<section id="d293999e339" identifier="/us/pl/115/246/tI/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92976024-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18601">42 USC 18601 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This title may be cited as the “<shortTitle role="title">Laboratory Modernization and Technology Transfer Act</shortTitle>”.</content></section>
<section id="d293999e354" identifier="/us/pl/115/246/tI/s102" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>INCLUSION OF EARLY STAGE TECHNOLOGY DEMONSTRATION IN AUTHORIZED TECHNOLOGY TRANSFER ACTIVITIES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x92978735-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1001 of the Energy Policy Act of 2005 (<ref href="/us/usc/t42/s16391">42 U.S.C. 16391</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y92978736-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s102/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (g) as subsection (h); and</content></paragraph>
<paragraph class="fontsize10" id="y92978737-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s102/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (f) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y92978738-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Early Stage Technology Demonstration</inline>.—</heading><content>The Secretary shall permit the directors of the National Laboratories to use funds authorized to support technology transfer within the Department to carry out early stage and precommercial technology demonstration activities to remove technology barriers that limit private sector interest and demonstrate potential commercial applications of any research and technologies arising from National Laboratory activities.”</content></subsection>

<section id="d293999e396" identifier="/us/pl/115/246/tI/s103" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92978739-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18611">42 USC 18611</ref>.</p></sidenote><heading>SENSE OF CONGRESS ON ACCELERATING ENERGY INNOVATION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x9297fc6a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y9297fc6b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>although important progress has been made in cost reduction and deployment of clean energy technologies, accelerating clean energy innovation will help meet critical competitiveness, energy security, and environmental goals;</content></paragraph>
<paragraph class="fontsize10" id="y9297fc6c-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>accelerating the pace of clean energy innovation in the United States calls for—</chapeau><subparagraph class="fontsize10" id="y9297fc6d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>supporting existing research and development programs at the Department and the world-class National Laboratories;</content></subparagraph>
<subparagraph class="fontsize10" id="y9297fc6e-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>exploring and developing new pathways for innovators, investors, and decision-makers to leverage the resources of the Department for addressing the challenges and comparative strengths of geographic regions; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9297fc6f-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>recognizing the financial constraints of the Department, regularly reviewing clean energy programs to ensure that taxpayer investments are maximized;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9297fc70-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the energy supply, demand, policies, markets, and resource options of the United States vary by geographic region;</content></paragraph>
<paragraph class="fontsize10" id="y9297fc71-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>a regional approach to innovation can bridge the gaps between local talent, institutions, and industries to identify opportunities and convert United States investment into domestic companies; and</content></paragraph>
<paragraph class="fontsize10" id="y9297fc72-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>Congress, the Secretary, and energy industry participants should advance efforts that promote international, <page identifier="/us/stat/132/3132">132 STAT. 3132</page>
domestic, and regional cooperation on the research and development of energy innovations that—</chapeau><subparagraph class="fontsize10" id="y9297fc73-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>provide clean, affordable, and reliable energy for everyone;</content></subparagraph>
<subparagraph class="fontsize10" id="y9297fc74-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>promote economic growth;</content></subparagraph>
<subparagraph class="fontsize10" id="y9297fc75-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>are critical for energy security; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9297fc76-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s103/5/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>are sustainable without government support.</content></subparagraph>

<section id="d293999e473" identifier="/us/pl/115/246/tI/s104" style="-uslm-lc:I658143"><num class="fontsize12" value="104">SEC. 104. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9297fc77-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18612">42 USC 18612</ref>.</p></sidenote><heading>RESTORATION OF LABORATORY DIRECTED RESEARCH AND DEVELOPMENT PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y9297fc78-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s104/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Except as provided in subsection (b), the Secretary shall ensure that laboratory operating contractors do not allocate costs of general and administrative overhead to laboratory directed research and development.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9297fc79-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s104/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Exception for National Security Laboratories</inline>.—</heading><content>This section shall not apply to the national security laboratories with respect to which section 3119 of the National Defense Authorization Act for Fiscal Year 2017 (<ref href="/us/pl/114/328">Public Law 114–328</ref>) applies.</content></subsection>

<section id="d293999e506" identifier="/us/pl/115/246/tI/s105" style="-uslm-lc:I658143"><num class="fontsize12" value="105">SEC. 105. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9298238a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18613">42 USC 18613</ref>.</p></sidenote><heading>RESEARCH GRANTS DATABASE.</heading><subsection class="firstIndent0 fontsize10" id="y9298238b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s105/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9298238c-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote>—</heading><content>The Secretary shall establish and maintain a public database, accessible on the website of the Department, that contains a searchable listing of each unclassified research and development project contract, grant, cooperative agreement, task order for a federally funded research and development center, or other transaction administered by the Department.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9298238d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s105/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><content>Each listing described in subsection (a) shall include, at a minimum, for each listed project, the Department office carrying out the project, the project name, an abstract or summary of the project, funding levels, project duration, contractor or grantee name (including the names of any subcontractors), and expected objectives and milestones.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9298238e-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s105/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Relevant Literature and Patents</inline>.—</heading><content>The Secretary shall provide information through the public database established under subsection (a) on relevant literature and patents that are associated with each research and development project contract, grant, or cooperative agreement, or other transaction, of the Department.</content></subsection>

<section id="d293999e547" identifier="/us/pl/115/246/tI/s106" style="-uslm-lc:I658143"><num class="fontsize12" value="106">SEC. 106. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92984a9f-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p><p class="leftAlign firstIndent0 fontsize8" id="x92984aa0-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x92984aa1-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p><p class="leftAlign firstIndent0 fontsize8" id="x92984aa2-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18614">42 USC 18614</ref>.</p></sidenote><heading>TECHNOLOGY TRANSFER AND TRANSITIONS ASSESSMENT.</heading><content style="-uslm-lc:I658120">  Not later than 1 year after the date of enactment of this Act, and as often as the Secretary determines to be necessary thereafter, the Secretary shall transmit to the appropriate committees of Congress a report that includes recommended changes to the policy of the Department and legislative changes to section 1001 of the Energy Policy Act of 2005 (<ref href="/us/usc/t42/s16391">42 U.S.C. 16391</ref>) to improve the ability of the Department to successfully transfer new energy technologies to the private sector.</content></section>
<section id="d293999e568" identifier="/us/pl/115/246/tI/s107" style="-uslm-lc:I658143"><num class="fontsize12" value="107">SEC. 107. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92984aa3-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18615">42 USC 18615</ref>.</p></sidenote><heading>AGREEMENTS FOR COMMERCIALIZING TECHNOLOGY PILOT PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y92990df4-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary shall carry out the Agreements for Commercializing Technology pilot program of the Department, as announced by the Secretary on December 8, 2011, in accordance with this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92990df5-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Terms</inline>.—</heading><content>Each agreement entered into pursuant to the pilot program referred to in subsection (a) shall provide to the contractor of the applicable National Laboratory, to the maximum extent determined to be appropriate by the Secretary, increased authority to <page identifier="/us/stat/132/3133">132 STAT. 3133</page>
negotiate contract terms, such as intellectual property rights, payment structures, performance guarantees, and multiparty collaborations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92990df6-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline>.—</heading><paragraph class="fontsize10" id="y92990df7-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Any director of a National Laboratory may enter into an agreement pursuant to the pilot program referred to in subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y92990df8-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Agreements with non-federal entities</inline>.—</heading><content>To carry out paragraph (1) and subject to paragraph (3), the Secretary shall permit the directors of the National Laboratories to execute agreements with a non-Federal entity, including a non-Federal entity already receiving Federal funding that will be used to support activities under agreements executed pursuant to paragraph (1), provided that such funding is solely used to carry out the purposes of the Federal award.</content></paragraph>
<paragraph class="fontsize10" id="y92990df9-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Restriction</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92990dfa-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote>.—</heading><chapeau>The requirements of <ref href="/us/usc/t35/ch18">chapter 18 of title 35, United States Code</ref> (commonly known as the “Bayh-Dole Act”) shall apply if—</chapeau><subparagraph class="fontsize10" id="y92990dfb-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the agreement is a funding agreement (as that term is defined in section 201 of that title); and</content></subparagraph>
<subparagraph class="fontsize10" id="y92990dfc-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>at least one of the parties to the funding agreement is eligible to receive rights under that chapter.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92990dfd-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Submission to Secretary</inline>.—</heading><chapeau>Each affected director of a National Laboratory shall submit to the Secretary, with respect to each agreement entered into under this section—</chapeau><paragraph class="fontsize10" id="y92990dfe-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92990dff-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Summary.</p></sidenote><content>a summary of information relating to the relevant project;</content></paragraph>
<paragraph class="fontsize10" id="y92993510-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92993511-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Cost estimate.</p></sidenote><content>the total estimated costs of the project;</content></paragraph>
<paragraph class="fontsize10" id="y92993512-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92993513-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Timeframe estimate.</p></sidenote><content>estimated commencement and completion dates of the project; and</content></paragraph>
<paragraph class="fontsize10" id="y92993514-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>other documentation determined to be appropriate by the Secretary.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92993515-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Certification</inline>.—</heading><chapeau>The Secretary shall require the contractor of the affected National Laboratory to certify that each activity carried out under a project for which an agreement is entered into under this section—</chapeau><paragraph class="fontsize10" id="y92993516-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>is not in direct competition with the private sector; and</content></paragraph>
<paragraph class="fontsize10" id="y92993517-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>does not present, or minimizes, any apparent conflict of interest, and avoids or neutralizes any actual conflict of interest, as a result of the agreement under this section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92993518-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Extension</inline>.—</heading><content>The pilot program referred to in subsection (a) shall be extended until September 30, 2019.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92993519-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9299351a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="y9299351b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Overall assessment</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9299351c-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p></sidenote>.—</heading><chapeau>Not later than 60 days after the date described in subsection (f), the Secretary, in coordination with directors of the National Laboratories, shall submit to the appropriate committees of Congress a report that—</chapeau><subparagraph class="fontsize10" id="y9299351d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>assesses the overall effectiveness of the pilot program referred to in subsection (a);</content></subparagraph>

<subparagraph class="fontsize10" id="y9299351f-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/g/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>assesses the potential for program activities to interfere with the responsibilities of the National Laboratories to the Department; and</content></subparagraph>

<paragraph class="fontsize10" id="y92993523-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tI/s107/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Transparency</inline>.—</heading><content>The Secretary, in coordination with directors of the National Laboratories, shall submit to the appropriate committees of Congress an annual report that accounts for all incidences of, and provides a justification for, non-Federal entities using funds derived from a Federal contract or award to carry out agreements pursuant to this section.</content></paragraph>

<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y9299f786-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="n">“(n) </num><heading class="fontsize10"><inline class="smallCaps">Protection of Information</inline>.—</heading><chapeau>The following types of information collected by ARPA–E from recipients of financial assistance awards shall be considered commercial and financial information obtained from a person and privileged or confidential and not subject to disclosure under <ref href="/us/usc/t5/s552/b/4">section 552(b)(4) of title 5, United States Code</ref>:</chapeau><paragraph class="fontsize10" id="y9299f787-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Plans for commercialization of technologies developed under the award, including business plans, technology-to-market plans, market studies, and cost and performance models.</content></paragraph>
<paragraph class="fontsize10" id="y9299f788-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Investments provided to an awardee from third parties (such as venture capital firms, hedge funds, and private equity firms), including amounts and the percentage of ownership of the awardee provided in return for the investments.</content></paragraph>
<paragraph class="fontsize10" id="y9299f789-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>Additional financial support that the awardee—</chapeau><subparagraph class="fontsize10" id="y9299f78a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>plans to or has invested into the technology developed under the award; or</content></subparagraph>
<subparagraph class="fontsize10" id="y9299f78b-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is seeking from third parties.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y929a45af-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Existing Programs; Coordination of Activities</inline>.—</heading><chapeau>To the maximum extent practicable, the Secretary shall seek—</chapeau><paragraph class="fontsize10" id="y929a45b0-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to leverage existing programs of the Department; and</content></paragraph>
<paragraph class="fontsize10" id="y929a45b1-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to consolidate and coordinate activities throughout the Department to promote collaboration and crosscutting approaches within programs of the Department.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y929a45b2-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Additional Actions</inline>.—</heading><chapeau>The Secretary shall—</chapeau><paragraph class="fontsize10" id="y929a45b3-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>prioritize activities that use all affordable domestic resources;</content></paragraph>
<paragraph class="fontsize10" id="y929a45b4-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>develop a planning, evaluation, and technical assessment framework for setting objective long-term strategic goals and evaluating progress that—</chapeau><subparagraph class="fontsize10" id="y929a45b5-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>ensures integrity and independence; and</content></subparagraph>
<subparagraph class="fontsize10" id="y929a45b6-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>provides the flexibility to adapt to market dynamics;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929a45b7-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>ensure that activities shall be undertaken in a manner that does not duplicate other activities within the Department or other Federal Government activities; and</content></paragraph>
<paragraph class="fontsize10" id="y929a45b8-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s203/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>identify programs that may be more effectively left to the States, industry, nongovernmental organizations, institutions of higher education, or other stakeholders.</content></paragraph>

<section id="d293999e1089" identifier="/us/pl/115/246/tII/s204" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="204">SEC. 204. </num><heading>STRATEGIC RESEARCH PORTFOLIO ANALYSIS AND COORDINATION PLAN.</heading><content class="firstIndent0 fontsize10" id="x929a93d9-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The Energy Policy Act of 2005 <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> section 994 (<ref href="/us/usc/t42/s16358">42 U.S.C. 16358</ref>) and <amendingAction type="insert">inserting</amendingAction> the following:<page identifier="/us/stat/132/3136">132 STAT. 3136</page>

<paragraph class="fontsize10" id="y929b090e-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the national needs relevant to the statutory missions of the Department; and</content></paragraph>
<paragraph class="fontsize10" id="y929b090f-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>global energy dynamics.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y929b0910-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Coordination Analysis and Plan</inline>.—</heading><paragraph class="fontsize10" id="y929b0911-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As part of the review under subsection (a), the Secretary shall develop a plan to improve coordination and collaboration in research, development, demonstration, and commercial application activities across organizational boundaries of the Department.</content></paragraph>
<paragraph class="fontsize10" id="y929b0912-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Plan contents</inline>.—</heading><chapeau>The plan developed under paragraph (1) shall describe—</chapeau><subparagraph class="fontsize10" id="y929b0913-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>crosscutting scientific and technical issues and research questions that span more than one program or major office of the Department;</content></subparagraph>
<subparagraph class="fontsize10" id="y929b0914-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>ways in which the applied technology programs of the Department are coordinating activities and addressing the questions referred to in subparagraph (A);</content></subparagraph>
<subparagraph class="fontsize10" id="y929b0915-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>ways in which the technical interchange within the Department, particularly between the Office of Science and the applied technology programs, could be enhanced, including ways in which the research agendas of the Office of Science and the applied programs could better interact and assist each other;</content></subparagraph>
<subparagraph class="fontsize10" id="y929b0916-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>ways in which the Secretary would ensure that the overall research agenda of the Department includes, in addition to fundamental, curiosity-driven research, fundamental research related to topics of concern to the applied programs, and applications in Departmental technology programs of research results generated by fundamental, curiosity-driven research;</content></subparagraph>
<subparagraph class="fontsize10" id="y929b0917-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929b0918-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p></sidenote><content>critical assessments of any ongoing programs that have experienced subpar performance or cost overruns of 10 percent or more over 1 or more years;</content></subparagraph>
<subparagraph class="fontsize10" id="y929b0919-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>any activities that may be more effectively left to the States, industry, nongovernmental organizations, institutions of higher education, or other stakeholders; and</content></subparagraph>
<subparagraph class="fontsize10" id="y929b091a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929b091b-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluations.</p><p class="leftAlign firstIndent0 fontsize8" id="x929b091c-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Proposals.</p></sidenote><chapeau>detailed evaluations and proposals for innovation hubs, institutes, and research centers of the Department, including—</chapeau><clause class="fontsize10" id="y929b091d-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>an affirmation that the hubs, institutes, and research centers will—</chapeau><subclause class="fontsize10" id="y929b091e-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>advance the mission of the Department; and</content></subclause>

<clause class="fontsize10" id="y929d0502-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/1/A/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>that enhances the energy independence and security of the United States by enabling improved or expanded supply and production of domestic energy resources, including coal, oil, and natural gas;</content></clause>

<subparagraph class="fontsize10" id="y929d0504-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>any other innovative energy technology area identified by the Secretary.</content></subparagraph>

<paragraph class="fontsize10" id="y929d0505-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Hub</inline>.—</heading><subparagraph class="fontsize10" id="y929d0506-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/2/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>Hub</term>” means an Energy Innovation Hub established under this section.</content></subparagraph>
<subparagraph class="fontsize10" id="y929d0507-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/2/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Inclusion</inline>.—</heading><content>The term “<term>Hub</term>” includes any Energy Innovation Hub in existence on the date of enactment of this Act.</content></subparagraph>

<paragraph class="fontsize10" id="y929d0508-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Qualifying entity</inline>.—</heading><chapeau>The term “<term>qualifying entity</term>” means—</chapeau><subparagraph class="fontsize10" id="y929d0509-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an institution of higher education;<page identifier="/us/stat/132/3138">132 STAT. 3138</page></content></subparagraph>
<subparagraph class="fontsize10" id="y929d050a-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an appropriate State or Federal entity, including a federally funded research and development center of the Department;</content></subparagraph>
<subparagraph class="fontsize10" id="y929d050b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>a nongovernmental organization with expertise in advanced energy technology research, development, demonstration, or commercial application; or</content></subparagraph>
<subparagraph class="fontsize10" id="y929d050c-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/a/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>any other relevant entity the Secretary determines appropriate.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y929d050d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Program</inline>.—</heading><paragraph class="fontsize10" id="y929d050e-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall carry out a program to enhance the economic, environmental, and energy security of the United States by making awards to consortia for establishing and operating hubs, to be known as “Energy Innovation Hubs”, to conduct and support, at, if practicable, one centralized location, multidisciplinary, collaborative research, development, demonstration, and commercial application of advanced energy technologies.</content></paragraph>
<paragraph class="fontsize10" id="y929d050f-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929d0510-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Designation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Technology development focus</inline>.—</heading><content>The Secretary shall designate for each Hub a unique advanced energy technology or basic research focus.</content></paragraph>
<paragraph class="fontsize10" id="y929d0511-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><chapeau>The Secretary shall ensure the coordination of, and avoid unnecessary duplication of, the activities of each Hub with the activities of—</chapeau><subparagraph class="fontsize10" id="y929d0512-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>other research entities of the Department, including the National Laboratories, the Advanced Research Projects Agency—Energy, and Energy Frontier Research Centers; and</content></subparagraph>
<subparagraph class="fontsize10" id="y929d0513-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>industry.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y929d0514-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Application Process</inline>.—</heading><paragraph class="fontsize10" id="y929d0515-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline>.—</heading><chapeau>To be eligible to receive an award for the establishment and operation of a Hub under subsection (b)(1), a consortium shall—</chapeau><subparagraph class="fontsize10" id="y929d0516-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>be composed of not fewer than two qualifying entities;</content></subparagraph>
<subparagraph class="fontsize10" id="y929d0517-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>operate subject to a binding agreement, entered into by each member of the consortium, that documents—</chapeau><clause class="fontsize10" id="y929d0518-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the proposed partnership agreement, including the governance and management structure of the Hub;</content></clause>
<clause class="fontsize10" id="y929d0519-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>measures the consortium will undertake to enable cost-effective implementation of activities under the program described in subsection (b)(1); and</content></clause>
<clause class="fontsize10" id="y929d051a-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>a proposed budget, including financial contributions from non-Federal sources; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y929d051b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>operate as a nonprofit organization.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929d051c-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Application</inline>.—</heading><subparagraph class="fontsize10" id="y929d051d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A consortium seeking to establish and operate a Hub under subsection (b)(1) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a detailed description of each element of the consortium agreement required under paragraph (1)(B).</content></subparagraph>
<subparagraph class="fontsize10" id="y929d2c2e-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content>If the consortium members will not be located at one centralized location, the application under subparagraph (A) shall include a communications plan that ensures close coordination and integration of Hub activities.<page identifier="/us/stat/132/3139">132 STAT. 3139</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929d2c2f-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Selection</inline>.—</heading><subparagraph class="fontsize10" id="y929d2c30-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall select consortia for awards for the establishment and operation of Hubs through a competitive selection process.</content></subparagraph>
<subparagraph class="fontsize10" id="y929d2c31-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><chapeau>In selecting consortia under subparagraph (A), the Secretary shall consider—</chapeau><clause class="fontsize10" id="y929d2c32-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the information disclosed by the consortium under this subsection; and</content></clause>
<clause class="fontsize10" id="y929d2c33-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/c/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any existing facilities a consortium will provide for Hub activities.</content></clause>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y929d2c34-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Term</inline>.—</heading><paragraph class="fontsize10" id="y929d2c35-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>An award made to a Hub under this section shall be for a period of not more than 5 years, subject to the availability of appropriations, after which the award may be renewed, subject to a rigorous merit review.</content></paragraph>
<paragraph class="fontsize10" id="y929d2c36-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Existing hubs</inline>.—</heading><chapeau>A Hub already in existence on, or undergoing a renewal process on, the date of enactment of this Act—</chapeau><subparagraph class="fontsize10" id="y929d2c37-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>may continue to receive support during the 5-year period beginning on the date of establishment of that Hub; and</content></subparagraph>
<subparagraph class="fontsize10" id="y929d2c38-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>shall be eligible for renewal of that support at the end of that 5-year period.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y929d2c39-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Hub Operations</inline>.—</heading><paragraph class="fontsize10" id="y929d2c3a-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Each Hub shall conduct or provide for multidisciplinary, collaborative research, development, demonstration, and commercial application of advanced energy technologies within the technology development focus designated under subsection (b)(2).</content></paragraph>
<paragraph class="fontsize10" id="y929d2c3b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Activities</inline>.—</heading><chapeau>Each Hub shall—</chapeau><subparagraph class="fontsize10" id="y929d2c3c-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>encourage collaboration and communication among the member qualifying entities of the consortium and awardees;</content></subparagraph>
<subparagraph class="fontsize10" id="y929d2c3d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929d2c3e-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Plans.</p><p class="leftAlign firstIndent0 fontsize8" id="x929d2c3f-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><content>develop and publish proposed plans and programs on a publicly accessible website;</content></subparagraph>
<subparagraph class="fontsize10" id="y929d2c40-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929d2c41-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><chapeau>submit an annual report to the Department summarizing the activities of the Hub, including—</chapeau><clause class="fontsize10" id="y929d2c42-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>detailing organizational expenditures; and</content></clause>
<clause class="fontsize10" id="y929d2c43-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>describing each project undertaken by the Hub; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y929d2c44-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>monitor project implementation and coordination.</content></subparagraph>

<paragraph class="fontsize10" id="y929d2c45-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Conflicts of interest</inline>.—</heading><content>Each Hub shall maintain conflict of interest procedures, consistent with the conflict of interest procedures of the Department.</content></paragraph>
<paragraph class="fontsize10" id="y929d2c46-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on construction</inline>.—</heading><subparagraph class="fontsize10" id="y929d2c47-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in subparagraph (B)—</chapeau><clause class="fontsize10" id="y929d2c48-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/4/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>no funds provided under this section may be used for construction of new buildings or facilities for Hubs; and</content></clause>

<subparagraph class="fontsize10" id="y929d2c4a-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tII/s206/e/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Test bed and renovation exception</inline>.—</heading><content>Nothing in this paragraph prohibits the use of funds provided under this section or non-Federal cost share funds for the construction of a test bed or renovations to existing <page identifier="/us/stat/132/3140">132 STAT. 3140</page>
buildings or facilities for the purposes of research if the Secretary determines that the test bed or renovations are limited to a scope and scale necessary for the research to be conducted.</content></subparagraph>

<section id="d293999e1810" identifier="/us/pl/115/246/tIII/s302" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="302">SEC. 302. </num><heading>MISSION.</heading><content class="firstIndent0 fontsize10" id="x929d2c4d-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 209 of the Department of Energy Organization Act (<ref href="/us/usc/t42/s7139">42 U.S.C. 7139</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y929d535e-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Mission</inline>.—</heading><content>The mission of the Office of Science shall be the delivery of scientific discoveries, capabilities, and major scientific tools to transform the understanding of nature and to advance the energy, economic, and national security of the United States.”</content></subsection>

<section id="d293999e1838" identifier="/us/pl/115/246/tIII/s303" style="-uslm-lc:I658143"><num class="fontsize12" value="303">SEC. 303. </num><heading>BASIC ENERGY SCIENCES.</heading><subsection class="firstIndent0 fontsize10" id="y929eb2ef-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929eda00-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18641">42 USC 18641</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Energy Frontier Research Centers</inline>.—</heading><paragraph class="fontsize10" id="y929eda01-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Director shall carry out a program to provide awards, on a competitive, merit-reviewed basis, to multi-institutional collaborations or other appropriate entities to conduct fundamental and use-inspired energy research to accelerate scientific breakthroughs.</content></paragraph>
<paragraph class="fontsize10" id="y929eda02-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Collaborations</inline>.—</heading><content>A collaboration receiving an award under this subsection may include multiple types of institutions and private sector entities.</content></paragraph>
<paragraph class="fontsize10" id="y929eda03-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Selection and duration</inline>.—</heading><subparagraph class="fontsize10" id="y929eda04-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A collaboration under this subsection shall be selected for a period of 4 years.</content></subparagraph>
<subparagraph class="fontsize10" id="y929eda05-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Existing centers</inline>.—</heading><content>An Energy Frontier Research Center in existence and supported by the Director on the date of enactment of this Act may continue to receive support for a period of 4 years beginning on the date of establishment of that center.</content></subparagraph>
<subparagraph class="fontsize10" id="y929eda06-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Reapplication</inline>.—</heading><content>After the end of the period described in subparagraph (A) or (B), as applicable, a recipient of an award may reapply for selection on a competitive, merit-reviewed basis.</content></subparagraph>
<subparagraph class="fontsize10" id="y929eda07-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>Consistent with the existing authorities of the Department, the Director may terminate an underperforming center for cause during the performance period.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929eda08-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">No funding for construction</inline>.—</heading><content>No funding provided pursuant to this subsection may be used for the construction of new buildings or facilities.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y929eda09-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929eda0a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18641">42 USC 18641</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Basic Energy Sciences User Facilities</inline>.—</heading><paragraph class="fontsize10" id="y929eda0b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Director shall carry out a program for the development, construction, operation, and maintenance of national user facilities.</content></paragraph>
<paragraph class="fontsize10" id="y929eda0c-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><content>To the maximum extent practicable, the national user facilities developed, constructed, operated, <page identifier="/us/stat/132/3141">132 STAT. 3141</page>
or maintained under paragraph (1) shall serve the needs of the Department, industry, the academic community, and other relevant entities to create and examine materials and chemical processes for the purpose of improving the competitiveness of the United States.</content></paragraph>
<paragraph class="fontsize10" id="y929eda0d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Included facilities</inline>.—</heading><chapeau>The national user facilities developed, constructed, operated, or maintained under paragraph (1) shall include—</chapeau><subparagraph class="fontsize10" id="y929eda0e-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>x-ray light sources;</content></subparagraph>
<subparagraph class="fontsize10" id="y929eda0f-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>neutron sources;</content></subparagraph>
<subparagraph class="fontsize10" id="y929eda10-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>nanoscale science research centers; and</content></subparagraph>
<subparagraph class="fontsize10" id="y929eda11-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>such other facilities as the Director considers appropriate, consistent with section 209 of the Department of Energy Organization Act (<ref href="/us/usc/t42/s7139">42 U.S.C. 7139</ref>).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y929eda12-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Accelerator Research and Development</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x929eda13-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x929eda14-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18641">42 USC 18641</ref>.</p></sidenote>.—</heading><content>The Director shall carry out research and development on advanced accelerator and storage ring technologies relevant to the development of basic energy sciences user facilities, in consultation with the High Energy Physics and Nuclear Physics programs of the Office of Science.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y929eda15-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Solar Fuels Research Initiative</inline>.—</heading><paragraph class="fontsize10" id="y929eda16-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s303/d/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Section 973 of the Energy Policy Act of 2005 (<ref href="/us/usc/t42/s16313">42 U.S.C. 16313</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="y929f7657-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="973">“SEC. 973. </num><heading class="fontsize12">SOLAR FUELS RESEARCH INITIATIVE.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y929f7658-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Initiative</inline>.—</heading><paragraph class="fontsize10" id="y929f7659-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall carry out a research initiative, to be known as the ‘Solar Fuels Research Initiative’ (referred to in this section as the ‘Initiative’) to expand theoretical and fundamental knowledge of photochemistry, electrochemistry, biochemistry, and materials science useful for the practical development of experimental systems to convert solar energy to chemical energy.</content></paragraph>
<paragraph class="fontsize10" id="y929f765a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Leveraging</inline>.—</heading><chapeau>In carrying out programs and activities under the Initiative, the Secretary shall leverage expertise and resources from—</chapeau><subparagraph class="fontsize10" id="y929f765b-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Basic Energy Sciences Program and the Biological and Environmental Research Program of the Office of Science; and</content></subparagraph>
<subparagraph class="fontsize10" id="y929f765c-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Office of Energy Efficiency and Renewable Energy.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929f765d-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Teams</inline>.—</heading><subparagraph class="fontsize10" id="y929f765e-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In carrying out the Initiative, the Secretary shall organize activities among multidisciplinary teams to leverage, to the maximum extent practicable, expertise from the National Laboratories, institutions of higher education, and the private sector.</content></subparagraph>
<subparagraph class="fontsize10" id="y929f765f-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Goals</inline>.—</heading><content>The multidisciplinary teams described in subparagraph (A) shall pursue aggressive, milestone-driven, basic research goals.</content></subparagraph>
<subparagraph class="fontsize10" id="y929f7660-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Resources</inline>.—</heading><content>The Secretary shall provide sufficient resources to the multidisciplinary teams described in subparagraph (A) to achieve the goals described in subparagraph (B) over a period of time to be determined by the Secretary.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929f7661-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Additional activities</inline>.—</heading><content>The Secretary may organize additional activities under this subsection through Energy <page identifier="/us/stat/132/3142">132 STAT. 3142</page>
Frontier Research Centers, Energy Innovation Hubs, or other organizational structures.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y929f7662-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Artificial Photosynthesis</inline>.—</heading><paragraph class="fontsize10" id="y929f7663-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall carry out under the Initiative a program to support research needed to bridge scientific barriers to, and discover knowledge relevant to, artificial photosynthetic systems.</content></paragraph>
<paragraph class="fontsize10" id="y929f7664-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Activities</inline>.—</heading><chapeau>As part of the program described in paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y929f7665-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the Director of the Office of Basic Energy Sciences shall support basic research to pursue distinct lines of scientific inquiry, including—</chapeau><clause class="fontsize10" id="y929f7666-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>photoinduced production of hydrogen and oxygen from water; and</content></clause>
<clause class="fontsize10" id="y929f7667-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the sustainable photoinduced reduction of carbon dioxide to fuel products including hydrocarbons, alcohols, carbon monoxide, and natural gas; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y929f7668-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Assistant Secretary for Energy Efficiency and Renewable Energy shall support translational research, development, and validation of physical concepts developed under the program.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929f7669-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Standard of review</inline>.—</heading><content>The Secretary shall review activities carried out under the program described in paragraph (1) to determine the achievement of technical milestones.</content></paragraph>
<paragraph class="fontsize10" id="y929f766a-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>No funds allocated to the program described in paragraph (1) may be obligated or expended for commercial application of energy technology.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y929f766b-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Biochemistry, Replication of Natural Photosynthesis, and Related Processes</inline>.—</heading><paragraph class="fontsize10" id="y929f766c-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall carry out under the Initiative a program to support research needed to replicate natural photosynthetic processes by use of artificial photosynthetic components and materials.</content></paragraph>
<paragraph class="fontsize10" id="y929f9d7d-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Activities</inline>.—</heading><chapeau>As part of the program described in paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y929f9d7e-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the Director of the Office of Basic Energy Sciences shall support basic research to expand fundamental knowledge to replicate natural synthesis processes, including—</chapeau><clause class="fontsize10" id="y929f9d7f-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the photoinduced reduction of dinitrogen to ammonia;</content></clause>
<clause class="fontsize10" id="y929f9d80-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the absorption of carbon dioxide from ambient air;</content></clause>
<clause class="fontsize10" id="y929f9d81-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>molecular-based charge separation and storage;</content></clause>
<clause class="fontsize10" id="y929f9d82-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>photoinitiated electron transfer; and</content></clause>
<clause class="fontsize10" id="y929f9d83-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>catalysis in biological or biomimetic systems;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y929f9d84-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Associate Director of Biological and Environmental Research shall support systems biology and genomics approaches to understand genetic and physiological pathways connected to photosynthetic mechanisms; and</content></subparagraph>
<subparagraph class="fontsize10" id="y929f9d85-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the Assistant Secretary for Energy Efficiency and Renewable Energy shall support translational research, development, and validation of physical concepts developed under the program.<page identifier="/us/stat/132/3143">132 STAT. 3143</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y929f9d86-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Standard of review</inline>.—</heading><content>The Secretary shall review activities carried out under the program described in paragraph (1) to determine the achievement of technical milestones.</content></paragraph>

<paragraph class="fontsize10" id="y92a1e7b4-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Execution</inline>.—</heading><subparagraph class="fontsize10" id="y92a1e7b5-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In carrying out the Program, the Secretary shall—</chapeau><clause class="fontsize10" id="y92a1e7b6-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>establish two or more National Laboratory partnerships with industry partners and institutions of higher education for the research and development of two or more exascale computing architectures across all applicable organizations of the Department;</content></clause>
<clause class="fontsize10" id="y92a1e7b7-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>conduct mission-related codesign activities in developing the exascale computing architectures under clause (i);</content></clause>
<clause class="fontsize10" id="y92a1e7b8-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>develop such advancements in hardware and software technology as are required to fully realize the potential of an exascale production system in addressing Department target applications and solving scientific problems involving predictive modeling and simulation and large scale data analytics and management;</content></clause>
<clause class="fontsize10" id="y92a1e7b9-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>explore the use of exascale computing technologies to advance a broad range of science and engineering; and</content></clause>
<clause class="fontsize10" id="y92a1e7ba-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>provide, as appropriate, on a competitive, merit-reviewed basis, access for researchers in industries in the United States, institutions of higher education, National Laboratories, and other Federal agencies to the exascale computing systems developed pursuant to clause (i).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92a1e7bb-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Selection of partners</inline>.—</heading><content>The Secretary shall select the partnerships with the computing facilities of the Department under subparagraph (A) through a competitive, peer-review process.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y92a1e7bc-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Codesign and application development</inline>.—</heading><subparagraph class="fontsize10" id="y92a1e7bd-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall—</chapeau><clause class="fontsize10" id="y92a1e7be-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>carry out the Program through an integration of applications, computer science, applied mathematics, and computer hardware architecture using the partnerships established pursuant to paragraph (2) to ensure that, to the maximum extent practicable, two or more exascale computing machine architectures are capable of solving Department target applications and broader scientific problems, including predictive modeling and simulation and large scale data analytics and management; and</content></clause>
<clause class="fontsize10" id="y92a1e7bf-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>conduct outreach programs to increase the readiness for the use of such platforms by domestic industries, including manufacturers.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92a1e7c0-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>The Secretary shall submit to Congress a report describing—<page identifier="/us/stat/132/3147">132 STAT. 3147</page></chapeau><clause class="fontsize10" id="y92a1e7c1-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>how the integration under subparagraph (A) is furthering application science data and computational workloads across application interests, including national security, material science, physical science, cybersecurity, biological science, the Materials Genome and BRAIN Initiatives of the President, advanced manufacturing, and the national electric grid; and</content></clause>
<clause class="fontsize10" id="y92a1e7c2-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the roles and responsibilities of National Laboratories and industry, including the definition of the roles and responsibilities within the Department to ensure an integrated program across the Department.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y92a1e7c3-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Project review</inline>.—</heading><subparagraph class="fontsize10" id="y92a1e7c4-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The exascale architectures developed pursuant to partnerships established pursuant to paragraph (2) shall be reviewed through a project review process.</content></subparagraph>
<subparagraph class="fontsize10" id="y92a1e7c5-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 90 days after the date of enactment of this subsection, the Secretary shall submit to Congress a report on—</chapeau><clause class="fontsize10" id="y92a1e7c6-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the results of the review conducted under subparagraph (A); and</content></clause>
<clause class="fontsize10" id="y92a1e7c7-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the coordination and management of the Program to ensure an integrated research program across the Department.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y92a1e7c8-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Annual reports</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a1e7c9-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote>—</heading><content>At the time of the budget submission of the Department for each fiscal year, the Secretary, in consultation with the members of the partnerships established pursuant to paragraph (2), shall submit to Congress a report that describes funding for the Program as a whole by functional element of the Department and critical milestones.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y92a1e7ca-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s304/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">High-Performance Computing and Networking Research</inline>.—</heading><content>The Director shall support research in high-performance computing and networking relevant to energy applications, including modeling, simulation, and advanced data analytics for basic and applied energy research programs carried out by the Secretary.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a1e7cb-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s304/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Applied Mathematics and Software Development for High-End Computing Systems</inline>.—</heading><chapeau>The Director shall carry out activities to develop, test, and support—</chapeau><paragraph class="fontsize10" id="y92a1e7cc-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s304/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>mathematics, models, and algorithms for complex systems and programming environments; and</content></paragraph>
<paragraph class="fontsize10" id="y92a1e7cd-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s304/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>tools, languages, and operating systems for high-end computing systems (as defined in section 2 of the American Super Computing Leadership Act of 2017 (<ref href="/us/usc/t15/s5541">15 U.S.C. 5541</ref>)).</content></paragraph>

<section id="d293999e3045" identifier="/us/pl/115/246/tIII/s305" style="-uslm-lc:I658143"><num class="fontsize12" value="305">SEC. 305. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a1e7ce-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18643">42 USC 18643</ref>.</p></sidenote><heading>HIGH-ENERGY PHYSICS.</heading><subsection class="firstIndent0 fontsize10" id="y92a234ef-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s305/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><chapeau>It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y92a234f0-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s305/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Director should incorporate the findings and recommendations of the report of the Particle Physics Project Prioritization Panel entitled “Building for Discovery: Strategic Plan for U.S. Particle Physics in the Global Context” into the planning process of the Department; and</content></paragraph>
<paragraph class="fontsize10" id="y92a234f1-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s305/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the nations that lead in particle physics by hosting international teams dedicated to a common scientific goal attract the world’s best talent and inspire future generations of physicists and technologists.<page identifier="/us/stat/132/3148">132 STAT. 3148</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92a234f2-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s305/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">International Collaboration</inline>.—</heading><content>The Director, as practicable and in coordination with other appropriate Federal agencies as necessary, shall ensure the access of United States researchers to the most advanced accelerator facilities and research capabilities in the world, including the Large Hadron Collider.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a234f3-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s305/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Neutrino Research</inline>.—</heading><content>The Director shall carry out research activities on rare decay processes and the nature of the neutrino, which may include collaborations with the National Science Foundation or international collaborations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a234f4-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s305/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Dark Energy and Dark Matter Research</inline>.—</heading><content>The Director shall carry out research activities on the nature of dark energy and dark matter, which may include collaborations with the National Aeronautics and Space Administration or the National Science Foundation; or international collaborations.</content></subsection>

<section id="d293999e3104" identifier="/us/pl/115/246/tIII/s306" style="-uslm-lc:I658143"><num class="fontsize12" value="306">SEC. 306. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a234f5-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18644">42 USC 18644</ref>.</p></sidenote><heading>BIOLOGICAL AND ENVIRONMENTAL RESEARCH.</heading><subsection class="firstIndent0 fontsize10" id="y92a28316-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Biological Systems</inline>.—</heading><chapeau>The Director shall carry out research and development activities in fundamental, structural, computational, and systems biology to increase systems-level understanding of the complex biological systems, which may include activities—</chapeau><paragraph class="fontsize10" id="y92a28317-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>to accelerate breakthroughs and new knowledge that would enable the cost-effective, sustainable production of—</chapeau><subparagraph class="fontsize10" id="y92a28318-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>biomass-based liquid transportation fuels;</content></subparagraph>
<subparagraph class="fontsize10" id="y92a28319-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>bioenergy; and</content></subparagraph>
<subparagraph class="fontsize10" id="y92a2831a-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>biobased materials;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y92a2831b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to improve understanding of the global carbon cycle, including processes for removing carbon dioxide from the atmosphere, through photosynthesis and other biological processes, for sequestration and storage; and</content></paragraph>
<paragraph class="fontsize10" id="y92a2831c-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to understand the biological mechanisms used to transform, immobilize, or remove contaminants from subsurface environments.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92a2aa2d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Limitation for Research Funds</inline>.—</heading><content>The Director shall not approve new climate science-related initiatives without making a determination that such work is well-coordinated with any relevant work carried out by other Federal agencies.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a2aa2e-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Low-Dose Radiation Research Program</inline>.—</heading><paragraph class="fontsize10" id="y92a2aa2f-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Director shall carry out a research program on low-dose radiation.</content></paragraph>
<paragraph class="fontsize10" id="y92a2aa30-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s306/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><content>The purpose of the program is to enhance the scientific understanding of, and reduce uncertainties associated with, the effects of exposure to low-dose radiation to inform improved risk-management methods.</content></paragraph>

<section id="d293999e3188" identifier="/us/pl/115/246/tIII/s307" style="-uslm-lc:I658143"><num class="fontsize12" value="307">SEC. 307. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a2aa31-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18645">42 USC 18645</ref>.</p></sidenote><heading>FUSION ENERGY.</heading><subsection class="firstIndent0 fontsize10" id="y92a36d82-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Fusion Materials Research and Development</inline>.—</heading><chapeau>As part of the activities authorized in section 978 of the Energy Policy Act of 2005 (<ref href="/us/usc/t42/s16318">42 U.S.C. 16318</ref>)—</chapeau><paragraph class="fontsize10" id="y92a36d83-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a36d84-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>the Director, in coordination with the Assistant Secretary for Nuclear Energy of the Department, shall carry out research and development activities to identify, characterize, and demonstrate materials that can endure the neutron, plasma, and heat fluxes expected in a fusion power system; and</content></paragraph>
<paragraph class="fontsize10" id="y92a36d85-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a36d86-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><chapeau>the Director shall provide an assessment of—</chapeau><page identifier="/us/stat/132/3149">132 STAT. 3149</page>
<subparagraph class="fontsize10" id="y92a36d87-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the need for one or more facilities that can examine and test potential fusion and next generation fission materials and other enabling technologies relevant to the development of fusion power; and</content></subparagraph>
<subparagraph class="fontsize10" id="y92a36d88-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>whether a single new facility that substantially addresses magnetic fusion and next generation fission materials research needs is feasible, in conjunction with the expected capabilities of facilities operational as of the date of enactment of this Act.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92a36d89-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Tokamak Research and Development</inline>.—</heading><content>The Director shall support research and development activities and facility operations to optimize the tokamak approach to fusion energy.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a36d8a-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Inertial Fusion Energy Research and Development</inline>.—</heading><content>The Director shall support research and development activities for inertial fusion for energy applications.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a36d8b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Alternative and Enabling Concepts</inline>.—</heading><content>The Director shall support research and development activities and facility operations at institutions of higher education, National Laboratories, and private facilities in the United States for a portfolio of alternative and enabling fusion energy concepts that may provide solutions to significant challenges to the establishment of a commercial magnetic fusion power plant, prioritized based on the ability of the United States to play a leadership role in the international fusion research community.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a36d8c-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Coordination With ARPA–E</inline>.—</heading><chapeau>The Director shall coordinate with the Director of the Advanced Research Projects Agency-Energy (referred to in this subsection as “ARPA–E”) to—</chapeau><paragraph class="fontsize10" id="y92a36d8d-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>assess the potential for any fusion energy project supported by ARPA–E to represent a promising approach to a commercially viable fusion power plant;</content></paragraph>
<paragraph class="fontsize10" id="y92a36d8e-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>determine whether the results of any fusion energy project supported by ARPA–E merit the support of follow-on research activities carried out by the Office of Science; and</content></paragraph>
<paragraph class="fontsize10" id="y92a36d8f-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>avoid the unintentional duplication of activities.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92a36d90-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/f" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Fairness in Competition for Solicitations for International Project Activities</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a36d91-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definition.</p></sidenote>—</heading><content>Section 33 of the Atomic Energy Act of 1954 (<ref href="/us/usc/t42/s2053">42 U.S.C. 2053</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> before the first sentence the following: “<quotedText>In this section, with respect to international research projects, the term ‘<term>private facilities or laboratories</term>’ means facilities or laboratories located in the United States.</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a36d92-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Identification of Priorities</inline>.—</heading><paragraph class="fontsize10" id="y92a36d93-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><subparagraph class="fontsize10" id="y92a36d94-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a36d95-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to Congress a report on the fusion energy research and development activities that the Department proposes to carry out over the 10-year period following the date of the report under not fewer than 3 realistic budget scenarios, including a scenario based on 3-percent annual growth in the non-ITER portion of the budget for fusion energy research and development activities.</content></subparagraph>
<subparagraph class="fontsize10" id="y92a36d96-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Inclusions</inline>.—</heading><chapeau>The report required under subparagraph (A) shall—</chapeau><clause class="fontsize10" id="y92a36d97-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>identify specific areas of fusion energy research and enabling technology development in which the United States can and should establish or solidify a lead in the global fusion energy development effort;<page identifier="/us/stat/132/3150">132 STAT. 3150</page></content></clause>
<clause class="fontsize10" id="y92a36d98-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>identify priorities for initiation of facility construction and facility decommissioning under each of the three budget scenarios described in subparagraph (A); and</content></clause>
<clause class="fontsize10" id="y92a36d99-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>assess the ability of the fusion workforce of the United States to carry out the activities identified under clauses (i) and (ii), including the adequacy of programs at institutions of higher education in the United States to train the leaders and workers of the next generation of fusion energy researchers.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y92a36d9a-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Process</inline>.—</heading><content>In order to develop the report required under paragraph (1)(A), the Secretary shall leverage best practices and lessons learned from the process used to develop the most recent report of the Particle Physics Project Prioritization Panel of the High Energy Physics Advisory Panel.</content></paragraph>
<paragraph class="fontsize10" id="y92a36d9b-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s307/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content>No member of the Fusion Energy Sciences Advisory Committee shall be excluded from participating in developing or voting on final approval of the report required under paragraph (1)(A).</content></paragraph>

<section id="d293999e3388" identifier="/us/pl/115/246/tIII/s308" style="-uslm-lc:I658143"><num class="fontsize12" value="308">SEC. 308. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a36d9c-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18646">42 USC 18646</ref>.</p></sidenote><heading>NUCLEAR PHYSICS.</heading><subsection class="firstIndent0 fontsize10" id="y92a3bbbd-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s308/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Isotope Development and Production for Research Applications</inline>.—</heading><chapeau>The Director—</chapeau><paragraph class="fontsize10" id="y92a3bbbe-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s308/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>may carry out a program for the production of isotopes, including the development of techniques to produce isotopes, that the Secretary determines are needed for research, medical, industrial, or related purposes; and</content></paragraph>
<paragraph class="fontsize10" id="y92a3bbbf-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s308/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>shall ensure that isotope production activities carried out under the program under this paragraph do not compete with private industry unless the Director determines that critical national interests require the involvement of the Federal Government.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92a3bbc0-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s308/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Renaming of the Rare Isotope Accelerator</inline>.—</heading><chapeau>Section 981 of the Energy Policy Act of 2005 (<ref href="/us/usc/t42/s16321">42 U.S.C. 16321</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y92a3bbc1-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s308/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the section heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText>rare isotope accelerator</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>facility for rare isotope beams</quotedText>”; and</content></paragraph>

<section id="d293999e3457" identifier="/us/pl/115/246/tIII/s309" style="-uslm-lc:I658143"><num class="fontsize12" value="309">SEC. 309. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92a3bbc3-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s18647">42 USC 18647</ref>.</p></sidenote><heading>SCIENCE LABORATORIES INFRASTRUCTURE PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y92a3e2d4-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s309/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Director shall carry out a program to improve the safety, efficiency, and mission readiness of infrastructure at laboratories of the Office of Science.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92a3e2d5-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s309/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Inclusions</inline>.—</heading><chapeau>The program under subsection (a) shall include projects—</chapeau><paragraph class="fontsize10" id="y92a3e2d6-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s309/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to renovate or replace space that does not meet research needs;</content></paragraph>
<paragraph class="fontsize10" id="y92a3e2d7-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s309/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to replace facilities that are no longer cost effective to renovate or operate;</content></paragraph>
<paragraph class="fontsize10" id="y92a3e2d8-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s309/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to modernize utility systems to prevent failures and ensure efficiency;</content></paragraph>
<paragraph class="fontsize10" id="y92a3e2d9-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s309/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to remove excess facilities to allow safe and efficient operations; and<page identifier="/us/stat/132/3151">132 STAT. 3151</page></content></paragraph>
<paragraph class="fontsize10" id="y92a3e2da-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/246/tIII/s309/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to construct modern facilities to conduct advanced research in controlled environmental conditions.</content></paragraph>
