in Lieu of Review</inline>.—</heading><content>In any case in which a written application for review has been received under this Act by the agency, review shall be unnecessary where the case does not satisfy the criteria for a cold case murder.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b59c-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Records.</p></sidenote> In such a case, the head of the agency shall issue a written certification, with a copy provided to the designated person that made the application under subsection (a), stating that final review is not necessary because all probative investigative leads have been exhausted or that a likely perpetrator will not be identified.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6832b59d-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Reviewer</inline>.—</heading><content>A review required under subsection (a) shall not be conducted by a person who previously investigated the murder at issue.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6832b59e-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Acknowledgment</inline>.—</heading><chapeau>The agency shall provide in writing to the applicant as soon as reasonably possible—</chapeau><paragraph class="fontsize10" id="y6832b59f-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>confirmation of the agency’s receipt of the application under subsection (a); and</content></paragraph>
<paragraph class="fontsize10" id="y6832b5a0-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b5a1-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notice.</p></sidenote><content>notice of the applicant’s rights under this Act.<page identifier="/us/stat/136/1359">136 STAT. 1359</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6832b5a2-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on Multiple Concurrent Reviews</inline>.—</heading><content>Only one case review shall be undertaken at any one time with respect to the same cold case murder victim.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6832b5a3-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b5a4-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Time Limit</inline>.—</heading><content>Not later than 6 months after the receipt of the written application submitted pursuant to subsection (a), the agency shall conclude its case file review and reach a conclusion about whether or not a full reinvestigation under section 4 is warranted.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6832b5a5-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Extensions</inline>.—</heading><paragraph class="fontsize10" id="y6832b5a6-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/h/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b5a7-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The agency may extend the time limit under subsection (g) once for a period of time not to exceed 6 months if the agency makes a finding that the number of case files to be reviewed make it impracticable to comply with such limit without unreasonably taking resources from other law enforcement activities.</content></paragraph>
<paragraph class="fontsize10" id="y6832b5a8-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s2/h/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b5a9-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notice.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Actions subsequent to waiver</inline>.—</heading><content>For cases for which the time limit in subsection (g) is extended, the agency shall provide notice and an explanation of its reasoning to one designated person who filed the written application pursuant to this section.</content></paragraph>

<section id="d123118e282" identifier="/us/pl/117/164/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b5aa-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60902">34 USC 60902</ref>.</p></sidenote><heading>APPLICATION.</heading><content style="-uslm-lc:I658120">  Each agency shall develop a written application to be used for designated persons to request a case file review under section 2.</content></section>
<section id="d123118e295" identifier="/us/pl/117/164/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6832b5ab-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60903">34 USC 60903</ref>.</p></sidenote><heading>FULL REINVESTIGATION.</heading><subsection class="firstIndent0 fontsize10" id="y6832dcbc-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The agency shall conduct a full reinvestigation of the cold case murder at issue if the review of the case file required by section 2 concludes that a full reinvestigation of such cold case murder would result in probative investigative leads.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y683303cd-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x683303ce-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analyses.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reinvestigation</inline>.—</heading><content>A full reinvestigation shall include analyzing all evidence regarding the cold case murder at issue for the purpose of developing probative investigative leads or a likely perpetrator.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y683303cf-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Reviewer</inline>.—</heading><content>A reinvestigation required under subsection (a) shall not be conducted by a person who previously investigated the murder at issue.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y683303d0-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on Multiple Concurrent Reviews</inline>.—</heading><content>Only one full reinvestigation shall be undertaken at any one time with respect to the same cold case murder victim.</content></subsection>

<section id="d123118e344" identifier="/us/pl/117/164/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x683303d1-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60904">34 USC 60904</ref>.</p></sidenote><heading>CONSULTATION AND UPDATES.</heading><subsection class="firstIndent0 fontsize10" id="y683303d2-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The agency shall consult with the designated person who filed the written application pursuant to section 2 and provide him or her with periodic updates during the case file review and full reinvestigation.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y683303d3-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Explanation of Conclusion</inline>.—</heading><content>The agency shall meet with the designated person and discuss the evidence to explain to the designated person who filed the written application pursuant to section 2 its decision whether or not to engage in the full reinvestigation provided for under section 4 at the conclusion of the case file review.</content></subsection>

<section id="d123118e372" identifier="/us/pl/117/164/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x683303d4-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p><p class="leftAlign firstIndent0 fontsize8" id="x683303d5-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60905">34 USC 60905</ref>.</p></sidenote><heading>SUBSEQUENT REVIEWS.</heading><subsection class="firstIndent0 fontsize10" id="y68332ae6-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Case File Review</inline>.—</heading><content>If a review under subsection (a) case file regarding a cold case murder is conducted and a conclusion is reached not to conduct a full reinvestigation, no additional case <page identifier="/us/stat/136/1360">136 STAT. 1360</page>
file review shall be required to be undertaken under this Act with respect to that cold case murder for a period of five years, unless there is newly discovered, materially significant evidence. An agency may continue an investigation absent a designated person’s application.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y68332ae7-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Full Reinvestigation</inline>.—</heading><content>If a full reinvestigation of a cold case murder is completed and a suspect is not identified at its conclusion, no additional case file review or full reinvestigation shall be undertaken with regard to that cold case murder for a period of five years beginning on the date of the conclusion of the reinvestigation, unless there is newly discovered, materially significant evidence.</content></subsection>

<section id="d123118e406" identifier="/us/pl/117/164/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x68332ae8-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60906">34 USC 60906</ref>.</p></sidenote><heading>DATA COLLECTION.</heading><subsection class="firstIndent0 fontsize10" id="y683351f9-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x683351fa-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="x683351fb-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Publication.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Beginning on the date that is three years after the date of enactment of this Act, and annually thereafter, the Director of the National Institute of Justice shall publish statistics on the number of cold case murders.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y683351fc-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Manner of Publication</inline>.—</heading><content>The statistics published pursuant to subsection (a) shall, at a minimum, be disaggregated by the circumstances of the cold case murder, including the classification of the offense, and by agency.</content></subsection>

<section id="d123118e439" identifier="/us/pl/117/164/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x683351fd-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60907">34 USC 60907</ref>.</p></sidenote><heading>PROCEDURES TO PROMOTE COMPLIANCE.</heading><subsection class="firstIndent0 fontsize10" id="y6833a01e-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s8/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833a01f-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><content>Not later than one year after the date of enactment of this Act, the head of each agency shall promulgate regulations to enforce the right of a designated person to request a review under this Act and to ensure compliance by the agency with the obligations described in this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6833a020-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Procedures</inline>.—</heading><chapeau>The regulations promulgated under subsection (a) shall—</chapeau><paragraph class="fontsize10" id="y6833a021-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s8/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833a022-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Designation.</p></sidenote><content>designate an administrative authority within the agency to receive and investigate complaints relating to a review initiated under section 2 or a reinvestigation initiated under section 4;</content></paragraph>
<paragraph class="fontsize10" id="y6833a023-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s8/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833a024-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirement.</p></sidenote><content>require a course of training for appropriate employees and officers within the agency regarding the procedures, responsibilities, and obligations required under this Act;</content></paragraph>
<paragraph class="fontsize10" id="y6833a025-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s8/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>contain disciplinary sanctions, which may include suspension or termination from employment, for employees of the agency who are shown to have willfully or wantonly failed to comply with this Act;</content></paragraph>
<paragraph class="fontsize10" id="y6833a026-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s8/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>provide a procedure for the resolution of complaints filed by the designated person concerning the agency’s handling of a cold case murder investigation or the case file evaluation; and</content></paragraph>
<paragraph class="fontsize10" id="y6833a027-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s8/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>provide that the head of the agency, or the designee thereof, shall be the final arbiter of the complaint, and that there shall be no judicial review of the final decision of the head of the agency by a complainant.</content></paragraph>

<section id="d123118e502" identifier="/us/pl/117/164/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833a028-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60908">34 USC 60908</ref>.</p></sidenote><heading>WITHHOLDING INFORMATION.</heading><content class="firstIndent0 fontsize10" id="x6833a029-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Nothing in this Act shall require an agency to provide information that would endanger the safety of any person, unreasonably impede an ongoing investigation, violate a court order, or violate legal obligations regarding privacy.<?I13?><page identifier="/us/stat/136/1361">136 STAT. 1361</page></content></section>
<section id="d123118e519" identifier="/us/pl/117/164/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833a02a-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60909">34 USC 60909</ref>.</p></sidenote><heading>MULTIPLE AGENCIES.</heading><content style="-uslm-lc:I658120">  <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833c73b-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Coordination.</p></sidenote>In the case that more than one agency conducted the initial investigation of a cold case murder, each agency shall coordinate their case file review or full reinvestigation such that there is only one joint case file review or full reinvestigation occurring at a time in compliance with section 2(f) or 4(d), as applicable.</content></section>
<section id="d123118e535" identifier="/us/pl/117/164/s11" style="-uslm-lc:I658142"><num class="fontsize12" value="11">SEC. 11. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833c73c-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60910">34 USC 60910</ref>.</p></sidenote><heading>APPLICABILITY.</heading><content style="-uslm-lc:I658120">  This Act applies in the case of any cold case murder occurring on or after January 1, 1970.</content></section>
<section id="d123118e547" identifier="/us/pl/117/164/s12" style="-uslm-lc:I658142"><num class="fontsize12" value="12">SEC. 12. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6833c73d-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60911">34 USC 60911</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6834155e-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y6834155f-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The term “<term>designated person</term>” means an immediate family member or someone similarly situated, as defined by the Attorney General.</content></paragraph>
<paragraph class="fontsize10" id="y68341560-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The term “<term>immediate family member</term>” means a parent, parent-in-law, grandparent, grandparent-in-law, sibling, spouse, child, or step-child of a murder victim.</content></paragraph>
<paragraph class="fontsize10" id="y68341561-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The term “<term>victim</term>” means a natural person who died as a result of a cold case murder.</content></paragraph>
<paragraph class="fontsize10" id="y68341562-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The term “<term>murder</term>” means any criminal offense under <ref href="/us/usc/t18/s1111/a">section 1111(a) of title 18, United States Code</ref>, or any offense the elements of which are substantially identical to such section.</content></paragraph>
<paragraph class="fontsize10" id="y68341563-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>The term “<term>agency</term>” means a Federal law enforcement entity with jurisdiction to engage in the detection, investigation, or prosecution of a cold case murder.</content></paragraph>
<paragraph class="fontsize10" id="y68341564-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><chapeau>The term “<term>cold case murder</term>” means a murder—</chapeau><subparagraph class="fontsize10" id="y68341565-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>committed more than three years prior to the date of an application by a designated person under section 2(a);</content></subparagraph>
<subparagraph class="fontsize10" id="y68341566-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>previously investigated by a Federal law enforcement entity;</content></subparagraph>
<subparagraph class="fontsize10" id="y68341567-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/6/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>for which all probative investigative leads have been exhausted; and</content></subparagraph>
<subparagraph class="fontsize10" id="y68341568-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s12/6/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>for which no likely perpetrator has been identified.</content></subparagraph>

<section id="d123118e614" identifier="/us/pl/117/164/s13" style="-uslm-lc:I658142"><num class="fontsize12" value="13">SEC. 13. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x68341569-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s60912">34 USC 60912</ref>.</p></sidenote><heading>ANNUAL REPORT.</heading><subsection class="firstIndent0 fontsize10" id="y68343c7a-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s13/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Each agency shall submit an annual report to the Committees on the Judiciary of the House of Representatives and of the Senate describing actions taken and results achieved under this Act during the previous year.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6834638b-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s13/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report Described</inline>.—</heading><chapeau>The report described in subsection (a) shall include—</chapeau><paragraph class="fontsize10" id="y6834638c-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s13/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the number of written applications filed with the agency pursuant to section 2(a);</content></paragraph>
<paragraph class="fontsize10" id="y6834638d-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s13/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the number of extensions granted, and an explanation of reasons provided under section 2(h);</content></paragraph>
<paragraph class="fontsize10" id="y6834638e-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s13/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the number of full reinvestigations initiated and closed pursuant to section 4; and</content></paragraph>
<paragraph class="fontsize10" id="y6834638f-e81b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/164/s13/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x68346390-e81b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Data.</p></sidenote><content>statistics and individualized information on topics that include identified suspects, arrests, charges, and convictions <page identifier="/us/stat/136/1362">136 STAT. 1362</page>
