<section id="d310209e91" identifier="/us/pl/115/177/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>IMPROVEMENTS TO AUTHORITIES FOR PROVISION OF ASSISTANCE FOR ADAPTATIONS OF RESIDENCES OF VETERANS IN REHABILITATION PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="y0c85726a-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t38/ch21">Chapter 21 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 2102A the following new section:<quotedContent><section class="centered fontsize12" id="y0c85997b-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658165"><num class="fontsize12" value="2102B">“§ 2102B.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c85997c-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s2102b">38 USC 2102b</ref>.</p></sidenote> Adaptations to residences of veterans in rehabilitation programs</heading><subsection class="firstIndent0 fontsize10" id="y0c85997d-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c85997e-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subject to subsections (b) and (c), the Secretary may assist a veteran who is entitled to services and assistance under chapter 31 of this title and is pursuing a rehabilitation program under such chapter in acquiring such adaptations to such veteran’s residence as are determined necessary by the Secretary to accomplish the purposes of such rehabilitation program.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y0c85997f-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Amount</inline>.—</heading><paragraph class="inline" id="y0c859980-e838-11f0-bc57-ad3ac4b1618c"><num value="1">(1) </num><content>The aggregate amount of assistance available to a veteran under subsection (a) may not exceed $77,307.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c859981-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Waiver authority.</p><p class="leftAlign firstIndent0 fontsize8" id="x0c859982-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote> The Secretary may waive this limitation for a veteran if the Secretary determines a waiver is necessary for the rehabilitation program of the veteran.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y0c859983-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c859984-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective dates.</p></sidenote><content>Effective on October 1 of each year (beginning in 2017), the Secretary shall increase the amount described in paragraph (1) by the percentage calculated under section 2102(e)(2) of this title.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y0c859985-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c859986-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="x0c859987-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><content>Beginning on October 1, 2019, the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a biennial report on the use of the waiver authority under paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0c859988-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><content>The Secretary shall prescribe such regulations as may be necessary to carry out this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y0c859989-e838-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Rehabilitation Program Defined</inline>.—</heading><content>In this section, the term ‘<term>rehabilitation program</term>’ has the meaning given such term in section 3101 of this title.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y0c85998a-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c85998b-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notice.</p><p class="leftAlign firstIndent0 fontsize8" id="x0c85998c-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Criteria.</p><p class="leftAlign firstIndent0 fontsize8" id="x0c85998d-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s2102b">38 USC 2102b note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><content>The Secretary may provide assistance under section 2102B of such title, as added by subsection (a), in advance of regulations by issuing notice specifying the criteria for the application, approval, and oversight processes relating to the provision of assistance under such section.<page identifier="/us/stat/132/1377">132 STAT. 1377</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y0c85998e-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendments</inline>.—</heading><paragraph class="fontsize10" id="y0c85998f-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Scope of services and assistance for training and rehabilitation</inline>.—</heading><content>Section 3104 of such title <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y0c85c0a0-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><content>The Secretary may not assist a veteran in acquiring adaptations to the residence of the veteran under this chapter. Any such assistance may be furnished only under section 2102B of this title.”</content></subsection>

<paragraph class="fontsize10" id="y0c85c0a1-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Members of the armed forces residing outside the united states</inline>.—</heading><chapeau>Section 2101A of such title <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="y0c85c0a2-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (c) as subsection (d); and</content></subparagraph>
<subparagraph class="fontsize10" id="y0c85c0a3-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (b) the following new subsection (c):<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y0c85c0a4-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>Notwithstanding subsections (a) and (b), this section shall not apply to the provision of assistance under section 2102B of this title.”</content></subsection>

<paragraph class="fontsize10" id="y0c85c0a5-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/3" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Benefits additional to benefits under other laws</inline>.—</heading><chapeau>Section 2104 of such title <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="y0c85c0a6-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; however</quotedText>” and all that follows through “<quotedText>once</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y0c85c0a7-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subsection (b), by <amendingAction type="delete">striking</amendingAction> the second sentence; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0c85c0a8-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y0c85c0a9-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c85c0aa-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>The Secretary may not provide assistance to a veteran under this chapter if the Secretary determines such assistance would result in a duplication of benefits under this title to the veteran.”</content></subsection>

<paragraph class="fontsize10" id="y0c85c0ab-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/177/s1/c/4" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Exception to mandatory life insurance</inline>.—</heading><content>Section 2106(a) of such title <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y0c85e7bc-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><chapeau>The Secretary shall insure any individual under 70 years of age who has received assistance under this chapter against the death of the individual except for an individual who—</chapeau><paragraph class="fontsize10" id="y0c85e7bd-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>elects in writing to not receive insurance under this section;</content></paragraph>
<paragraph class="fontsize10" id="y0c85e7be-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>fails to respond in a timely manner to a request from the Secretary for information on which the premium for such insurance can be based; or</content></paragraph>
<paragraph class="fontsize10" id="y0c85e7bf-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>receives such assistance under section 2102B of this title.”</content></paragraph>
