<section id="d82924e102" identifier="/us/pl/117/121/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009907e7-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s701">15 USC 701 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">American Fisheries Advisory Committee Act</shortTitle>”.</content></section>
<section id="d82924e117" identifier="/us/pl/117/121/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AMERICAN FISHERIES ADVISORY COMMITTEE.</heading><subsection class="firstIndent0 fontsize10" id="y0099a428-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/121/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><chapeau>Section 2 of the Act of August 11, 1939 (<ref href="/us/usc/t15/s713c–3">15 U.S.C. 713c–3</ref>), <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y0099a429-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/121/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (e) as subsection (f); and</content></paragraph>
<paragraph class="fontsize10" id="y0099a42a-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/121/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (d) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y009ab59b-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">American Fisheries Advisory Committee</inline>.—</heading><paragraph class="fontsize10" id="y009ab59c-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="y009ab59d-e81d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Committee</inline>.—</heading><content>The term ‘<term>Committee</term>’ means the American Fisheries Advisory Committee established under paragraph (2).</content></subparagraph>
<subparagraph class="fontsize10" id="y009ab59e-e81d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Fishing community</inline>.—</heading><content>The term ‘<term>fishing community</term>’ means harvesters, marketers, growers, processors, recreational fishermen, charter fishermen, and persons providing them with goods and services.</content></subparagraph>
<subparagraph class="fontsize10" id="y009ab59f-e81d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Marketing and promotion</inline>.—</heading><content>The term ‘<term>marketing and promotion</term>’ means an activity aimed at encouraging the consumption of seafood or expanding or maintaining commercial markets for seafood.</content></subparagraph>
<subparagraph class="fontsize10" id="y009ab5a0-e81d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Processor</inline>.—</heading><content>The term ‘<term>processor</term>’ means any person in the business of preparing or packaging seafood (including seafood of the processor’s own harvesting) for sale.</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcb1-e81d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Seafood</inline>.—</heading><content>The term ‘<term>seafood</term>’ means farm-raised and wild-caught fish, shellfish, or marine algae harvested in the United States or by a United States flagged vessel for human consumption.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y009adcb2-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adcb3-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x009adcb4-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Regions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><chapeau>Not later than 90 days after the date of the enactment of the American Fisheries Advisory Committee Act, the Secretary shall establish 6 regions within the American Fisheries Advisory Committee as follows:</chapeau><subparagraph class="fontsize10" id="y009adcb5-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Region 1 shall consist of Alaska, Hawaii, the Commonwealth of the Northern Mariana Islands, and the Territories of Guam and American Samoa.</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcb6-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Region 2 shall consist of Maine, New Hampshire, Massachusetts, Rhode Island, and Connecticut.<page identifier="/us/stat/131/1189">131 STAT. 1189</page></content></subparagraph>
<subparagraph class="fontsize10" id="y009adcb7-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Region 3 shall consist of Texas, Alabama, Louisiana, Mississippi, Florida, Arkansas, Puerto Rico, and the Territory of the Virgin Islands of the United States.</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcb8-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>Region 4 shall consist of California, Washington, Oregon, and Idaho.</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcb9-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>Region 5 shall consist of New Jersey, New York, Delaware, Maryland, Virginia, North Carolina, South Carolina, and Georgia.</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcba-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>Region 6 shall consist of Michigan, Minnesota, Wisconsin, Illinois, Indiana, Ohio, and Pennsylvania.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y009adcbb-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>The Committee shall be composed of the following members:</chapeau><subparagraph class="fontsize10" id="y009adcbc-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Regional representation</inline>.—</heading><chapeau>Each of the regions listed in subparagraphs (A) through (F) of paragraph (2) shall be represented on the Committee by 3 members—</chapeau><clause class="fontsize10" id="y009adcbd-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adcbe-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Appointments.</p></sidenote><content>who are appointed by the Secretary;</content></clause>
<clause class="fontsize10" id="y009adcbf-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>who reside in a State or territory in the region that the member will represent;</content></clause>
<clause class="fontsize10" id="y009adcc0-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>of which—</chapeau><subclause class="fontsize10" id="y009adcc1-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>one shall have experience as a seafood harvester or processor;</content></subclause>
<subclause class="fontsize10" id="y009adcc2-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>one shall have experience as recreational or commercial fisher or have experience growing seafood; and</content></subclause>
<subclause class="fontsize10" id="y009adcc3-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>one shall be an individual who represents the fisheries science community or the relevant Regional Fishery Management Council; and</content></subclause>
</clause>
<clause class="fontsize10" id="y009adcc4-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>that are selected so that the members of the Committee have experience or expertise with as many seafood species as practicable.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y009adcc5-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adcc6-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Appointments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">At-large members</inline>.—</heading><chapeau>The Secretary shall appoint to the Committee at-large members as follows:</chapeau><clause class="fontsize10" id="y009adcc7-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>One individual with experience in food distribution, marketing, retail, or food service.</content></clause>
<clause class="fontsize10" id="y009adcc8-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>One individual with experience in the recreational fishing industry supply chain, such as fishermen, manufacturers, retailers, and distributors.</content></clause>
<clause class="fontsize10" id="y009adcc9-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>One individual with experience in the commercial fishing industry supply chain, such as fishermen, manufacturers, retailers, and distributors.</content></clause>
<clause class="fontsize10" id="y009adcca-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>One individual who is an employee of the National Marine Fisheries Service with expertise in fisheries research.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y009adccb-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Balanced representation</inline>.—</heading><content>In selecting the members described in subparagraphs (A) and (B), the Secretary shall seek to maximize on the Committee, to the extent practicable, a balanced representation of expertise in United States fisheries, seafood production, and science.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y009adccc-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Member terms</inline>.—</heading><content>The term for a member of the Committee shall be 3 years, except that the Secretary shall designate staggered terms for the members initially appointed to the Committee.</content></paragraph>
<paragraph class="fontsize10" id="y009adccd-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Responsibilities</inline>.—</heading><chapeau>The Committee shall be responsible for—</chapeau><subparagraph class="fontsize10" id="y009adcce-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>identifying needs of the fishing community that may be addressed by a project funded with a grant under subsection (c);<page identifier="/us/stat/131/1190">131 STAT. 1190</page></content></subparagraph>
<subparagraph class="fontsize10" id="y009adccf-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>developing the request for proposals for such grants;</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcd0-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>reviewing applications for such grants; and</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcd1-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>selecting applications for approval under subsection (c)(2)(B).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y009adcd2-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Chair</inline>.—</heading><content>The Committee shall elect a chair by a majority of those voting, if a quorum is present.</content></paragraph>
<paragraph class="fontsize10" id="y009adcd3-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Quorum</inline>.—</heading><content>A simple majority of members of the Committee shall constitute a quorum, but a lesser number may hold hearings.</content></paragraph>
<paragraph class="fontsize10" id="y009adcd4-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><subparagraph class="fontsize10" id="y009adcd5-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Frequency</inline>.—</heading><content>The Committee shall meet not more than 2 times each year.</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcd6-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Location</inline>.—</heading><content>The meetings of the Committee shall rotate between the geographic regions described under paragraph (2).</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcd7-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Minimizing costs</inline>.—</heading><content>The Committee shall seek to minimize the operational costs associated with meetings, hearings, or other business of the Committee, including through the use of video or teleconference.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y009adcd8-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Designation of staff member</inline>.—</heading><content>The Secretary shall designate a staff member to coordinate the activities of the Committee and to assist with administrative and other functions as requested by the Committee.</content></paragraph>
<paragraph class="fontsize10" id="y009adcd9-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adcda-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reimbursements.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Per diem and expenses and funding</inline>.—</heading><subparagraph class="fontsize10" id="y009adcdb-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A member of the Committee shall serve without compensation, but shall be reimbursed in accordance with <ref href="/us/usc/t5/s5703">section 5703 of title 5, United States Code</ref>, for reasonable travel costs and expenses incurred in performing duties as a member of the Committee.</content></subparagraph>
<subparagraph class="fontsize10" id="y009adcdc-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><content>The costs of reimbursements under subparagraph (A) and the other costs associated with the Committee shall be paid from funds made available to carry out this section (which may include funds described in subsection (f)(1)(B)), except that no funds allocated for grants under subsection (f)(1)(A) shall be expended for any purpose under this subsection.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y009adcdd-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adcde-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability. </p></sidenote><heading class="fontsize10"><inline class="smallCaps">Conflict of interest</inline>.—</heading><content>The conflict of interest and recusal provisions set out in section 302(j) of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1852/j">16 U.S.C. 1852(j)</ref>) shall apply to any decision by the Committee and to all members of the Committee as if each member of the Committee is an affected individual within the meaning of such section 302(j), except that in addition to the disclosure requirements of section 302(j)(2)(C) of such Act (<ref href="/us/usc/t16/s1852/j/2/C">16 U.S.C. 1852(j)(2)(C)</ref>), each member of the Committee shall disclose any financial interest or relationship in an organization or with an individual that is applying for a grant under subsection (c) held by the member of the Committee, including an interest as an officer, director, trustee, partner, employee, contractor, agent, or other representative.</content></paragraph>
<paragraph class="fontsize10" id="y009adcdf-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><heading class="fontsize10"><inline class="smallCaps">Technical review of applications</inline>.—</heading><subparagraph class="fontsize10" id="y009adce0-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adce1-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Prior to review of an application for a grant under subsection (c) by the Committee, the Secretary shall obtain an independent written technical evaluation from 3 or more appropriate Federal, private, <page identifier="/us/stat/131/1191">131 STAT. 1191</page>
or public sector experts (such as industry, academia, or governmental experts) who—</chapeau><clause class="fontsize10" id="y009adce2-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>have subject matter expertise to determine the technical merit of the proposal in the application;</content></clause>
<clause class="fontsize10" id="y009adce3-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>shall independently evaluate each such proposal; and</content></clause>
<clause class="fontsize10" id="y009adce4-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adce5-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><content>shall certify that the expert does not have a conflict of interest concerning the application that the expert is reviewing.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y009adce6-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adce7-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote>—</heading><content>Not later than 180 days after the date of enactment of the American Fisheries Advisory Committee Act, the Secretary shall issue guidance related to carrying out the technical evaluations under subparagraph (A).<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009adce8-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Criteria.</p></sidenote> Such guidance shall include criteria for the elimination by the National Oceanic and Atmospheric Administration of applications that fail to meet a minimum level of technical merit as determined by the review described in subparagraph (A).”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y009adce9-e81d-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/121/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Role in Approval of Grants</inline>.—</heading><content>Section 2(c)(3) of the Act of August 11, 1939 (<ref href="/us/usc/t15/s713c–3/c/3">15 U.S.C. 713c–3(c)(3)</ref>), <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><paragraph class="indentUp0 firstIndent0 fontsize10" id="y009b2b0a-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3)</num><subparagraph class="inline" id="y009b2b0b-e81d-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><chapeau>No application for a grant under this subsection may be approved unless the Secretary—</chapeau><clause class="fontsize10" id="y009b2b0c-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is satisfied that the applicant has the requisite technical and financial capability to carry out the project; and</content></clause>
<clause class="fontsize10" id="y009b2b0d-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x009b2b0e-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x009b2b0f-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p><p class="leftAlign firstIndent0 fontsize8" id="x009b2b10-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><chapeau>based on the recommendations of the American Fisheries Advisory Committee established in subsection (e), evaluates the proposed project as to—</chapeau><subclause class="fontsize10" id="y009b2b11-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>soundness of design;</content></subclause>
<subclause class="fontsize10" id="y009b2b12-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the possibilities of securing productive results;</content></subclause>
<subclause class="fontsize10" id="y009b2b13-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>minimization of duplication with other fisheries research and development projects;</content></subclause>
<subclause class="fontsize10" id="y009b2b14-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>the organization and management of the project;</content></subclause>
<subclause class="fontsize10" id="y009b2b15-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>methods proposed for monitoring and evaluating the success or failure of the project; and</content></subclause>
<subclause class="fontsize10" id="y009b2b16-e81d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">“(VI) </num><content>such other criteria as the Secretary may require.</content></subclause>
