<section id="d152448e92" identifier="/us/pl/115/261/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Marrakesh Treaty Implementation Act</shortTitle>”.</content></section>
<section id="d152448e102" identifier="/us/pl/115/261/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IMPLEMENTATION AMENDMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y0a6272fe-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t17/ch1">Chapter 1 of title 17, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y0a6272ff-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in section 121—</chapeau><subparagraph class="fontsize10" id="y0a627300-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in subsection (a)—</chapeau><clause class="fontsize10" id="y0a627301-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>in the United States</quotedText>” after “<quotedText>distribute</quotedText>”;</content></clause>

<clause class="fontsize10" id="y0a627311-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a/1/D/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0a627312-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definitions.</p></sidenote><content>by <amendingAction type="insert">inserting</amendingAction> before paragraph (2), as so redesignated, the following:<page identifier="/us/stat/132/3668">132 STAT. 3668</page>
<quotedContent><paragraph class="indentDown2 fontsize10" id="y0a627313-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>‘accessible format’ means an alternative manner or form that gives an eligible person access to the work when the copy or phonorecord in the accessible format is used exclusively by the eligible person to permit him or her to have access as feasibly and comfortably as a person without such disability as described in paragraph (3);”</content></paragraph>
</quotedContent>;</content></clause>
<clause class="fontsize10" id="y0a629a24-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a/1/D/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (2), as so redesignated, the following:<quotedContent><paragraph class="indentDown2 fontsize10" id="y0a629a25-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>‘eligible person’ means an individual who, regardless of any other disability—</chapeau><subparagraph class="fontsize10" id="y0a629a26-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is blind;</content></subparagraph>
<subparagraph class="fontsize10" id="y0a629a27-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>has a visual impairment or perceptual or reading disability that cannot be improved to give visual function substantially equivalent to that of a person who has no such impairment or disability and so is unable to read printed works to substantially the same degree as a person without an impairment or disability; or</content></subparagraph>
<subparagraph class="fontsize10" id="y0a629a28-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>is otherwise unable, through physical disability, to hold or manipulate a book or to focus or move the eyes to the extent that would be normally acceptable for reading; and”</content></subparagraph>
</paragraph>
</quotedContent>; and</content></clause>
<clause class="fontsize10" id="y0a629a29-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a/1/D/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>in paragraph (4), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” at the end and <amendingAction type="insert">inserting</amendingAction> a period; and</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0a629a2a-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/261/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after section 121 the following:<quotedContent><section class="centered fontsize12" id="y0a630f5b-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658164"><num class="fontsize12" value="121A">“§ 121A.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0a630f5c-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t17/s121A">17 USC 121A</ref>.</p></sidenote> Limitations on exclusive rights: reproduction for blind or other people with disabilities in Marrakesh Treaty countries</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y0a630f5d-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><chapeau>Notwithstanding the provisions of sections 106 and 602, it is not an infringement of copyright for an authorized entity, acting pursuant to this section, to export copies or phonorecords of a previously published literary work or of a previously published musical work that has been fixed in the form of text or notation in accessible formats to another country when the exportation is made either to—</chapeau><paragraph class="fontsize10" id="y0a630f5e-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>an authorized entity located in a country that is a Party to the Marrakesh Treaty; or</content></paragraph>
<paragraph class="fontsize10" id="y0a630f5f-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>an eligible person in a country that is a Party to the Marrakesh Treaty,</content></paragraph>
<continuation class="fontsize10" id="x0a630f60-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">if prior to the exportation of such copies or phonorecords, the authorized entity engaged in the exportation did not know or have reasonable grounds to know that the copies or phonorecords would be used other than by eligible persons.</continuation></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y0a630f61-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><content>Notwithstanding the provisions of sections 106 and 602, it is not an infringement of copyright for an authorized entity or an eligible person, or someone acting on behalf of an eligible person, acting pursuant to this section, to import copies or phonorecords of a previously published literary work or of a previously published musical work that has been fixed in the form of text or notation in accessible formats.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y0a630f62-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><chapeau>In conducting activities under subsection (a) or (b), an authorized entity shall establish and follow its own practices, in keeping with its particular circumstances, to—</chapeau><paragraph class="fontsize10" id="y0a630f63-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>establish that the persons the authorized entity serves are eligible persons;<page identifier="/us/stat/132/3669">132 STAT. 3669</page></content></paragraph>
<paragraph class="fontsize10" id="y0a630f64-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>limit to eligible persons and authorized entities the distribution of accessible format copies by the authorized entity;</content></paragraph>
<paragraph class="fontsize10" id="y0a630f65-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>discourage the reproduction and distribution of unauthorized copies;</content></paragraph>
<paragraph class="fontsize10" id="y0a630f66-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>maintain due care in, and records of, the handling of copies of works by the authorized entity, while respecting the privacy of eligible persons on an equal basis with others; and</content></paragraph>
<paragraph class="fontsize10" id="y0a630f67-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0a630f68-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><chapeau>facilitate effective cross-border exchange of accessible format copies by making publicly available—</chapeau><subparagraph class="fontsize10" id="y0a630f69-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the titles of works for which the authorized entity has accessible format copies or phonorecords and the specific accessible formats in which they are available; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0a630f6a-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>information on the policies, practices, and authorized entity partners of the authorized entity for the cross-border exchange of accessible format copies.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y0a630f6b-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><chapeau>Nothing in this section shall be construed to establish—</chapeau><paragraph class="fontsize10" id="y0a630f6c-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>a cause of action under this title; or</content></paragraph>
<paragraph class="fontsize10" id="y0a630f6d-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>a basis for regulation by any Federal agency.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y0a630f6e-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><content>Nothing in this section shall be construed to limit the ability to engage in any activity otherwise permitted under this title.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y0a630f6f-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0a630f70-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definitions.</p></sidenote><chapeau>For purposes of this section—</chapeau><paragraph class="fontsize10" id="y0a630f71-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the terms ‘accessible format’, ‘authorized entity’, and ‘eligible person’ have the meanings given those terms in section 121; and</content></paragraph>
