<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x196a76a3-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Mount Hood Cooper Spur Land Exchange Clarification Act.</p></sidenote>
<section id="d182879e98" identifier="/us/pl/115/110/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Mount Hood Cooper Spur Land Exchange Clarification Act</shortTitle>”.</content></section>
<section id="d182879e108" identifier="/us/pl/115/110/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>COOPER SPUR LAND EXCHANGE CLARIFICATION AMENDMENTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x196b12e4-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1206(a) of the Omnibus Public Land Management Act of 2009 (<ref href="/us/pl/111/11">Public Law 111–11</ref>; <ref href="/us/stat/123/1018">123 Stat. 1018</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y196b12e5-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y196b12e6-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> “<quotedText>120 acres</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>107 acres</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y196b12e7-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (E)(ii), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>improvements,</quotedText>” after “<quotedText>buildings,</quotedText>”; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y196b12e8-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in paragraph (2)—</chapeau><subparagraph class="fontsize10" id="y196b12e9-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in subparagraph (D)—</chapeau><clause class="fontsize10" id="y196b12ea-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in clause (i), by <amendingAction type="delete">striking</amendingAction> “<quotedText>As soon as practicable after the date of enactment of this Act, the Secretary and Mt. Hood Meadows shall select</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Not later than 120 days<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x196b12eb-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote> after the date of the enactment of the Mount Hood Cooper Spur Land Exchange Clarification Act, the Secretary and Mt. Hood Meadows shall jointly select</quotedText>”;</content></clause>
<clause class="fontsize10" id="y196b12ec-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in clause (ii), in the matter preceding subclause (I), by <amendingAction type="delete">striking</amendingAction> “<quotedText>An appraisal under clause (i) shall</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Except as provided under clause (iii), an appraisal under clause (i) shall assign a separate value to each tax lot to allow for the equalization of values and</quotedText>”; and</content></clause>
<clause class="fontsize10" id="y196b12ed-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><clause class="indentUp0 fontsize10" id="y196b39fe-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Final appraised value</inline>.—</heading><subclause class="fontsize10" id="y196b39ff-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x196b3a00-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x196b3a01-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to subclause (II), after the final appraised value of the Federal land and the non-Federal land are determined and approved by the Secretary, the Secretary shall not be required to reappraise or update the final appraised value for a period of up to 3 years, beginning on the date of the approval by the Secretary of the final appraised value.<page identifier="/us/stat/131/2271">131 STAT. 2271</page></content></subclause>
<subclause class="fontsize10" id="y196b3a02-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>Subclause (I) shall not apply if the condition of either the Federal land or the non-Federal land referred to in subclause (I) is significantly and substantially altered by fire, windstorm, or other events.</content></subclause>
</clause>
<clause class="indentUp0 fontsize10" id="y196b3a03-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Public review</inline>.—</heading><content>Before completing the land exchange under this Act, the Secretary shall make available for public review the complete appraisals of the land to be exchanged.”</content></clause>
</quotedContent>; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y196b3a04-e83a-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/110/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> subparagraph (G) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y196b6115-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><heading class="fontsize10"><inline class="smallCaps">Required conveyance conditions</inline>.—</heading><chapeau>Prior to the exchange of the Federal and non-Federal land—</chapeau><clause class="fontsize10" id="y196b6116-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x196b6117-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Conservation.</p></sidenote><chapeau>the Secretary and Mt. Hood Meadows may mutually agree for the Secretary to reserve a conservation easement to protect the identified wetland in accordance with applicable law, subject to the requirements that—</chapeau><subclause class="fontsize10" id="y196b6118-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the conservation easement shall be consistent with the terms of the September 30, 2015, mediation between the Secretary and Mt. Hood Meadows; and</content></subclause>
<subclause class="fontsize10" id="y196b6119-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x196b611a-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>in order to take effect, the conservation easement shall be finalized not later than 120 days after the date of enactment of the Mount Hood Cooper Spur Land Exchange Clarification Act; and</content></subclause>
</clause>
<clause class="fontsize10" id="y196b611b-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>the Secretary shall reserve a 24-foot-wide nonexclusive trail easement at the existing trail locations on the Federal land that retains for the United States existing rights to construct, reconstruct, maintain, and permit nonmotorized use by the public of existing trails subject to the right of the owner of the Federal land—</chapeau><subclause class="fontsize10" id="y196b611c-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>to cross the trails with roads, utilities, and infrastructure facilities; and</content></subclause>
<subclause class="fontsize10" id="y196b611d-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>to improve or relocate the trails to accommodate development of the Federal land.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y196b611e-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><heading class="fontsize10"><inline class="smallCaps">Equalization of values</inline>.—</heading><clause class="fontsize10" id="y196b611f-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding subparagraph (A), in addition to or in lieu of monetary compensation, a lesser area of Federal land or non-Federal land may be conveyed if necessary to equalize appraised values of the exchange properties, without limitation, consistent with the requirements of this Act and subject to the approval of the Secretary and Mt. Hood Meadows.</content></clause>
<clause class="fontsize10" id="y196b6120-e83a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of certain compensation or conveyances as donation</inline>.—</heading><content>If, after payment of compensation or adjustment of land area subject to exchange under this Act, the amount by which the appraised value of the land and other property conveyed by Mt. Hood Meadows under subparagraph (A) exceeds the appraised value of the land conveyed by <page identifier="/us/stat/131/2272">131 STAT. 2272</page>
the Secretary under subparagraph (A) shall be considered a donation by Mt. Hood Meadows to the United States.”</content></clause>
</subparagraph>
